I contacted this office to file bankruptcy. They advised chapter 13 would be best. The plans seem acceptable and was excited about being able to take care of of my finances. Once I filled out the paperwork and sent over the stuff they said they needed and paid the initial fee of $575. As soon as I gave them the money they asked me if I would be able to make my first payment by the next month. That made me nervous since the court date had not even been set, and I couldnt make a payment along with all the other debt that I have, if the case hadnt even been Done yet. So I started doing research and noticed all the negative comments on this company. I then decided to not go through with this since we hadnt filed anything yet. I asked to cancel this and refund my money since that money doesnt come easy to me and I needed it to keep paying my bills . Once I asked for that their attitude completely changed I just got a letter in the mail showing all these fees that make no sense considering all they did was look over my bills and now they are saying that what they did cost more than what I paid, so I will not get any refund, Im very upset because again I cant afford to just throw away money. Thats why I came to them in the first place. I hope people read this before going with this company and think second about it I wish I would have.Business response

I have attached ******************************* refund request letter that shows the work we did/why no refund with the owner signing it.*************************** said she decided not to file because she does not want to make the monthly payment to the trustee before her debt gets settled with the creditors. (We have no say over that. Your case gets filed, you immediately become protected and your creditors are notified. Then Eastern district has to make your payment to the trustee on the 1st of the month after you file, and your court date is about 30 days after you file, depending on how busy court is.) So that would be the case for any bankruptcy attorney she files with.

I have tried to contact someone about a total loss situation I am dealing with. I have made 5 calls and left 2 messages and no response. This is terrible service and the secretary makes you feel like you are disturbing her when you call in. Every time I call to speak to someone they are at lunch or busy and will return My call. So far I have to heard from anyone. I don't know what to do. This is frustrating. I'm without a vehicle and the lien holder is trying to take the check for the secured and unsecured debt.Business response

I started my case in december 2021. my chapter 13 was filed february 28 2022. since filing i have had little to no contact from the law firm. i was assigned an attorney when i filed and he is not willing to speak with me. i have spo*** with him twice and he just says don't lose sleep over it or i will have my associate follow up and it never happens. i looked him up online and found that my attorney Mr. *** (********) ***** has his own practice that is not associated with the law firm of john t orcutt. my case has been farmed out and no matter who i try to email, call i am told somebody will follow up and it never happens. Per my instructions by this law firm i have been paying $1230.00 to the bankruptcy court starting 04.01.2022. A total now of $2450.00. I have also been paying both mortgage payments because the court has not dispersed money. I am going into debt making double payments because my attorney won't talk to me and the assigned follow up paralegal excuses himself by forwarding my emails to a person i have never heard of and never responds.Initial Complaint

John Orcutt has been my Chap 13 attorney since 2017 and when I totaled my car that's in bankruptcy, I called 6 days ago to answer questions about what the process is, I have called, left messages and NO one has returned my calls. If your an attorney who has been getting paid, should return calls, immediately.Business response

I paid 373.00 for fees to file bankruptcy. I withdrew from filing. Nothing was done that the 373.00 was paid for and upon requesting a return of my fees I've been given the run around. It's been 2+ weeks since requesting the return of my fee. My emails are being ignored, I get one response and a week goes by with no other responses. I am constantly being told the attorney needs to review my case when there is no case.Business response

I retained Orcutt firm to process a bankrupcy filing for me. The filing was done, with one last step incomplete. This firm was in constant touch with me as long as I was paying them $1400 by phone and email. The final step has to be done in A CERTAIN PERIOD OF TIME. there email notifying me of that went into my spam account unkown to me and was not descovered until after the dead line for this step so my bankrupcy was not recorded. I have tried multipull time to contact Orcutt by telephone, email and direct mail. In my oppinion I paid for something that I did not get.
