There are different transaction dates; therefore, attached is a complete explanation for this claim. In summary, we ordered a bed specifically on the basis that it matches our current furniture. We paid a deposit of $492 which included a color match fee. After three months of miscommunication, unprofessionalism, and the bed being built without our prior receipt or approval of a color/finish sample, we are requesting a refund in full which has been denied by Amish Oak & Cherry, Inc.

order placed5/10/24,see on the invoice no sample was ordered, customer brought a drawer to use as stain guide.attached is all email correspondence we have had with customer since ordering.also attached is sales condition sheet& wood character sheet signed by customer at time of purchase.Customer agreed to all terms&conditions&knew ahead of time all deposits were nonrefundable.it is listed on our invoice&sales conditions form.notified customer order was to be complete midJune, after this email customer said they requested a sample for approval.Once customer requested the sample we did order a sample.Next contact was to notify customer we received the bed, they refused to come in and inspect the bed in comparison to the drawer,we ordered the sample, received the sample, notified customer we had the bed, samples,&drawer available for inspection.customer again refused to come in&inspect.we did provide pictures, however pictures are taken by an old ipad,in a warehouse without good lighting,we did notify customer they needed to come in&inspect in person,as inspecting by pictures were not accurate.in the attached email correspondence you will see at no point was anyone condescending, customer stated they did not want to drive the distance to inspect the bed they ordered.I did agree to mail the wood sample, however we could not mail the drawer, due to liability.customer got upset over this email.we have fulfilled the order, in a custom stain specifically to match the customer's bed.customer refused to inspect the bed with the drawer and when the sample was ordered as they requested they then refused to come and inspect the drawer, sample& bed so they could see in person everything matches&was built exactly to their request. we cannot refund money on an order that was built exactly as requested,in the lead time quoted, because the customer refused to come in and inspect the order.Amish Oak&Cherry will not refund any monies when we fulfilled the order&completed the order as requested.

I am rejecting this response because:

      - Attached is document confirming a sample was requested at the beginning of the process (see Attachment A)

      - Attached is email from **** referencing the sample and why it was not initially provided to us (see Attachment B)

When we ordered the bed, it was never our intention to cancel the order; however, as stated previously Amish Oak & Cherry has not provide the level of service due to us.  We never requested that the drawer be mailed back to us and this was communicated to Nikol.  We were specifically requesting that the sample be mailed as we were told it would be in the beginning of the process.

Attached are photos of the sample that just happened to be inside the drawer when we picked it up.  As shown, it does not match our current furniture which was the purpose of ordering the bed in the beginning.

All of this mishap could have been avoided if Amish Oak & Cherry had followed the process that was discussed initially which included sending us a sample prior to building the bed and taking ownership for it not happening as it should have.  We are requesting a refund in the amount of $492.80.

We tried to accommodate all requests by the customer, the order was fulfilled along with the custom stain samples, the customer refused to come in person and inspect the items, and has refused to pay the balance and complete the transaction, which in turn forfeits the 25% deposit.

We have the bed in our warehouse, and it is still available for the customer to come in and inspect and complete their transaction, being that this was a custom order specifically for them.

We will be happy to schedule the inspection anytime they would like to come in.  If they continue in the order cancelation the 25% deposit is forfeited as this is our policy and always has been.

      Thank you for your time,

      Nikol

I am rejecting this response because:

This latest response from Amish Oak & Cherry is another example of the rhetoric we have been dealing with for four months now.  We continue to reiterate that the color/stain does not match our current furniture which was and still is the ultimate goal.  There is nothing custom about the bed other than a color match and it should not have been painted/stained until the sample was provided and approved as acceptable by us.

Amish Oak & Cherry has created a rapport that is demeaning and irreparable; therefore, we are no longer interested in continuing to do business with them.  We ordered the bed over four months ago and they have continuously been untruthful about the process and still has not taken ownership for their own error in having the builder paint/stain the bed prior to us approving the match.  If the sample had been provided in the beginning as **** led us to believe would occur, this entire situation would have been avoided.  As previously stated, there is no need to waste time going to inspect the bed when the photos provided and the samples we have which were never sent but happened to be in the drawer when we picked it up confirms that the bed does not match our current furniture.

We are requesting the refund in the full amount based upon a breach in the process by Amish Oak & Cherry and also the bed not matching our current furniture based upon photos and the samples.
