On 4/13/2021 I contracted with Woody Exteriors (***********) to have my roof, siding and windows replaced. I provided a $20,000 materials deposit with the expectation of work to proceed in approximately 4 - 8 weeks. After having this date pushed out several times with no firm commitment, both **************************** (******s wife and office business manager) have ceased responding to emails, phone calls and text messages. Please note, there are two contracts, one for roofing and siding, the other for windows. I believe this was done to keep each contract under $30,000 to avoid licensing requirements. I have attempted to contact them through all available methods since September 2021 and have been ignored. I want my $20,000 refunded to me OR receive delivery of the materials if they have already been purchased with the materials deposit. I will only accept materials if they are complete, what was ordered and in new condition.Initial Complaint

This company will not return my texts or give me an idea of when the materials we have paid for or the work we have contracted will be started. They have been unresponsive and have held us and our money hostage. They contracted to do the work and do not have the resources to complete the work.Initial Complaint

Initially met with Woody Exteriors Oct 2020, took 51/2 months to get estimate vinyl exterior siding, windows, demolation and construction of new deck. Total estimated cost $36,031.88 with a deposit of $14,435 at contract signing March 3 2021. The contract stated work would begin as schedule allows and the contractor would keep the owner informed. Two calls to office staff who counted with multiple excuses of illness, employee arrest, wrecked truck, material orders delays and other jobs ahead. I demanded to see materials order which made on 8/5/21 (If material delays were a problem why was the order put in 5 months after the contract/deposit?) The order sheet had incorrect figures and did not have the Suppliers name. I am concerned this is a scam order sheet. There was no evidence that any of the deposit was used to pay for anything on this job. 9/17/21 call asked for refund of deposit. Office gave two options, wait for them to get to the job, or they would file for bankruptcy.Business response

Business Response /* (1000, 5, 2021/09/17) */ Definitely no scam. We have been heavily effected by Covid and a series of other catastrophic incidents beyond our control. I could list them all but they are only see as excuses to others when they are real life tragedies for us. We have never taken anyone's money, not intending to do the work. We have customers that have been waiting since last summer and we will still get their work done. We could never have anticipated the many things that have contributed to our current situation. We will be filing bankruptcy but were trying to complete all outstanding contracts before doing so, so that no one loses their deposits. That is the morally correct thing to do. We don't want anyone to lose money they gave us and we never intended for things to happen like they have. We will continue to do jobs in the order they were comtracted unless we are forced to file bankruptcy sooner by anyone unwilling to wait. We've been 100% honest with everyone about their material orders and the many things causing delays. We are a small company that charges way less than our competition. Small companies are going to have more problems without the financial strength to recover from them. Understanding customers will wait for the quality work ***** delivers, others will sue us. We are doing all we can to survive and have never taken money without intending to do the work in a timely manner. Again, circumstances beyond our control have caused us to go bankrupt. We would like to postpone filing to protect the interests of our customers, however some homeowners may force our hand at proceeding with filing in order to protect ourselves from litigation. This isn't just a matter of us being one of over 150,000 small businesses meeting their demise through an international pandemic. It is our family at stake, as of next week, we will be homeless. We've not done anything with anyone's money except try to keep the business going and a roof over our heads. It has been devastating for us and we are doing all we can to protect other people's money by doing the work before we file. Our attorney has instructed us that once we file, the contracts are null, the homeowners lose their deposit and we don't do the work. That is the worse case scenario for everyone and the only way we can avoid it is patience on the homeowner's part. We have customers that have been waiting for over a year and they understand what we've been through. We have never lied to anyone. Situations have caused what we believed would be possible to simply not be. It disgusts us that this has happened. We are financially ruined and our reputation will be destroyed by the couple of customers that refuse to believe we had honest intentions. We are truly sorry this has happened to our small business, our family and consequently those who put their trust in us. No one would choose to have their company, their livelihood run in to the ground but for us, that has happened. The employees we've had have turned out to be thieves or drug addicts which we don't tolerate. ***** has worked all by himself many times while I've looked for workers. Again, everyone sees it as "excuses" when they are the honest and true reasons we've lost everything. Yet we are still trying to get the jobs done that we were contracted to do before filing bankruptcy. We've not taken on any new work since May because we didn't want to take on more work than we could do. That shows we aren't "scamming" anyone. We've turned down dozens of jobs because we can't get to them. The ones we accepted, we thought we could get to in a timely manner which ended up not being the case. There are several people that have grown tired of waiting and we understand that completely. There has not been a single day that ***** has not worked, he can only do so much by himself and he cannot control the material issues that are still occurring all over the country. It looks like this customer would prefer to lose their money than wait for us to get their work done, that is unfortunate. Appears you took jobs and deposits when you could not get to them in a timely manner. I'd also bet you spent the deposits on things that had nothing to do with the job the deposit was intended. The only satisfaction I can envision is completing the job with monthly draws determined by me or obtaining judgement. The legal process will start this week.
