      We had this company do an extensive plant and turf project in 2020. We have been under maintenance contract with them since 2021. 3 tall ***** ***** **** died immediately, 2 were replaced but were also dead within weeks. To this day, 3 years later the trees (and various other smaller plants) remain dead while we have been under a maintenance contract with them.

      It is disappointing to receive this complaint after nearly 3 years. 

      Dr. *** is correct that he had 3 trees die as a result of the original installation. We replaced these trees as he indicated. He does not note that we replaced these trees a second time. 

      Additionally, our contract states:

      "1. Plant Guarantee.   TJL, Inc. guarantees all plantings we supply and install for one year that are covered under an automated irrigation system and maintained under a continuous maintenance agreement by TJL, Inc.   This guarantee does not apply to plants that are lost due to abuse, vandalism, animals, fire, lightning, hail, vehicular damage, freeze, neglect, nor Acts of God."

      It is necessary to note that the ***'s waited until 2021 to retain us for maintenance services for a project that was completed in 2020. Further, the property was in such disrepair from lack of maintenance in the area that we worked in when we began taking care of the property that we had to have a crew spend an entire day just to get the area back up to standard. Even then, we stood behind our product and replaced the material despite the lack of care. 

      There are also major drainage issues on the property that have resulted in flooding of their house as well as planting beds. We have advised from the beginning that something needs to be done about this. Additionally we have provided 4 different proposals that contain solutions to help with their drainage situation. None have been approved. Please note that we did not do any hardscape or grading work on this property. This work was all done by another contractor prior to beginning to work for the ***'s. 

      Further multiple of those proposals indicate that we would be willing to replace the redbuds one more time if they would get the drainage situation fixed. If we are guilty of anything it is not walking away when there were over half a dozen proposal requested by the ***'s that have been provided and not approved. The last proposal resulted in no response to follow up from our company or the landscape architect for nearly 6 months. The communication hasn't been excellent on any side.

      We wish the ***'s the best, but we can't be responsible for trees that we didn't select for life. Further, the ***'s maintenance agreement (which has been terminated) has nothing to do with their planting beds. It is only for turf fertilization and irrigation start up and shut down. It doesn't even include plant health care treatments. 

      We will be happy to provide contracts or any further documentation BBB would like.

       I am rejecting this response because:

      TJL failed to respond to our concerns in a timely fashion over three years and place the blame on the consumer even though we made many good faith efforts to come to an agreement on how the garden could be brought to the mutual expectation of all major plants being viable under a maintenance contract.

      We are requesting TJL supply funds for replacement of the 3 redbud trees.

      I’m not sure what clarification you need at this point. The main purpose was to make the Better Business Bureau aware of poor performance by this company.
