      Contracted with owner of Brunswick Fence Works to have a fence installed. A check was given to the owner for $ ******* as a deposit for the job and materials. The remainder of the quote was to be paid upon completion of the fence. The owner stated the project would be completed in 8 weeks. I have contacted this owner multiple times through email and he continues to make excuses for why he can not complete the job AND refuses to issue a Refund. It is now Jan. of 2023 and I still have no fence and he refuses to refund my deposit. I would like to receive my Money back that he is still holding on to.

      Unfortunately, the owner responded with untruthful information. I filed my complaint earlier than his issuing the refund. He FINALLY did take a refund check to a 3rd party Friday after my complaint. I was notified at 1:20 pm she had the check in her possession. And he continues to state I was on a "smear campaign". I simply wanted a refund of my monies for a job not completed after waiting over 6 months and trying to resolve on my own. I have received that now. Thanks for your help in this matter.

      This fall my neighbor and I contracted with Brunswick Fence to supply our respective properties with estimates for the purchase and installation of fencing. Brian from Brunswick Fence came to our properties (adjoined), measured and determined the amount of fence and the labor involved. Upon receipt of these estimates, my neighbor (******* ******* and I determined that the costs of labor (installation) was more than we could afford. At this time we negotiated with Brian the purchase of just materials with the intention of installing the fencing ourselves. Part of this negotiation included any possible additional materials needed or any credit for unused materials. Brian even offered personnel, subject to availability should the job become too much. This would be at an appropriate hourly rate. Brian agreed to this, which at this point we paid over $8000. for all of the materials in full. Fast forward the items were received and installed on our respective properties, with 3 sections and 4 posts left over to which we contacted Brian for credit of these items. After text messaging this negotiation, he agreed to $200. for the seven items which he offered to pick-up, as he reported that he could use them on another job. To date he has been unresponsive to continued calls and texts to fulfill this last element of this business transaction. We desire no more than the $200. he promised and to pick-up these items that are of no use to us.

      Business Response /* (1000, 5, 2022/02/01) */ Mr. ****** called me to give an estimate. It was more than he wanted to spend with the labor. So I offered to supply him the material for whatever it cost me. There was no contract between the three of us. (**** & his neighbor) It was only me helping someone out. When he and his neighbor completed their job, they had 3 sections of fencing left. He called me and asked what I would give him for it. At the moment I was 3 sections short on another job so I told him I'd take it for $200. Ultimately I found some I already had in stock and used it rather spending $200 extra on the job. The price I gave him was for new fencing that was still in packaging. He had loaded this material for transport to his property, unloaded it, and moved it around his where it still rests today. Out of 2 jobs, 1.5 sections per job is great residual. He obviously didn't make a cut where we would've made a cut this leaving him extra material. This is what helping someone out gets you in the end. Consumer Response /* (3000, 7, 2022/02/03) */ (The consumer indicated he/she DID NOT accept the response from the business.) Interesting response. However a few facts omitted. He fails to mention that him came out to our properties and measured for the required materials to do the job. The amount ordered, and paid for was based on his measurements. Had he installed the fence I doubt he would have left the un used materials. He failed to indicate that we paid him in full upon ordering months prior to us picking up the fence. He verbally told us that if additional fence was needed it could be purchased and we would receive credit for extra. When we agreed to install the fence ourselves, he just told us to pay him for the materials in the original estimate. Those materials as all materials are billed at retail. His claim that he sells materials at his cost is laughable as all businesses make up their cost of materials as that plus labor is their prophet, how they stay in business. Finally, he admits that he agreed to refund our $200. until it decided not to. Concidering we paid him over $8400. up front, is the return of $200. for 3 sections and 4 posts that much of an issue to dismiss as a gesture of integrity? Clearly we should have not pid in full, you bet he would have picked up the extra materials with an adjusted balance that is only of use to him. That is good business practice and good will. Business Response /* (4000, 9, 2022/02/07) */ I really have way better things to do than this. Yes I measured the job and came up with a number. And yes he has 3 sections of fence left. That's totally due to him not making some cuts that we would've made. At the end of the day, it comes to 1.5 sections per job. That's a VERY good estimate. When he called me to come out he asked for an"estimate". An "estimate" is just that. It's an "estimate"! Had he handled himself differently with me, I would've been glad to help. His attitude quickly diminished when he did have everything go as he wanted. The moment he took the material out of the packaging, it becomes used. And whether he wants to believe it or not, I absolutely gave him the material at cost. I only wanted to help him out. I'm not in business to sell retail. We install. We have enough work that I don't need to make a dime on everI do in life. It simply makes me feel as if I'm giving back when I can do these things. As stated before, I can give you references where I've done the same for others. As far as holding out full payment....do you hold out on full payment at Wal-Mart or at the grocery store??? That's a simple one..you wouldn't have gotten any material. It's that mindset right there I'm dealing with. This is my last response into this BS! File what. you want file, do what you want to do. Write your senator, write the governor, call the president. BBB...I'll also be removing myself from your organization for the fact you allow anyone to say anything and you do nothing to combat an injustice committed against a business. Obviously, the response to this matter is unfortunate as the contractor has no interest in resolving our complaint. My numerous texts and calls to him remain as a matter of record, along with our efforts to resolve. Your reporting of this matter, and the permanent record of what occurred will give an perspective customer ample reason to avoid doing business with this company. Any further actions civil or legal will indeed prevail based on the attitude of the contractor to be unreasonable. Sad outcome.
