      The overall concern is that our contractor, ***** ********************* owner of First Choice Landscaping and Hardscaping of *******, **, started work April 14, 2022. Work was supposed to be completed in ***** working days. Work slowed down to sporadically showing up with little communication. He and his crew left the job for 11 weeks (May 2nd-July 20th) with no communication that they were leaving. They returned to the job mid-July and worked intermittently until ***** quit the job on August 20th, 2022 and has yet to settle up with us. We have paid a total of $44,051. As acknowledged by both parties this is an overpayment for the work that has been completed. Out of fairness to both sides we had an independent professional contractor assess the work completed based on the proposal and determine the percentage of work completed of each line item. Based on that we have determined that $16,864 is due back to us as a refund. ***** has acknowledged that he owes money back to us. What ***** believes he owes us back is significantly less than what we are asking. He has stated that he believes he should return back is $7,761. Communication has gone back and forth and he is not willing to consider negotiating. ***** was extorting our money in lieu of a letter from us stating there would be no slander. On August 30th ***** ****ed I will need a written letter stating there will be no slander in any form from you or your wife about me or my company with both of your signatures. I will bring you the check when I come to get my tools and have that signed letter. After that ***** escalated, on Sept 1st Tyler **** Im not going to argue back and forth with you. If you dont want to settle this ourselves then we can go to court and both pay lawyers more than this is worth. He has now stopped communicating all together. Currently, the last communication was a **** to him from us on 9/18/22 with no response from him. It has now been 2 months since he quit and has not returned our money
