I purchased a truck from an online auction run by ***********. *********** refers customers to a sister company called Fr8star in order to obtain bids on hauling machinery purchased through the auction. I contacted Fr8star to acquire bids for hauling the truck. They presented me with several bids and I accepted a bid from ******* ****. ****** ******* the Fr8star representative, assured me and ******* **** that the truck was 8’6” in height. The bid that I accepted was based on that information. I paid a deposit of $973 to ******* ****. They hired a driver to pick up the truck and he found that it was 11’6”- too tall for his trailer and he was not able to haul the truck. In order to have the truck hauled I will need to seek new bids based on a more expensive style of trailer. I have contacted both companies several times trying to resolve the issue. ******* **** has stated that they will allow me a credit of $645 towards a new bid to haul the truck but they are keeping the remainder of my deposit because they paid a driver who was not able to haul the truck. ****** from Fr8star has said that it is up to ******* **** to refund my money. He has also stated that their agreement with ******* **** specifically states that they cannot keep a deposit if they are unable to deliver the load. As it stands, I have paid $973 and have received nothing in return. This is the direct result of ****** from Fr8star giving erroneous information to the bidders. I am not sure that I will contract with ******* **** to haul the truck or if I will end up going with a different company. I would like to have the entire amount that I paid refunded to me so that I can then move forward with finding a hauler for my truck.Business response

We vehemently deny any allegations that fraud resulted from one of our representatives giving alleged erroneous information. As indicated in our Legal Disclosures it is up to the bidder to ensure that the dimensions are accurate prior to accepting the bid for transport. We have attempted to come to a resolution with you through our customer service representatives to no avail. Your request for a refund cannot be processed because we are not possession of the funds. As stated in your complaint, ******* **** is the correct party to direct your concerns to.
