      I hired Young's Excavation for my Merrimack location to add a sidewalk and striping as per the town of Merrimack's request. Bill Y**** recommended (for an additional $3640) and we did, some milling and overlay of the entrance so the striping would adhere better. When the project was complete and the town official signed off, he noted that some of the striping was already starting to peel up. It got worse over the next week or so. I spoke with Bill; he sent a crew to address the issue, but they overheated the stripes and it got worse. I spoke with Bill again and he said he would rectify the situation in the spring. Spring is here and he sends a crew out to address the situation. They did not apply the Thermoplastic striping ($2500) I paid for originally. They used paint with glass bead instead and the word STOP was originally 10 ft and they redid it as 2 ft. When I spoke to Bill, he said we was not going to do anymore. We did have a discrepancy with the original invoice. I did not pay $2500 for a remobilization of his crew which he stated was from the police removing them from the job site for parking in the neighbor's lot. I have a copy of the police report and it states that the police relocated their trucks to a cross street and did not remove them from the project. As you can see from the attached pictures, he did not properly rectify the situation. The town of Merrimack stated the Stop had to be 10 ft as well as the striping had to be Thermoplastic. I do not want to have any issues with the town for an improper fix to the entrance. I would like it properly fixed.

      I do not accept the business's response as a resolution to my complaint because: I paid in full the original agreement.  Because he was trying to overcharge me on a situation that was caused by his own employees is not acceptable

      The customer made the unilateral decision not to pay for the second mobilization which didn't mean that we as a company didn't incur the expense, we did. We had to stop working because a neighbor complained and the police asked us to stop until it was resolved, causing us to have to come back a different day. Therefore the remaining funds of $2,500 can be applied to hiring another company to try to satisfy your request because after numerous trips back to the project, you are still unsatisfied.

      I do not accept the business's response as a resolution to my complaint because: As you can see from the attached police report, the police officer did not remove them from the site.  That decision was completely on Young's foreman.  

      Why should I have to pay for a remobilization that was not necessary?  I would like them to fix the repairs that were not done properly.

      - 05May2022 driveway excavation began. Also told on this date, that to do driveway correctly, an additional cost of $6000 would be required. Agreed to these terms. After paving, met with Bill Y**** about concerns and my dissatisfaction. Mr. Y****** response of cutting out the new driveway and adding a patch was also not acceptable. He was in agreement that this was not a fair option for me. Small improvement to pitch of driveway with heat and weight, however, driveway still pitches toward basement door. - Original quote -$9,290. Quote plus added cost - $15,290. Paid to date - $9,500. Amount owed upon completion of driveway - $5,790. - Work to be performed - Old driveway removed, 8" sub base that became 24" sub base with GeoFabric. Finished grade and vibratory compact of sub base. Pave driveway with 2" basecoat and a 1" top coat of hot aggregate asphalt. - Dispute - A large section of the driveaway pitches to the house, rather than away. Specifically, the water flows down the driveway to my basement door where it accumulates on the threshold. Attempts at fixing by the company, were futile. Only other option presented by the owner was a cutout of the incorrectly installed driveway and a patch to remediate the flooding/icing issue. - I was going to pay the final balance thinking I had no other recourse, however I was informed that a 5% fee would be attached to that final balance to offset there credit card costs which I refused in lieu of bringing a check later. I received a call and email on 24Jun2022 that the fee would be waived. However, as I explained in an email, I was not happy with the installation and wanted another professional's opinion. Today, 27Jun2022, Bill Y**** informed me that if that was the path I wanted to take, he would put a lien on my home. I contacted the BBB immediately and was encouraged to start this complaint process. - Invoice # - INV0381

      We worked very hard to accommodate all of Mr. ********** requests. Difficulties arose, no doubt. But they stemmed largely from challenging topography exacerbated by a hidden drainage pipe up against the foundation of the house. None of us knew this pipe existed. Despite these challenges, we worked with Mr. ******** to accomplish his stated goals and overcome the hidden challenges. After many conversations, Mr. ******** and we were all in agreement (knowing the risks) about the best courses of action. We executed exactly as we agreed. Paving a driveway can’t change all the landscape challenges but can help alleviate some problems, which is what we accomplished for the customer. As Mr. ******** stated, he was prepared to settle the invoice but now refuses because we were going to pass along the credit card fee, however we have since agreed to waive the charge.

      I do not accept the business's response as a resolution to my complaint because my driveway is not finished and is in fact going to cause damage to my house. I would like Y****'s to either fix the issues or help defer the cost if having another company install a properly pitched driveway. What I have now is, as stated by myself and Mr. Y****, unacceptable.  Mr. Y**** himself admitted cutting out the ill pitch section of driveway and adding a patch was one fix, I do not want a patched driveway. I want, as agreed upon, a properly pitched driveway that is not an inch from my threshold and allows for the screen door to open. I have not presented anything Mr. Y****  is not aware of, for the life of me, I do not understand how a business owner gives a customer this product and expects full payment. I would lose my job if this was my final product.
