On July 27, 2023 Dennis Skeen of S&S Landscaping & Snow Bis-Man LLC gave me a bid on redoing my rock bed, I asked him to raise the rock bed to rid a gap under the fence and straighten the brick outlining the rock bed. He said he would remove and wash old rock, add in additional dirt to raise it up and rent a tamper machine to pack the dirt, then would cut the grass line to get a straight line and lay lines to lay the bricks, and would line the fence with bricks to keep the dirt and rocks from going over to the neighbors rock bed. He did remove the rock and wash it and add dirt but not enough dirt to raise it up to rid the gap under the fence as then he would have to rent a tamper machine (which is what he said he would initially), he didn't cut the grass line to make a straight edge he said it was too hard, so he laid the bricks and kicked them into place with his foot, the bricks against the fence are doing the wave since he didn't add enough dirt and they have to go over the cement holding in the fence posts. My rock bed now looks worse than it did before he touched it. He didn't follow through with what he said he would do. When I asked him about the it being crooked I got multiple messages about being ungrateful and unappreciative for what he has done. When he gave me the bid on the 07-27-23 he said he would be here over the weekend and right away Monday morning to get started and the project would be completed by 08-02-23. He asked for materials and 10% labor be prepaid and I paid those on 07-29-23 in the amount of $900. It wasn't completed until 08-11-23 and he wanted payment on 08-10-23 and 10:30pm at night. I paid him once I could see the completed project on 08-11-23 in the amount of $761. As of 08-17-23 the old dirty rock that was supposed to be disposed of was still sitting in the driveway, disposal was charged on the bill. I asked for an extra day to use some of the rock not a week. I want my $1661 back so I can hire someone to fix his mess

      In response:

When evaluating the job I informed Ms. Solberg it would be in her best interest to communicate with her neighbor to the south on this project. The reason being, the rock bed is in both yards with the fence separating the two properties. This would cause issues with erosion as water finds its own level. I also tried to sell her a french drain to eliminate those erosion issues and she was not interested in doing so as she would have to put up a fence which would be a significantly higher expense.  I told her I would do all the tamping by hand in order to avoid renting one, in hopes of saving her money. All the materials that were quoted were used for this particular project. I also stated that I would straighten the border to the best of my ability.

As far as the payment, I had stated I would have her come look at it to make sure it was to her satisfaction. I use a Square, a point of sale system, which automatically sends emails and reminders to pay. I apologize if the system automatically sent out multiple emails as that was not my intention and was not done by me personally.

Please see attached photo of the job upon its completion, which contradicts Ms. Solberg's photo. I would be more than happy to discuss with her what compromises can be made in order to make the project more to her satisfaction.

I am rejecting this response because: This is the first time that I have ever heard about any French drain.  I asked 2 things to be completed eliminate the gap under the fence to keep dogs from getting out and straighten the rock bed.  Taking the picture from an angle rather than straight on with the edge would not show how crooked it is.  I have heard from so many that the rock bed work I had done was terrible and they hope I didn't pay for that quality of work. Kicking the bricks into place is not how a professional would place bricks. I have the video footage of every time they were at the house. All the time they wasted, the yelling on the phone using cuss words which the neighbors complained about. He expected me to approve the job and give final payment at 10:30pm in the pitch black by looking at the job by a flash light.  When I didn’t pay then he left because I wasn't going to pay anyways so why should he stay and clean up, those are his words to me the next day. When I sent him a message the next day letting him know I I felt the rock bed was super crooked I got 1 nasty message after the next. He called me ungrateful for what he had done and went on to brag about all he has done. Taking shovels of rock and dumping it behind the line of brick along the fence doesn’t fill a gap other than temporary and would never stop a dog from getting under the fence, all that did was waste the rock I was paying for. I was told I talked to the neighbors and they were not interested in his services and that the fence belongs to the neighbors so I can’t just replace the fence. He told me he doesn’t believe in the customer is always right and went on to complain about his customers. He charged me for dumping and I did the cleanup of the remaining rock as once again he failed to show and told me to do it.  Nothing was ever his fault it was always someone else's, I was constantly babysitting to try to get them to complete the job and everyday there was a new excuse.
