This company sold me a home with several defects, has done everything they can to not repair same and has now said they will not repair a 3 foot long split in the linoleum floor that has surfaced recently, saying we had 6 weeks to report structural defects. A $172,000 home should not have a split in the floor after one year of being in use. And 6 weeks is not even enough time for structural defects to surface.Business response

Good afternoon. I am writing in response to ID#********* **** ****** **** ******* *** *********** ** ******
Mr. ****** has submitted a complaint stating that, “This company sold me a home with several defects, has done everything they can to not repair some and has now said they will not repair a 3 foot long split in the linoleum floor that has surfaced recently, saying we had 6 weeks to report structural defects. A $172,000 home should not have a split in the floor after one year of being in use. And 6 weeks is not even enough time for structural defects to surface.”
The manufacturer of Mr. ******** home, ******** ***** of Lillington, has repaired every warranty item that Mr. ****** has submitted for warranty with the exception of two (2) remaining items that are scheduled to be repaired by ******** ***** on October 5, 2022 at 12:00 pm.
The most recent item Mr. ****** has submitted is a three (3) foot long split in the vinyl flooring that in Mr. ******** words, "...has just surfaced recently..." The three (3) foot long split in the vinyl flooring has never been reported on any sort of repair list turned in by Mr. ****** or anyone in his family. The manufacturer, ******** *****, provides a one year structural warranty, but they provide an initial 30 day “Cosmetic Warranty" to report things like cracked windows, scratched cabinets, splits/tears in vinyl, countertop chips, etc. because most of those items happen when customers move into their new home, rearrange furniture, buy new appliances, etc. and the factory does not warranty issues that were caused by consumers. The fact that Mr. ****** moved in his home almost twelve (12) months ago and is just now, for the very first time, reporting a three (3) foot long split in his vinyl flooring, I think it's safe to assume that it didn't come that way from the home manufacturer, and didn't occur at any time while Down East Homes was completing construction of Mr. ******** home.
On July 14, 2021 Mary ****** signed paperwork acknowledging the 30 Day Cosmetic Warranty, and the Cosmetic Warranty is also included in the Warranty Information provided by the Manufacturer that Mr. ****** has also received.
At this time we ask that this complaint be marked resolved based on the information provided. If any further assistance is required I have included my contact information below.
