      ******** Stone (Stone Landscaping) signed a contract to install sod at my residence. He took a $900 deposit in order to secure the sod. He scheduled the job based on his schedule and has since missed that appointment and 4 additional rescheduled appointment. He is now not responding: no communication, no service, no product!

      I met with the owner, ******** ********************** on 5/28 in regard to delivery of sod and seed( ***** sq ft of Bermuda and grass seed). Full payment was collected in the amount of *****. ******** was discussed and agreed upon for 6/4. Mr ********************** advised that the location in *********** where he was to pick up the sod ran out, it was a first come first serve basis. Full balance has been paid to Mr ********************** so he could pay for the sod. Multiple text and calls have been made to the owner and he has not returned any communication. A service agreement was created for this job.

      First, I have tried to resolve this issue with the owner. The owner, ********* Stone, agreed to a resolution and then did not follow through on the agreement.This contractor claimed to have experience and knowledge to complete drainage, grading, hardscape install and sod installation. He should have NEVER taken the job and did not have the experience or knowledge to complete the work. We were out of town and told the job was complete, so STUPIDLY we paid for the work after seeing a few carefully taken pictures he sent.Upon returning, APPALLED. Work done poorly and incomplete.* The fill dirt was not purchased or installed * The top soil was not purchased or installed * The sod was not purchase or installed * One drainage pipe was not replaced at all * One drainage pipe was only partially repaired * The three drainage pipes that were connected used perforated pipes instead of solid corrugated pipes. This is the INCORRECT pipe to use, and cheaper than what we paid for.* The drainage lines did not have the correct fall line. Water backed up and seeped into our basement, creating an emergency.Damages:* Electrical wire pulled going from the house to the pool * A deck drain was broken off the patio * Bricks were damaged * Pool fence damaged * Gutter damaged * A 50 foot border of grass destroyed and left as mud * The installed incorrectly Attempted to contact the owner. He would not return calls or respond to our requests.On June 4, we disputed the second half of the payment made for completion of all the work.******** contacted me on June 8 after receiving our payment dispute. After discussing he agreed to accept the dispute and not charge the $5000 since the dirt, topsoil, sod, and drainage pipes were not installed.He contacted our credit card company and disputed the resolution we agreed to. He is also committing insurance fraud by filing a claim for non-payment and loss wages after receiving our payment.

      The work was completed as requested. The customer *********************** had asked us to do him a favor so I agreed to help him while we were there. He asked us to replace one more drain and when we pulled it up It damaged our work that we had did but I did give him a warning before doing it and he said he would take the risk. We did remove all of the concrete, bushes, as requested. I did not charge them labor for the sod install because they canceled the order. I did not give them the money back for the sod because I can not get a refund for the sod from the sod vender. These people have tried to accuse me of doing things wrong and the materials being wrong even down to when I started laying the river rock which was one of the first things I did. I did the work as asked. I sent them the photos and theyre were happy when they paid the bill and now they are not. I offered to fix anything that was wrong and they declined it.

      I am rejecting this response because:

      The majority of things stated in this response are not true.

      True: The river rock, bushes and trees were removed. $7500 was paid for this work and materials.

      Not true: There were no "favors". This was a professional agreement by both parties for work being done.

      Not true: The drainage work that was done was incorrect and caused severe drainage issues on our property. We contacted the merchant without response and had to have another contractor dig up and repair the work, complete the final grading, and install sod. 

      Not true: Stone Landscaping did not pay for sod or other materials to complete the final grading or sod. I verified with the Sod vendor that Stone Landscaping did not pay for sod for our property. 

      Stone Lanscaping agreed via phone not to charge the second $5000 payment due to the drainage issues and sod not being installed. He then disputed the payment amount with our credit card company. 

      This contractor was not experienced in nor capable of completing this work. He has been dishonest and has not taken ownership in this disaster. I encourage him to do the right thing and move forward with his lawn mowing and pressure washing business and never commit to this type of landscaping work in the future.
