      I contacted Servpro of Lexington Thomasville after a fire at a rental in Thomasville. On April 2, I signed a contract with their corporation CHD? and then received copy of papers from Craig H*****. Line Items Servpro was going to complete for $31, 898.00. The project started May 1, 2021 and I gave them a check for $16,000 (50% of total up front). The house was cleaned of burned beds, tv, chair and table. All sheetrock was removed in 2 rooms, half of kitchen and in bath. The burned vinyl on the front and back porch was not removed. I was told the house would be completed in 30 days which would be May 30. That date went by and June came. I asked if the house could be completed by July 30 and I was told we were on schedule to do that. Very little was done in June. July 3 came and nothing was being done. I went to ***** and purchased light fixtures, windows, cabinets, kitchen sink, commode, surround, bath sink cabinet, medicine cabinet. I then called Mr. H***** and told him I had purchased these items. On July 26, Mr. H***** went to ***** and picked up the cabinets and took them to his business. He picked up the tub and installed it at the house, charging me $375 dollars to pick it up which I had not agreed to pay. On July 29, Mr. H***** had the front window and vinyl siding put on the front porch. They left and did nothing on the back porch. On July 27, Mr. H***** informed me I owned another $9,000 dollars and if I did not pay it, work would stop. The house was to be finished by July 30 and I needed to get the house completed so it could be rented. August 5, I contacted painter, carpenter, electricians, plumber and vinyl siding people and got the work done at end of August. Mr. H***** was demanding his $9,000. I was not paying him for work he did not do. We went to court and I found out the electrician fee of $5,000 that I was being charged, Mr. H***** was only paying $1800 for the entire electrical work. Only a small portion was finished by Mr. H*****'s electrician so the fee would have probably been $500 or less. This is 10 times the price! Also in the "new" line items that I did not agree on, Mr. H***** charged for detaching the tub, removing the surround/tub, picking up the tub with me paying $159 for the tub, the tub only costs me $1,000 and this was without running water in the tub, no surround or faucets. There were other issues also. I have contacted the Attorney General of North Carolina, Josh Stein, to make him aware of what is being done by this company.

      We have addressed this customers complaints with her, and in court. This is a 4 room rent house. Siding and windows were ordered as agreed, we paid 1/2 up front to have them manufactured, during the pandemic, over a year ago, lack of supplies and transportation were common and Servpro had no control over the time-line of manufacture and delivery. The financial agreement with this customer was 50% payment up front, 50% payment when the job was 80% complete and the last payment of 20% upon completion of the punch list. Servpro was with in 2 weeks of finishing this project. When asked for the second agreed to payment, this customer refused, even though she had a line item, not to exceed, invoice, we stopped working because we had other paying customers. This customer has a judgement against her from the Davidson County Magistrates office for breach of contract and lack of payment. Servpro was awarded her cabinets as part of that judgement. The cabinets could not be placed in the rental property as it was not securable due to the windows and siding not available to be installed. Again, logistical issues beyond our control drove the timeline. We had an agreed to pricing structure in writing that was not complied with by this customer. The project was coming in under the not to exceed budget but with lack of payment we could not continue working on this project. We regret this situation and have tried to be fair to settle this.

      I filed this information with BBB to help other people that might find themselves having to get a house restored after a fire. I would suggest that they go to the Davidson Country Clerk of Court office and look up file number *********. This file will cover the magistrate court, District Court and what took place in each court and the questions my attorney asked plaintiff. Plaintiff's attorney asked for dismissal of plaintiffs' case in District court after my attorney asked plaintiff 3/4 questions. The case did not last long enough for me to testify. Plaintiff took the cabinets that I had purchased from Lowes with the pretense of installing them in the house. The magistrate told him he could not do that, but he did. The magistrate awarded plaintiff the amount he wanted but subtracted the cabinets from that amount. The magistrate did not ask plaintiff for any cancelled checks, nothing to show what plaintiff had actually paid for anything and she did not know what he was charging for. Just a modified invoice with incorrect dates and an amount that plaintiff made up without any verification. Also, plaintiff charged me $375 dollars for picking up the stolen cabinets which I had not agreed to pay since the plaintiff was supposed to be purchasing, picking up and installing the cabinets but the magistrate awarded him the $375. I did not know magistrates give money for stealing property. My attorney was able to show this invoice was all fabricated and I was being charged on electrical work at least 10 times what plaintiff actually paid to his electrical contractor. When this point was made, plaintiff attorney asked for dismissal. I filed a complaint against this magistrate. She had nothing to prove this money was owed to plaintiff and she did not know what plaintiff had completed or needed to complete or what he was charging for. I had to hire an attorney out of Greensboro to get this matter settled. Plaintiff apparently doesn't remember we were in two more courts after the magistrate court. In the last court, plaintiff asked for the case to be dismissed. I do not have a judgement against me. This was settled in the District Court of Davidson County, NC. This man just cannot tell the truth. Another point, according to papers I signed on April 2, 2021, with plaintiff, the house was to be completed in 30 days which would have been May 2, then he changed it to May 30, then he was right on schedule to have it completed July 30, 2021. I had purchased 2 windows on July 3 for the house and the windows could have been installed on July 4, 2021. On July 30, no cabinets, commode, light fixtures, heating units, flooring, painting, doors, etc. I purchased all items to put in house because plaintiff would not work on the house and I did not have any way of forcing him to finish the house, he could have taken another 6 months and there was nothing I could have done. As far as him finishing the house in two weeks, plaintiff went on vacation July 30 and returned on August 9. That gave plaintiff 4 days to complete house in "two weeks" and he had purchased nothing for the house. August 14th/15th Saturday and Sunday. The fire was February 1, 2021, and I started work on the house on August 3 and I did not get the house finished until September 15, 2021, when I rented the house. Plaintiff's attorney asked for dismissal of case in District Court. No judgement for plaintiff. Defendant had to pay her Greensboro attorney and was happy to do it.
