      I called the number and **** ****** from the shingle master came for estimate . I told him this is related to claim with ***** **** and he accepted this as claim to be submitted on my behalf .He submitted the claim and told me he is getting paid more than the total cost of the project , so I told him he can start the work for the total roof replacement the insurance company approved. He started the work while I was travelling. When I returned I found the work was incomplete ( soffits and fascia were rotten and painted without replacement) and front fascia ere cracked . The shingle were not properly installed. He told me **** will come and evaluate.**** stopped replying to messages or calls.**** came and said that I am right and he will replace things as part of the original work. On the day of the repair he told me he will send me a bill for 2000 extra . I told him this is. Within scope of work . **** showed up and was rude and told me the work is fine and I told him also the insurance company did not approve the cost . He told me it is not my job even though he commuted to deal with this as insurance claim. **** started the repair with a gut called Oscar and then he stopped and didn’t complete the work and left. And then their office called and said I need to pay. I told them you need to finish work and submit the adjusted cost to insurance they refused and tried to harass me repeatedly by Brian the owner yelling me will file a lien on your house for not paying. I told them finish your work and communicate with the insurance company the extra cost as agreed . They said it is cash proposal abd denied that this was insurance claim despite providing the evidence of their estimate submission to ***** **** and despite mentioning that soffit and fascia of the trod was part of the scope of the work they were supposed to complete as part of royal roof replacement.

      Mr. ******* contacted The Shingle Master on Mar 17, 2022 after seeing one of our signs in his neighbor's yard.  **** ******* met with Mr. ******* on Mar 18, 2022 to inspect his roof.  At that time Mr. ******* explained to **** that he had an approved claim from his insurance company, ***** ****.  After reviewing the insurance claim proceeds, **** determined that ***** **** was not covering the cost of a complete replacement.  **** presented a discounted cash proposal to Mr. ******* for the complete scope discussed and agreed upon - Mr ******* agreed to our cash proposal and digitally signed it on Mar 23, 2022 @ 12:16 PM.  Mr. ******* paid $1000 deposit via ACH Mar 23, 2022 @ 1:29 PM. 

      Our office contacted Mr. ******* on 4/6/22 @ 12:29 PM to inform him that his roof replacement was scheduled for Apr 13, 2022.  The Shingle Master replaced Mr. *******'s roof on Apr 13, 2022.  On Apr 15, 2022, **** provided an additional estimate to Mr. ******* in order to gain approval with his insurance company, ***** ****.  On Apr 20, 2022, The Shingle Master installed new gutters, downspouts, gutter guards and 4ft facia repair per the agreed upon scope.

      On May 18, 2022 Mr. ******* requested additional work to be completed (soffit and fascia repairs).  We agreed to perform additional repairs for $1200 to which Mr. ******* verbally accepted and authorized. On June 1, 2022 The Shingle Master began the requested additional repairs.  We sent a formal proposal (see attached) - Mr. ******* did not sign it.  After not obtaining a signature and not receiving payment for the original scope, we decided to pull off the job until the roof was paid for.

      As of today, Mr. ******* has only paid $1000 towards the original invoice $12,503.62.  It has been 99 days since we installed his roof.  Mr. ******* has applied for and has been approved for financing with our financing partner.  The Shingle Master has referred this to our attorney who will be filing a lien on Mr. *******'s home tomorrow (July 22) for non-payment.  

      Mr ******* contends that we were contractually obligated to work with his insurance company.  This is simply not accurate as evidenced by the signed agreement.  The Shingle Master entered into a contractual agreement with Mr *******.  The agreement had a clearly defined scope of work.  Mr ******* agreed for us to complete the scope of work at the agreed upon price.  The Shingle Master completed the scope.

      The Shingle Master will respond to the complaining party’s assertions below:


      1- Eventhough , the shingle master are contradicting themselves by claiming this is not an insurance claim even though they submitted estimate on behalf of Mr ******* in attachment , and claimed they are receiving enough money for the replacement, they sent another contract to Mr ******* that is cash offer.

      Response:
      The Shingle Master offered Mr ******* a cash proposal to replace his roof and additional work as detailed in attachment [649 South Lakeside Dr - Signed Roof & Gutter Proposal].  Mr ******* agreed to price and scope of work as evidenced by his signature.  Our standard insurance scope agreement specifically gives The Shingle Master a limited Power of Attorney to work directly with the homeowner’s insurance company - the signed proposal IS NOT an insurance scope agreement.  In fact, the signed proposal doesn’t mention insurance once.


      2- In all cases , the scope of work for the contract (link attached at the body of this message) includes at page 3 inspecting and replacing ALL ROTTEN WOOD IN THE ROOF SYSTEM. Mr ******* found rotten and visible rotten wood in the fascia and soffit and asked for its replacement , and instead of replacing it , the shingle master claimed this is not in the scope and billed this as additional work . Until this date , this work has not been completed.

