      Rookstool Concrete was signed into contract on October 1, 2021 to complete our house foundation, basement, retaining wall, porch, driveway and sidewalk. Early in the project, they were responsive in getting work done with okay quality. However I was informed by the owner, *** *. late in 2022 that the cold weather would prevent them from finishing the driveway and sidewalk until the following year. I agreed that he could complete the project the following spring when weather permitted. The following spring and summer, there had been little to no communication from the owner, *** *. On our last phone conversation on June 6th 2023 he agreed that he would return to finish up the work as per our agreement in July of 2023. After several attempts to reach out to him via phone messages and text messages in late July and since, I have not heard anything back from *** *.. It is clear that he is ignoring me and moving on to larger projects that he would rather work on. With no response from *** *. in the last several attempts, I feel that he is treating me unfairly.

      In response to *** *** complaint, we would like to say that we understand the frustration in not getting the job completed to his timeline, but unfortunately there are many factors that come into play with jobs like this. We fulfilled the beginning stages of the job according to the contract. Where we came into a standstill was when the owner's new house was not on the property and work could not be completed until it was there. The house took until the late months of 2022 to be placed. We returned to the job site and did the next steps that we could complete. At that time, the weather was too cold and the ground was too frozen for us to do any flatwork, which is the last step of this project. Along with the ground being too frozen for flatwork, the exterior of the house was still being worked on.  The company doing that work had a telehandler they were using to complete that. The customer and I agreed that it was also better for his property that we waited until the telehandler was no longer in use. The customer had reached out to us on April 24, 2023 and we told him that the frost was finally starting to thaw the ground and we would try our best to be there but we recommended finding another contractor to finish it sooner than we could get there. There was no reply to that message. About five weeks later, he called and left a voicemail that wasn't returned. We work around a lot of areas with no cell phone service and can't return phone calls right away. We received another text message on June 6, 2023 letting us know about the voicemail. We replied that we got no response from our text message about suggesting a new contractor. Again, we recommended more names and let him know we couldn't get to it as soon as he'd like and apologized. We received no response to that text and got another text from the customer in late July and again in the middle of August saying he was following up with us. While we understand there was a signed contract, the prices of everything have increased dramatically; fuel, concrete, labor for our employees, etc. While there was such a large amount of time that passed between us completing the first stages of the job and the house being placed on the property for us to come finish, we would need to change the price of finishing this job. We just cannot make that number work with how inflation has increased everything.

      We apologize that this job has not been up to our normal work standards. We are not putting bigger jobs before this customer. We have been playing catch up with other jobs just as long as this one has been behind. The only jobs we've completed out of order are the jobs we were able to begin while we were waiting on the customer's house to be delivered to his property.

      We will complete the work as stated on the contract, including honoring the price. We will not be there to complete the additional work. We request that payment be provided the day off before we leave the job site. The work will be completed before the ground freezes this year and we will give *** * notice when we will arrive.
