This business sold ** a salvage car that cannot be registered so we are now stuck with a car that cannot be driven and a loan of over $7000. The car report history shows that they have sold this car multiple times only to have to take repossession of it again so it seems that they know about the issue and were just trying to offload it on the next unsuspecting person. The owner refuses to respond to our emails and texts.

      Business response

      06/19/2023

      Good day.
We sold a Salvage title unit and disclosed this in our advertising and all the accompanying documents per our ** state laws and this was also disclosed to the  lenders.  ************** is responsible for his state requirements on what is needed to registered a SALVAGE vehicle. The car report is not something I control and that's  a Carfax history and we have no control over that.  I have attached the title to show that we indeed got the vehicle from a CARMAX auction and at no time have we resold the unit several times as indicated by the client. We aren't legally a BHPH lot and don't engage in those practices and aren't aware of the issues that are indicated in the complaint.  We completed the ** inspection as required by our state law and the vehicle passed our State inspection.
"The owner refuses to respond to any of our emails or texts" this one statement is completely untrue.  There have been no emails, if there are please have ************** provide them and the text context he is more than welcome to provide that as we have responded to all texts, with the last one being on 6/17/2023 in which I indicated that we were closed for the holiday and will call  him tomorrow 6/20/2023 to talk to him.   We have responded and called ************** through out the entire registration process.
************** seems to have purchased a unit, without understanding his state's process and that happens.  However, we didn't offload anything to an unsuspecting customer, we simply sold a disclosed SALVAGE title unit that is legal in our state.  We strive to find reasonable solutions that might occur during a transaction.  This situation is simply one that occurred as a result of the client not understanding his state law requirements for the type of vehicle he purchased,  We are in communication with ***************

We continue to work with our clients.  Let us know if you need anything else.

I am rejecting this response because:
After conversing with the owner today we were unable reach an acceptable agreement. They sold an overinflated vehicle to a 17 year old girl without an adult present, and presented documents for my signature via email against my better judgement as I was attending a wedding on the other side of the country.  When I went to have it inspected in ******* to gain a rebuilt title, it would not pass a safety inspection due to the airbag light being illuminated on the vehicle. 3  separate mechanics could not get the software to stay in communication long enough to pull codes to fix the issue due to the vehicle not allowing the software to communicate with it, 1 prior to a clock spring installation and two after the installation.  The 4th mechanic, a VW dealership, confirmed the same thing would likely happen as the 3rd mechanic uses the same software the dealership does, but works with older generation VWs. The owner refused to buy back the vehicle as it is not able to be titled in the **************** due to being an unsafe vehicle.

Yes we communicated with ************** on 6/20/23.  We didn't sell a vehicle to a 17 year old girl without an adult present.  We sold a vehicle to ***************************** and the transaction was completed electronically.  All the documents and correspondence will attest to that fact.  We set a sale price and that sale price is accepted and rejected at any consumer's discretion.  **************, accepted that sales price.

************** indicated that he had inspection issues.   Please note that we are a licensed dealer in the *********************** and adhered to all the safety laws applicable to our state.  We conducted the required state inspections,  we disclosed all applicable information stating the fact that this was a salvage/rebulit title.  ( See attached documents).  The vehicle was purchased as is and as he stated he has had some installation done on the vehicle.  Buy back was the only option he indicated that he would accept.

We understand in this instance, the outcome was not what ************** desired. The unit was sold as is and all the disclosures were signed by ************** in this instance.

I have attached a couple of documents.

The As IS statement Signed by Mr. ********************* damage disclosure in which we indicated to ************** that he was indeed purchasing a Salvage Title Unit.

Correspondence with **************, we have always been in communication with Mr. ************************ Report History. We purchased the unit in March 2023 and have never resold the unit multiple times as indicated by Mr. ************************** inspection Certificate

      Thank you.

I bought a vehicle from this company in December 2022. I did my due diligence and brought it to a mechanic the next day. The mechanic was unable to see any issues because unbeknownst to either of **, the engine bay and undercarriage had been spray painted to conceal major issues that wouldve been apparent from a visual inspection had the paint not been there. It needed tires right away, the paint has started to wear off and issues are becoming apparent, ive needed all sorts of new belts, bolts on the exhaust had been drilled out and caused a major exhaust leak, and my engine is failing for many reasons. I was lied to by the owners wife at H Group Auto, she said that it was in great condition and reliable and that she was excited that I was going to have such a good car.

      Business response

      06/02/2023

      Good day.

As indicated in the complaint ********************** purchased a 22 year old vehicle specifically,  a **** Jeep Wrangler from our establishment.  By her own account she took the vehicle to the mechanic and there weren't any issues based on the assessment of I presumed a licensed mechanic.  ********************** has never contacted ** directly as this is the first communication on the routine maintenance issues that she encountered on a 22 year old vehicle.  At no point in time did we "lie" to Ms.  Gainsborg.  All our units are purchased AS IS  as indicated in the attachment  and she signed off on the document attached. ********************** never once called, never gave ** the option to offer our wholesale services etc.  We try to work with all our clients but the fact is that ********************** purchased the vehicle as AS IS.  Thank you.
