I hired **** to handle the plumbing for a basement in-law suite at the address stated above. **** was hired to complete the underground, rough, and final. We had a contract in place and payment was broken up into 3: Payment 1: Down Payment/Undergrounds - $3K Payment 2: After passing rough inspection - $3K Payment 3: After passing final inspection - $3K It was discussed that at the time, **** was working for a company as an estimator (****** ************ *********), but still held an active license and insurance. He said that he would complete the job on the weekends, could take time off from work, and also had helpers. Although the permit was applied for and not received when the contract was put in place, we had discussed timeline and completion dates and that was not an issue. **** said he definitely had the availability to take on and complete the job. I had paid **** the $3K deposit and he had come for 1 day to trench and set the grinder pump (which I had paid for). He did not purchase or supply any material that first and only day he showed up. After that first day, ****'s communication became poor. He did not show up the following weekend to continue working although he said he would. He did not inform me either that he would not be there. I attempted to contact him numerous times and was struggling to get ahold of him. I was finally able to get ahold of him and he stated that he had a death in the family and would be there the following weekend. The following weekend came and he did not show up or let me know he wouldn't be there. This pattern continued multiple times. He said he would be there and then would not show up. It finally got to the point where I could no longer trust him to show up and getting a response from him was very difficult. He would not answer my calls and said he wasn't receiving my texts even though he received them and was responding to them prior to the down payment.
