      In September of 2022 we entered into a landscape contract with this company for over $9,000 plus a lawn care agreement for $1 000. The landscape architect who also signed the contract stated that if we purchased the irrigation drip system, which we did, they would extend the normal six month warranty on shrubs. He also made this promise to our neighbor who also had a dead tree. He settled with them. We had them plant two Rising Sun Redbuds , one on the east side and one on the west side of the house. Both trees were the same size, planted at the same, time, on the same drip irrigation system. During the winter months the red bud in question had no leaves. When it began to bloom in the spring, the leaves were considetably smaller than the other, had not grown, and eventually lost its leaves. Lawn masters has made no attempt to settle this issure. I have requested that they replace the tree .

      Response to Mr. *********:
      Lawn Masters of the Triad did enter a landscaping contract with Mr. ********* in September 2022. Our operations manager offered Mr. ********* a 6-month warranty on his plant materials if he installed a drip irrigation as this will give the plants a higher chance of surviving. We do not provide warranties to any of our customers as we are not provided a warranty when we buy our plant material. We have explained this multiple times to Mr. ********* and we feel that our words are being twisted as we offered a “6-month warranty” but we did not offer to “extend” any warranty as we do not normally give a warranty. Our policy is to offer no warranty.
      Mr. ********* did not make us aware of this tree until after the 6 months that we had offered him. We did replace two boxwoods free of charge for Mr. ********* as we were informed before the 6 months. Mr. ********* has had mole and vole issues this past year as well. Not only can this be affecting the plant material but Mr. ********* also punctured his drip irrigation trying to treat the moles and voles. We did repair the drip irrigation and Mr. ********* did pay his invoice for the repair. Time did lapse between Mr. ********* puncturing the drip irrigation and the time that we could come to do the repair. We did have a technician go to Mr. *********’s property for a mole treatment in May 2023 and Mr. ********* spoke with him about multiple questions and concerns and the tree in question was never spoke about.
      We have spoken with Mr. ********* multiple times trying to resolve this issue and explain the warranty given to him better. I have stated this multiple times to Mr. ********* but our policy is to give no warranties. There is no statement of any warranty given to Mr. *********. At this time, we stand firm on our policies that we will not be replacing any plant material. We have attempted to go above and beyond with our efforts to appease Mr. ********* with his complaints and concerns but at this point we can no longer continue with this effort as it seems never ending. We have upheld the verbal agreement on a “6-month warranty” numerous times as we try to perform all work to the best of our abilities.

      I have also attached Mr. *********'s invoices and the tree in question.

       I am rejecting this response because:

      The landscape architect made the same promise to extend the warranty to our neighbor and she lost a tree. He settled with her. The owner makes it sound like he did numerous favors for me. Everything he documents I paid for. The only offer he has made was to replace the tree, and has not mentioned at what cost. He doesn't mention the 15 hamlein grasses he planted that also died. Since we are talking about all the things he did for me, his lawn fertization program, which I terminated, was sub par to competitors in our neighborhood.
