The date of the transaction was January 12, 2021. A $30,000 deposit at the signing of contract with total amount of $471,932.46 paid at closing. Manzitto committed to the construction of new residence including the lot. The nature of the dispute: (1) improper design and installation of HVAC system (2) use of roof shingle other than what was designated on contract and required by HOA (3) actual completion date months after date in original contract, requiring us an additional move and cost of renting a 2nd residence (4) closing and possession was strongly encouraged with promise of escrow account to be established for payment of unfinished features of home (5) inability to establish contact with management (specifically all those involved in the terms of original contract) to discuss resolving issues Original contract details, photos, and receipts are available if needed.Business response

In regard to *** ********* complaint details, we agree with the contract date & amount.
Dispute item 1. the improper design and installation of HVAC system. Please find the attached approved mechanical inspection by the City of Lincoln. We have had many discussions and visits with Mr. Hoffman on this topic. The HVAC system is working, there is not any reason to reinstall the HVAC system.
Dispute item 2. use of roof shingle other than what was designated on contract. A roof shingle was not designated on our contract. We did not receive any notice from HOA that the shingle was not in compliance.
Dispute item 3. actual completion date months after date in original contract. Lots of items affect the actual completion date, the Hoffman's did choose to do some change orders/adds to the original plan & those do take additional time to complete. Our superintendent on this project was in constant contact with the Hoffman's on schedule and advised of any delays that came about.
Dispute item 4. closing and possession was strongly encouraged. Yes, the Hoffman's did close on 1/28/2022.
Dispute item 5. inability to establish contact with management. Manzitto strongly disagrees with this statement. **** ****** communicated frequently via phone with *** ******** *** ******** *** also directly called *** ******* to discuss his concerns at one point. We can confirm various communication with *** *******. Manzitto offers a standard one year warranty with its projects, on this particular project we provided service for months after the warranty was expired just to help *** ********* concerns to be addressed.

Manzitto has failed to share or explain why they were allowed to make the building decisions that were made during construction without our knowledge or permission.
We continue to request Manzitto's consideration and cooperation to schedule a meeting with those present at the writing and signing of our contract to discuss a solution to the issues of the home.
