      ABC did an automatic renewal of a one year contract. At the start of the contract the salesperson was told that I wanted one year only, on 8/10/2023. The salesperson may have failed to enter the end date into the company files, as they did a renewal on 8/07/24 and billed me 85.80 for an additional treatment, I don't believe I received any notification that they were about to renew the contract. I have a number of rentals and this is the first time the did an automatic renewal. I would like them to delete the charges for the 1 additional service in the amount of $85.80.       *** ***** did sign a contract and prepaid for 6 services however, the original contract does not appear to have a cancel date notated on this contract. Line #24 on the contract, above his signature states the on going process after the initial contract.  He states that the salesperson "may have failed to notate" and he also states " I don't believe I received any notification of services". Our software shows *** ***** received an auto generated reminder email on 7/31/24 and a text message reminder on 8/6/24 for services to be rendered on 8/7/24.  *** ***** has no complaint on file of ever having any trouble receiving previous reminders. I decline to remove the $85.80 and do find *** ***** is responsible for these charges. I also exercise the right to refuse *** ***** any future ABC services due to his recorded comment of threatening to post untruthful information on several social media sites.

      A complaint was filed by another individual on 10-6-21 about them signing a tablet purported to be a credit card authorization only to also have a contract attached. Upon signing, you have entered into that contract and are obligated to pay a $165 early termination fee. The response to that person was that ABC ALWAYS tells customers that they are signing a contract. I WAS NOT INFORMED OF THIS EITHER. Doesn't this show and prove a pattern of unethical business practices? When I called the company to inquire about why this fee is even included, I was told so that the salesperson could get commission for the entire year's sale, and that if it wasn't included, EVERYONE could just cancel. Doesn't this also show the lack of incentive for the salesperson to not be forthright? This cannot be the standard that BBB wants their members to uphold.

      ***** called our office asking to get out of his service agreement.  The agreement hadn't been completed, so we explained that to him.  He admits to signing the contract, but said he didn't read it.  We explained that we could cancel it, but there is a early termination fee.  ***** did not want to pay that, so he said he was going to send a complaint to BBB.

      I am rejecting this response because: It does not address the root cause of the complaint.

      I did call in and acknowledge that my signature was located on the bottom of a contract. I explained that I felt the signature was obtained under false pretense. I signed what was explained to me, to be a credit card authorization. The salesperson never informed me that there was a contract out of view of the signature line on his tablet.

      I also asked why the early termination fee was even a part of the contract since it does not cost the company any money to NOT further provide services. (Looks like a money grab) The explaination I received is it is there to protect the salespersons commission. Doesn't this form of commission structure reward the signing of contracts?

      I do not dispute that I owe the money per the contract. My check is being mailed today. My legal counsel also advised me that ultimately, "I did have my signature on the contract"

      Lastly, upon reading other reviews, I have found a minimum of 4 other individuals making the same claim recently. Has any research been done to see if these contacts were obtained by the same salesperson? Remember, they have a financial incentive to obtain yearly contracts.

      Company did not inform me of contract or allow me to see that I signed a contract that was for 1 year or tell me that I had other options or give me any information outside of what they should have. When they took signiture on the contract they took my card and made me believe I was signing to charge the card and not for the contract. There was never any information given to me that I was in a contract until I was getting ready to move and needed to pause service and they told me then that I had a contract and was never informed prior to this. It's unacceptable to take a signiture for charging my card and put it on a contract that I did not sign

      Business Response /* (1000, 8, 2021/10/21) */ We always explain the service agreement to our customer's, and give them 3 days after to cancel their service if they would like to. Not only do we explain this, but it is written on the agreement as well. We have performed 3 scheduled appointments for this customer, so she did know that it was a recurring service. She has never had any call backs between service's, so we have to assume she was happy with our service.
