I contracted with Grizzly Steel Structures to assist in the design and construction of a metal building. The structure was completed in July '23. In Feb '24, I had workers to my property. Upon putting up scaffolding inside the steel structure, it was noted at the top of some 14' side walls and a portion of the roof that peaked at 18' an inferior product had been substituted for the product I paid Grizzly for (single bubble instead of double bubble insulation). As the products look similar from a distance, this was not discovered visually from the ground. Upon this discovery, further inspection took place by us and it was noted the insulation also covered workmanship errors including holes that were cut too large in the metal siding of the structure. I reported the issues to Grizzly along with the company they contracted with for the build, Five Star Metal Buildings within days (Feb '24) and well within the 1 year warranty for the building. Per the request of Five Star, I did not proceed with any work at the time to allow Grizzly and Five Star the opportunity to investigate in person if necessary. I explained that I could not stop work indefinitely as I risked losing my contractor, but would stop work to allow the companies time to follow up/investigate. I also decided to report additional issues I originally chose to bypass as all the problems started adding up to more and more. I supplied pictures and videos of all the issues discovered to both companies. After 2 weeks of no follow up for inspection, I stated I had to start work. I proposed a monetary settlement well below the cost of repairs and both companies agreed to a resolution of $1000 split between them. I returned the executed "Final Resolution" letter to both Grizzly and Five Star on April 2, 2024, both of whom confirmed on April 3, 2024 their receipt (********************* of ******************************************** of Five Star). I was informed a check would be sent in 3-5 weeks. It now has been 6 weeks with no payment processed.Business response

I contacted Grizzly Steel Structures for a quote on 9/24/23 for a metal building. I received a quote on 9/25/23 and we agreed to the final price. Bryan, the sales representative, stated that a deposit was needed to get the building in production and schedule install. I paid the deposit on 9/29/23. I received a voice message asking for site pictures for where the building would be on 10/3/23 from ** ********. I did not answer the call due to I didn't do business with ** ******** nor did I know why they were calling. I then called ** ******** on 10/3/23 for clarification on what was needed and to verify they were affiliated with Grizzly Steel Structures. Site pictures were sent on 10/19/23 to the number that ** ******** provided. The building we ordered is a 12ftx 40ft building and I explained that the site was prepared to 17.5ft x 55ft to allow for installation. ** ******** nor Grizzly Steel Structures attempted to schedule the install after the site pictures were submitted. I called multiple times (10/10, 10/19 and 11/15) to get an install date with no return phone calls or communication. The install was finally scheduled for 11/30/23 with an arrival time before 12pm. No crews showed up on 11/30/23. I called Bryan at 2:25pm and stated no one showed up. He assured me that the crews would be there that day (11/30/23). ** ******** then called and stated that the crew would not arrive until 12/1/23 with arrival time of 8am- 10am. Again, no one showed up. Bryan was made aware and again stated that the crew will get there that day. I spoke to ** ******** and they stated they did know when the crews would arrive or what time. The lady on the phone stated she doesn't know where the crews are all she knew was that the crew was in TN but didn't know where. I relayed the message to Bryan and he again assured that the crew would be onsite 12/1/23. At 8:38pm I texted Bryan that the crews still had not arrived and to return my deposit.Business response

Hello, we sincerely apologize about the inconvenience of this situation. The installation crew had a delay on their previous building/job before going out to erect yours, hence this is traveling construction. On the agreement that was sent to you for electronic signature, it does notate that "Buyer agrees to give Seller up to (3) installation attempts to deliver said product." (Picture Attached) because this is travel construction and some delays can be expected. With that being said, once the crew arrived, the installation site was off-level by approximately 30 inches (Picture Attached). The building specialist did advise that when doing ground installations, sites need to be level within 3-4 inches. On the Ground Level Disclaimer, it also mentions that the site needs to be level with 3-4 inches in which you also signed (Picture Attached). Since this was about 30 inches, the installation crew was not able to erect this building on your property. Unfortunately, a refund cannot be issued because 1) the down payment is non-refundable (Picture Attached) and 2) the installation crew went out and was not able to install the building because Mrs. ****** was not able to meet her end of the purchase agreement.

