I am filing a complaint against VIP Stables for false and misleading advertising, several breaches of contract and illegal billing. I had to wait to file this complaint until the partnership ended within this last year. 1) False and misleading advertising: The email that I responded to stated: "This newest partnership will be a "No Bills" opportunity to race for BIG purses, jam them in claiming classes where we think they can WIN, collect purse checks, watch them get claimed then repeat again and again and again! IN RETURN FOR NOT BEING BILLED FOR MONTHLY COSTS, partners split the purses earned 70/30 with VIP." The contract that we both signed stated: "No Bills" - YOU WILL HAVE NO OUT OF POCKET COSTS WHATSOEVER FOR THIS PARTNERSHIP. In return for "No Bills" to you, VIP shall receive 70% of the net purses earned (after Trainer and Driver deductions), with 30% to Investors based on their investment percentage. Result: THEY BILLED INVESTORS FOR MANY THOUSANDS OF DOLLARS even after the above advertising and signed contract. 2) Breach of contract The contract stated: "Investment. The initial investment target is $40,000.00, to purchase/claim racehorses in the $15,000 to $40,000 range with the goal of racing primarily at ***************." Result: They claimed a horse for $75,000 breaching the contract above. I was not interested in a $75,000 horse and only interested in $15,000 to $40,000 horses as specified in the contract. I asked to terminate the contract at this point and they said No. 3) Illegal billing. VIP Stables delayed paying veterinary bills from February until April and then passed these charges to investors saying that since the horse did not race in April, investors are responsible. They even paid a 10% late fee and passed that along to investors also. Many thousands of dollars were involved. The horse did race and earn money in February but they delayed paying these expenses till April. More breaches of contract info upon request.