      Response:
      Mr ******* contends that fascia and soffit is part of the roofing system.  That is not the case.  Fascia is considered trim and is adjacent to the leading edge of a roof. Soffit is on the underside of the overhanging roof and is not part of a roof system.  The Shingle Master was very specific in the proposal that 4ft of fascia would be replaced - Fascia Rot Repair 4 linear ft above front porch. Replace with client's choice of pvc board or white primered wood.

      Once the gutters were removed as part of the scope agreement, it was discovered that there was additional rot to the fascia. It was at this time that The Shingle Master sent an additional proposal - [649 South Lakeside Drive - Proposal].   Work was started, but never finished as Mr. ******* did not sign the 2nd proposal and had not paid for the original signed proposal.


      3- Within the scope of work was removing all debris , wood and nails resulting from the demolition and using net , not to damage the landscape. Mr ******* found extensive debris visible after the completion of the work.

      Response:
      Mr. *******’s assertions are unfounded and no evidence has been provided.  In fact, The Shingle Master takes many before and after photos.  See attached attachment [649 S Lakeside Dr - After Photos]


      4- There were improperly installed shingles that were loose eventhough the system install has 50 years warranty . Mr ******* demanded that this improper work be fixed which was done in June after the April install. **** since the install was not returning calls from Mr ******* , abd it is arguable that if there not a payment issue the Shingle Master wanted to resolve , that Mr ******* would have heard back from them after leaving voice mails abd messages at the office for completing the scope of work.

      Response:
      As previously stated, The Shingle Master completed the scope of work.  GAF provides a 50yr warranty against manufacturer’s defects.


      5- When Mr ******* was contacted by the owner ( ***** *****) , and explained the him that work was not completed , he did not accept this and threatened to start legal action and to put a lien on the property . Mr *******  paid the invoice ( in full) to intercept their attempt and is seeking the BBB help in inspecting the matter.

      Response:
      ***** ***** contacted Mr. ******* on 6/14/22 @ 11:43 am and left a voicemail regarding his outstanding balance as the roof had been completed 60 days prior.  Mr. ******* never returned the call.  Mr. ******* ignored all attempts to collect the debt.

      After 90 days, ***** ***** talked to Mr. ******* and explained that The Shingle Master would have no choice than to file a lien on his home for work completed that was unpaid. Mr. ******* threatened filing a complaint with BBB.


      6- The shingle Master continued to make false claims of financing the extensive out of pocket project , and Mr ******* applied for financing the project $12500) and was only approved for $1000 , and when he attempted to make the payment by his credit card , was told by the shingle master that they don’t accept credit card payments.Mr ******* had to make the payment by wire transfer to avoid having a lien put on his house for a scope of work that was not completed.

      Response:
      Mr. ******* applied for financing with a 3rd party vendor - ********. The Shingle Master is not responsible for Mr. *******’s credit worthiness and has no say in the the vendor’s decision-making process.

      Complaint: ********

      I am rejecting this response because:

      1- The scope of work specifies replacing all rotter wood. The scope of work included roof structures and soffit and fascia and even though some of the soffits and fascia, gutters were mentioned, the scope of work encompasses all rotten wood. Mr. ******* commissioned full roof system replacement. The scope of work was not completed. Also, the installed shingles were not installed properly, and it was until June that the Shingles Master replaced the faulty installation. ******* is requiring the refund of such uncompleted items in the scope of work if the work is not completed to date after the payment of the invoice Mr. ******* is requesting BBB to actively look into this as this is correspondence is rejected.

      2- The Shingle Master after the install and when **** came on May, there were rotten wood and nails around the house that were not removed after the installation and demolition that were not cleaned out by the shingle master. These debris were lying on the ground around the house with nails. **** took picture of that. This means that the terms of conditions agreed on within the contract which specified putting industrial net to prevent the damage of landscape and removing all remains of the demolition were not adhered to. Mr. ******* requiring the complete removal of the remains of the demolition.

      3- The fact that the Shingles Master falsely claimed that they accept credit payment when they have locked their portal and confirmed by the phone call to their office on the day of the payment is false publicity that they should not be allowed to continue to do and deceiving consumers.

      4- The fact that that Shingle Master is falsely claiming that they will communicate with Insuranc companies and then send cash contract is also misinforming consumers.

      5- The BBB is a neutral third party that is helping consumers report issues with business and it is a legitimate right for Mr. ******* to seek to inform of issues with ethical behavior that impacts consumers rights and this is exactly what Mr. ******* is doing now and has discussed with the owners of this business when instead of completing the scope of work , they attempted to put a lien on the property where they were commissioned to do work at.

      6- Mr. ****** is requesting that BBB actively look into this.