I am rejecting this response because:
The site pictures were provided before the install appointments were made and then not shown up for. Had the site been unable to be installed on it should have been addressed during the 6 plus weeks that it took "crews" to show up. Again, the "crew" was here less than 20 minutes and you could see by their actions and attitudes that they had no intentions of installing the building. Considering the "crew" did not show up when they were scheduled, were unable to be located by the woman who answered the phone at ** ******** and I quote "I don't know where in TN they [the crew] are but they are in the state of TN is all I know." The same woman also stated that she called and texted your "crew" but hadn't received a response from them since the day before. The lack of communication between the "crew", the sales representative with Grizzly Steel Structures and ** ******** is deplorable. You can't even keep up with your own install partners to perform any work. We told ** ******** and the sales representative with Grizzly Steel Structures when we were and were not available. I told the same woman with ** ******** that we would not be available on 12/2 as we were supposed to head out of town. We were walking out of our door to leave when the "crew" showed up 3 days after their scheduled appointment. For 3 days we were told "they [the crew] will be there for sure today, absolutely don't worry they will show up today." That never happened. We were not told they would just show up at random and when/if they felt like it. According to the text messages from the sales representative with Grizzly Steel Structures he had his manager involved due to the no call/no shows by the crew. I received zero communication by any party that the appointment time was going to change/be canceled etc. I received zero communication until I called and texted repeatedly to get an answer as to why no one showed up. So, no your "crew" did not show up on the 3rd attempt. There were multiple confirmations at different times made by the woman who answered the phone at ** ******** and by the sales representative for Grizzly Steel Structures, that no one showed up for. You knew that the "crew" had already breached the "contract" and were looking for any reason to not install the building. Furthermore, since the "crew" left after refusing to install the building, we have not been contacted since to even attempt to make anything right. Had this been handled appropriately we would not be communicating through the BBB. I've not been contacted about scheduling another time for installation or how to proceed moving forward etc. Nothing. At this point all you have done is stolen my money for a building that you never planned to build. This has cost me my deposit and 2 days worth of work wages while waiting for your "crew" to show up. You had no intentions of installing the building, you have no intentions of making anything right and you didn't think you'd be held responsible for stealing my money.Business response

Again, we apologize for the inconvenience this has created but the installation crew had all the right intentions of erecting this building up. The crews do not get paid until after the building is complete. To my knowledge, there is no crew out there that would like to go out to the job sites at their expense and not perform the job just because they didn't want to. Like mentioned to Mr. ***** on the review, if you claim that your site is level now, the re-stock fee will be waived for this one time and you will be put back on schedule. The scheduler did advise that in your area, you are looking at 8-11 weeks out on installation. Please let us know what you want to do.Initial Complaint

On October 17th I put a deposit down on a metal building to be built in **. Unforeseen circumsta**es happened and a job opportunity took us to ** instead. I understand this isn’t the businesses fault but after discussing what options I have for a refund/partial refund of my deposit it was out of the question for them. Not only that but when I was asking questions about my options I was talked to in a very rude tone by the employee. The building tripled in price for **. I can’t even sell the building to someone else to help recoup my deposit because the company says the building is “tied to my name”. So I’m out $4,100! The company gets to eventually sell this building to someone else and gets to keep my deposit. I just want my money back or a least a portion of it.Customer response

Good Morning,
We tried finding a solution with this customer to install this building now in the state of **. Due to different engineering certifications and building requirements, the price of the building there and from where she originally purchased from (**) are not the same. Unfortunately, this is completely out of our control. As stated on our contract that she signed, it lists multiple times that the down payment/deposit is non-refundable. Unfortunately, we cannot refund this customer.
