  Mr G***** lied to me and said he was a licensed contractor to work in **, he lead me to believe i was working with a official contractor thats licensed. He also refused to do what was agreed , i**luding insulation of the building and panel walls or drywall. he simply called a carport company and had them come and build a 3 bay carport, and the company was asking me for the payment for 7700 for that total cost of the carport they built, they thought i ordered it., he also told me to pull permits for the building, which i than starting thinking, isnt my contractor supposed to be doing the permits and paperwork with the city???? thats when i became suspicious of the situation, when the carport company built the unit, he simply came and demands the remaining bala**e of $11,083.68, I have witnesses hear mr g***** verbally saying that insulation will be done and panel work. I told mr g***** i need to install 3 auto lifts in the building, mr g***** didnt even assess the space or measurements of the lifts we already have installed in our current facility, him being the contractor should had made sure everything will fit if we hired him to do so, he has really let us down, and now also says the insulation is not i**luded nor any other services that were supposed to be done. now we have a building we cant use to facilitate the work needed and deems useless. nor has any permits been pulled by mr g***** to make sure the codes and design are approved. we are left in a terrible situation and the city has rejected the plans for the site. On top of that all, Mr g***** wants me to pay the bala**e asap, because i feel him not be licensed contractor, he wants to take the money and leave me with all sorts of problems with the coding permits that should have been done before anywork was supposed to be done. and also the building still is not complete and missing some pieces on the roof the building. i would really like to get my money back, and hire a real licensed contractor.

  Dear BBB Team:
  Indeed, what Mr ****** ********* has stated is partially the truth, but he has omitted sustainable information and has also changed some facts chronologically that it will explain as follows: 
  
  Mr ********* requested to get a quote for the Sale of a custom New Carport to be installed in his automotive repair shop. After conversations we agreed to make it with the following dimensions: 24 ft x 40 ft x 14 ft height (16’ 2” ridge), to be suitable for (3) car bays and tall enough to install vehicle lifts. I sent the final Estimate on November 22nd, 2023. Mr ********* APPROVED the estimate/contract digitally the same day (exhibit 1). The total amount was $18,769.75 (before taxes). He paid $9,000 dollars in cash; the remaining bala**e of $11,083.63 dollars (after taxes) should be paid when finished. I made the order to our manufacturer vendor to build the parts for the Carport. The delivery time and installation would be between 3 to 8 weeks. For this specific work, my company usually handle the permits required for the City, which is optional for the customers in the State of ***** ********. It was told my Mr ********* that he would handle the required permit due he has “friends” in the City that are his “customers” at his shop. I provided him all the documents (i**luding the plans) needed for this purpose. Early in January 2024 Mr *********’s secretary, Mrs ******* informed me that they had a delay with the permit because Mr ********* was on vacation, and he summited the documentation just a few days before and were rejected for i**omplete information. They requested my advice to resubmit the documents (exhibit 2).
  
  On January 5th, 2024, the materials arrived, and the installation crew started the built the unit. This crew are professionals specialized in Carport installation in all the East coast of the US, their labor was i**luded in my Estimate. On January 9th 2024, the Carport was completely built and installed, and Mr ********* SIGNED the Approval/Accepta**e document. The job was finished satisfactorily.  Later on, he said that he changed his mind about the doors color (which he accepted white), to be painted in brown color. Later he changed his mind again to be painted in black color. We get the materials and our crew worked overtime time at night because the weather conditions the following days would not allow us to work. This additional painting job was not i**luded in the original Estimate/Contract.
  
  On January 10th 2024, I met with Mr ********* to get paid the remaining bala**e payment. He came up with the argument that he found out that he could get the Carport “cheaper”, that for any reason he was going to pay such amount. The fact is that he previously accepted the contract. Then he said that I was not a License Contractor, which is not relevant because I sold a Carport installed by professional crew, I don't need a contractor  licensed for it. If I need  to do a job with a Contractor License, I use my other company *** ******** ***. Then, he asked me to give him a forced discount which I refused to accept. Then he said he would pay only if I install the foam insulation to the whole building, which I also refuse to do, because it was NOT i**luded in the contract.  He finally told me that that he was not going to pay nothing and told me to turn down the building. This happened in his office in the prese**e of my foam insulation crew and his employees. 
  
  On January 11th 2024, Mr ********* made a payment online through our web site with a Credit Card for the amount of $11,083.63, which as soon he got the receipt (exhibit 3), he sent me a copy stating that “you just got paid.” Minutes after he contacted the Credit Card processor, flagged our company and requested a full refund (exhibit 4, 5). He also sent me an email with a screenshot of his bank accounts showing a bala**e of 6 figures, stating that this situation “could take month or years”. Then he came up with another argument that the doors we painted are peeling off. 
  
  I notified via email to Mr ********* that according to the ***** ******** Laws when a buyer default in complete payment of a Carport/Shed, the seller holds the ownership of the building and keeps the right to take it back. After this notification Mr ********* make two payments for the amount of $3,500 dollars each:  ***** transaction 01/16/2024 $3500 Ref ************; ***** transaction 01/16/2024 $3500 Ref ************.
  
  As of today January 24th 2024, Mr ********* has refused to pay the bala**e due of $4,083.63 dollars, additionally the painting job for the amount of $1,342.85 dollars. The grand total is $5,426.48 dollars. In the event that the painted doors are peeling of, we will take care ONLY after the payment of the Sale of the custom New Carport installed be paid in full. 
  
  I have started the legal judicial procedures to turn down the Carport with the law enforcement support. We have done this before a few times. In the event that he wanted to pay to avoid turning down the unit, an additional fee of $3,500 dollars for legal costs need to be paid as well. Mr ********* has been notified 2 days ago.

   I am rejecting this response because:
  
  I was promised things that were not done, an oral contracts are legally binding,  like insulation,  and drywall, i never flagged any credit card company,  there was an error on there end of the system, i have completed ***** payments, for there bogus response, the built a new car port for me and it had peeling paint because it wasnt done right, if the job is not right, for something you buy or have made brand new, i or anyone would expect it to be new, this is not acceptable,  and the company shows no interest in helping or fixing the situation at all, all 3 door are peeling paint, and i completed payment by ***** today for totaling 10.5k , and 9 k before  i believe thr business should be held liable to atleast fix the problem,  the door ahould be repainted,  i didnt buy a used unit where i would expect that, i run a business and have a good look to my business  and the peeling paint is a eye sore for something i had built by kfs investments,  and doesnt care to help or fix what there company is responsible for.
