On December 20,2023, I called my student loan provider (mohela) and spoken with a representative.I asked the representative "If there was anyone I could speak to in regards to helping me to get my loan forgiven or the payments reduced. She transfered me to a ***************************. He informed me that he was a Senior Processor with ELC (Education Loan Center) located at ****************************************************************************** (that was the address shown on the email that he sent to me). During our ongoing converstations he indicated that he could help me get my student debt forgiven. My first payment was $233 to get started thereafter there was $233.00 automatically withdrawn for my checking account for the next three months (total paid was $932.00). In December through February he would communicate with me reguarly, regarding the status. He asked if I had received any paperwork from Mohela(which I had) and to email it to him. I scanned and attached the paperwork and sent it v-email to him on 2/30/24. He mailed me back on 2/6/2024. in the email he said" My paperwork was being processed. The last time I spoke with him was about the second week in February. Also, he informed me that during this process I should not continue making payments on my student loan until I heard back from him. I have given him my money, my student loan has not been forgiven and I am still receiving emails from ****** showing that I have payments dure and he is no longer returning my calls, text or emails.P.S. I did record all of our phone call conversations (if needed)Also, this is another address found on the paperwork I received: Education Loan Center, *****************************************************************. We have spoken to the client and it was a miscommunication. The application being processed was put into a pending status, Mohela is no longer allowed to process the applications, and she is now waiting for her completion letter. Whenever a client is transferred to us for help with their loans, oftentimes the process can take more than 6 months to complete, sometimes a year. Her file is in good status and standing, and there are no payments due at this time. See the attached letter with her file statusInitial Complaint

I was first contacted by email by a ****** ***** on 12/19 with a follow up phone call around the same time, he made it a urgency that i needed to pay a one time $699 fee to keep my student loans in good standing and to keep them from getting into forbearance he sounded very professional and very inform about loans and things of the sort so i thought it was legit, I paid the fee and filled out all the documents he requested, to be best of my knowledge he didn't reach out to me in 2020, but he did reach out to me this year around July and august with the same phishing scam he got me again this time it was 2 payments of 349.50 one in july the other in august, then it hit me loans are on hold until next year so this time i decided to look into it and check out my student while i was at it when i look at my loans the money did not reflect on the amount at all, i told him that my lender had nothing to do with ELC i question him about my money and i haven't heard from him againBusiness response

Business Response /* (1000, 5, 2021/09/21) */ Its uncertain based on the description what the actual problem is however there are a few discrepancies mentioned that wont match federal records. This client actually reached out to us starting 2018 not the other way around. He contacted us after falling into default for not paying on their student loans. They were in need of help because their wages were being garnished $230 bi-weekly. When a person takes out federal student loans they are placed with a servicer who is not their lender. They are a third party for profit company. His current "lender" he claims actually just lost their contract for predatory lending. His file will actually move to another company shortly. After default happens the client is then sent to the governments collection company which is where we started after he contracted our services. We successfully move the client out of default status and like any other business we charge a fee. Its not a hidden fee, in fact we are required to have multiple forms very simply outlining what its for and when it will be taken. The client signs off on it and in fact chooses their own pay dates. Fast forward years now we have successfully recertified the file over and over keeping it active status which can be shown in the federal files. This person has signed a contract with us in 2018, 2019, 2020, and records show 2021 to where we are currently all of which show active status in the federal database. Each year updating us with tax returns and legal documents. None of this can be done by mistake. Unfortunately if the client is now backing out of the program they will lose their status and will not be eligible for the newly proposed programs. If they believe they will get out of payments they are very much incorrect. Our phone records indicate many calls to this client including 7 unsuccessful attempts in the month of Sept alone. Their file is in limbo and since they are making their own conclusions to what is or has happened then it will eventually move out of the status. Their servicer is for profit and them moving into the programs we help with loses those servicers money. Clients often will listen to them. These circumstances happen all the time. There is a reason we have a great rating and they do not. All phone, email, and completion records will be added to this case verifying against the complaint.
