We closed on our home on 12/9/2022. We were informed that we had a one-year warranty and at the one-year **** to get all of the necessary repairs list made and sent to be accomplished at one time. We did such did not hear back from the company for over a month. We now have a one-year-old home with a roof leak and the company is refusing to make repairs.Business response

Buyer provided a repair list on day of warranty expiration (12/9/23). Unfortunately our warranty admin overlooked the email. On 1/10/24, we received a follow up email from the homeowner. We apologized for the delay and service requests were issued for all warrantable repairs. One of the open repairs is a missing dishwasher part that needs to be installed. We have made several requests to have our project manager install it, but she will not provide a date and time for appointment.
The roof leak she is stating, we are refusing to repair, is due to the fact it was not reported on her original email of end of year repairs dated 12/9/23. This leak was reported to us on 1/12/24. 34 days after her warranty expired.
All warranty requests must be provided before the one year warranty expiration.V/R- *****************************, Operations Manager

Caviness Land, 1041B Robeson St, Fayetteville NC. I've entered a contract to purchase a home on 24 November 2021 with an estimate date to close on 27 January, the date was moved to 11, then 18 February. As of today 21 February the house is not ready nor done to move in. The builder and their team are refusing to get the house complete on time for closing. We've met multiple times with the representative and they refuse to give us an estimate date for closing. It's been about 90 days since we've got under the contract and living in a hotel and the house is not done simply to the failures of the Caviness Land. That company should not in business. I'm active duty military (Army) with over 17 years on active duty Army and have never been through so much **** with anyone when it comes to the housing market or builder. This is unacceptable that company should not have a license to build and sell houses.Business response

Business Response /* (1000, 5, 2022/02/28) */ Due to an unprecedented market, we require buyers to sign a Construction Material Shortage Addendum at point of contract that states: The unprecedented events surrounding the Covid-19 pandemic include significant limitations and closures of entire industries and trades that support our construction of homes. Supply chains for materials and/or availability of labor have been negatively impacted by the pandemic. While Builder is committed to meeting the Contract completions date and the target closing date agreed to in the Contract, the parties understand and agree that delays could occur on the construction of this home due to said pandemic. Therefore, any such construction delays that are directly or indirectly attributable to the pandemic (such as shortage of or delay in obtaining construction materials, labor or other) shall be considered a force majeure (or Act of God) event; the parties further agree that the Contract completion date and target closing date shall be automatically extended on a day-by-day basis, based on the length of any such Covid-19 related delays. Furthermore, the Builder shall not be responsible for any Covid-19-related delays in completion of the Contract or of closings, nor shall the Builder be responsible for any monetary damages caused by interest rate extensions or for ANY closing expenses due to Covid-19-caused delays. Execution of this document shall be considered a waiver of any delay damages caused by the Covid-19 pandemic. If there is any conflict between the language of this Addendum and the Contract, the Addendum shall take precedence. This document was signed by the complainant (buyer) on 11/22/21. * On 1/5/22-The buyer's lender informed us that 10-days would be needed to process the loan after receipt of the 99B. * 1/24/22-Reminded buyer's agent of Lender's requirement and that this rule would affect closing date. Informed buyer's agent house was ready to hold walkthrough on 2/3/22. * 1/27/22-Production update given. * 2/2/22-Buyer mentioned termination due to delay in production. * We continued giving regular production updates; 2/2, 2/4, 2/7, 2/8, 2/9 *2/7/22-Changed walkthrough date to 2/10/22. *2/9/22-Recieved Certificate of Occupancy & 99B. Lender informed and 10-day Lender wait period started. *Closing date approved for 2/24/22. Based on the facts provided above, we kept buyer's agent informed of production process. We also agreed to a second walkthrough on the day of closing. All punch List items noted on original walkthrough complete with the exception of 2 and a few additional paint touch ups. Buyer was pleased with outcome of the meeting at the second walkthrough on day of closing.
