I purchased a mother board that was damaged. Sent back to seller. They refuse to credit me or send me a new motherboard and they kept the originalBusiness response

The order is for one A620M motherboard, branded ASRock. The order shipped on January 18th, and was delivered on January 25th. All motherboards ship from us with a fluorescent label informing customers to inspect the product carefully upon receipt, and inform us of any issues without delay.
On March 11th - 46 days after receiving this order - the customer contacted us to say there was damage to the motherboard. The board was returned to us, and showed very clear signs of having been used. Due to the time that the customer had the product in his possession, combined with the clear indications of installation and usage, we can only conclude this damage was not present upon delivery, but rather was causing during the customer's use or installation.
Installing these types of sensitive computer components should be done with extreme caution to avoid the risk of causing damage. Unfortunately, the damage caused to this motherboard has voided any and all warranties on this product.
We are unable to refund or replace a product where incorrect customer use has caused damage to the procuct.

I made a order with MemoryC and got a notification saying my package was delivered but I never got my package I tried to contact memoryC to see if I could get my money back since I never gotten my package and the customer service agent just says it's nothing they can do right now, and I think it's messed up I spend my money to not get what I ordered and now they don't wanna refund me my money back I'm super mad , now I'm just supposed to be outta my money this is crazyBusiness response

This customer claims the order was not delivered, despite us providing evidence to the contrary. A dispute was initiated with the customer's bank, and the bank worked with the customer on a resolution. The bank informed us that no refund was due to the customer, which seems to indicate that this customer either located the package, or the non-receipt case was opened with the wrong seller.Customer response

Our response to the customer's own bank is included below. This bank was satisfied that the package was delivered and they ruled in our favor as a result. Note that due to the time that has lapsed, the tracking link is no longer active as **** only retain online tracking for 3 months from the shipping date.
Response we provided to the bank on October 21:

We have opened a case with **** to have them investigate - case ID ********. **** have interviewed the carrier who is 100% confident the package was delivered inside the customer's mailbox, as stated on the delivery confirmation.
This is a case of package theft from a mailbox. We have advised the customer to file a police report for this federal crime. The customer has ignored our request to file said report, which is unusual if the customer really had an interest in retrieving this package.
We, and ****, are very certain this package is delivered and is either in the customer's possession, or has been stolen from the customer's mailbox. If stolen then we need the police report filed in order to proceed. Thank you.Customer response

At this stage a refund cannot be offered. We requested a police report be flied as soon as the theft was identified. A police report filed 5 months after an incident is not helpful. We did request this be filed immediately, and as it was not, no insurance will cover this theft. We and **** are adamant that this package was delivered successfully, and the issuing bank is also satisfied that delivery was correct and successful.
