      I purchased a 2013 ********** touareg on 12/08/2021, dealer did not disclose that carfax showed structural damage 11/25/2015. I went to the dealer 11/07/2023 to get issues resolved. **** (general manager) told me he did nothing wrong and will not do anything to fix the situation. he says ****** made a error and you need to check with them. he pulled a report from autocheck that doesnt disclose structural damage. this vehicle value is well below the average because of the structural damage. I also signed a damage disclosure that says no to any damage over 25%. any structural damage is over 25% value of the vehicle. dealer address is *****************************************************************

      Upon investigating the matter thoroughly, we would like to clarify that our dealership utilizes AutoCheck as our preferred vehicle history report provider. According to the AutoCheck report, there is no record of structural damage to the mentioned vehicle. As well there is no issue with this vehicle title and this was sold as a good sale in which paperwork was done properly to reflect this as well as the status of the vehicle title as PER NC DMV compliance. We are confident in the accuracy of our disclosure process and stand by the information provided to you.

      Additionally, we draw your attention to the ****181 form you signed during the purchase, where the vehicle was declared a clean title with no damage to the vehicle. This form explicitly states that the vehicle is not flood-damaged, stolen, or a salvage vehicle as well as does not have 25% damage to the vehicle (although) this is only valid for vehicle model years 5 years and newer which yours also is not. You purchased this vehicle in 2021 as well this vehicle that you are writing this about is a 10 year old year model vehicle. 


      We take pride in adhering to the highest standards of disclosure, and we firmly believe that our documentation accurately represents the condition of the vehicle at the time of sale. 

      Regarding the discrepancy with Carfax, we empathize with your concern and recommend contacting Carfax directly to address any potential errors in their reporting. As a dealership, we rely on the information provided by our chosen vehicle history report provider, and any disparities should be rectified through the appropriate channels with them. Including but not limited to also we rely on the physical title and status of the vehicle title as per North Carolina DMV.

      Furthermore, it's important to note that the vehicle was sold under an "as-is" condition, as outlined in both the ****181 form and our terms of sale. We encourage our customers to conduct thorough research on a vehicle's history, including service records, as part of their due diligence before making a purchase of the vehicle.  We do not have to provide you with an autocheck or a cafax report. We simply provided you with this as a courtesy to our customers. 

      We also provided you the auction history report that was inspected before we purchased this vehicle to sell it to you which clearly also showed the vehicle to not have structural damage.

      I am rejecting this response because:
      a dealer has a responsibility to protect the consumer when buying a new or used vehicle. this is learned when you obtain your dealers license! I understand the title is clean and clear, But we all know being in the car business that means absolutely nothing! you may only use autocheck for your own personal reasons which is fine.  we all know that carfax is number one when it comes to vehicle history reporting. luxury auto company has failed me as dealer because I brought you a issue, structural damage brings the value down alot, its the worst kind of accident a vehicle can have that hurts its value. my issue is I bought a used touareg at a value that should have been less if the dealership took the time to protect the consumer, instead of stating it has a clear title we did nothing wrong. The value of my 2013 executive touareg is 14k with current milage. once the Vin is run threw a different dealership that uses carfax and autocheck combine. the value is anywhere from $3500 to $7000 dollars, as a consumer someone dropped the ball and I'm the only who is suffering the consequences of having a vehicle i payed top notch used car price for back in 2021, and I know now the car was not worth that value. I attached the email from carfax they stated the information is true. I called autocheck they told me the information they have is true. I hope to have this issue resolved
