      On July 27 we ordered 1100pcs of part # ******322MFAE from New Tech. The parts were paid 50% upfront and 50% after 2 weeks. The parts were delivered into our possession on August 2nd. Due to the nature of the parts our customer requested that we further test the parts for authenticity before putting them into production. We do not have additional testing capabilities so we in turn partnered with one of our local trusted distributors Chip 1 Exchange to get their opinion on the components and offer additional testing. Parts were delivered to Chip 1 on August 5th for further inspection. Chip 1 was unable to find any major anomalies with there testing capabilities, but did note some issues that may need further investigation. However they were unable to test further with their capabilities and recommended a certified AS6081 test facility Xtreme Components. Chip 1 acted in our behalf as they had told me they already had a relationship with Xtreme to get the parts further tested and validated. On 9/22 Xtreme finished their extensive testing and verified the parts as being suspect counterfeit. The report was furnished to Chip 1 Exchange showing the part failure and obvious remarking of the components to a higher temp grade. We were notified of the issue and parts were quarantined by Chip 1. We immediately notified New Tech of the incident and requested a full refund of all payments made for the parts. New Tech after pushing back granted RMA but with restocking fee which we did not agree to. We then asked them to confirm parts would be destroyed and removed from the market since they were proven by third party testing to be counterfeit, which they did not agree to. They continue to not agree to a full refund and insist parts are good. They have been reported to the ERAI who also agrees with our findings, as well as the FBI and Gidep. They are knowingly selling counterfeit components.

      Correction, we asked to send back so we may inspect that parts are in fact the parts that were shipped. We were even accommodating to the fact that this was past the warranty time. 51 days to be exact. You refused to send back because we wanted to go through our inspection and testing. If these are the parts we provided, that you were so sure of, you would have no problem letting us review the matter and then destroy and issue a refund, but you didn’t. 

      You never mentioned the mistake on the testing report until after we mention to ERAI about the discrepancies in the test report. How can they change the test report after parts are out of their possession? We have done business with testing facilities and there is no room for error on test reports. Also, you claim you never opened the package, but funny how the test report states that the package was sealed on 8/5/2022, so who opened the package between 8/2/2022 and 8/5/2022?? Xtreme Semiconductor didn't receive the parts until 8/11/2022 so what happened between 8/2/2022 and 8/11/2022 when they finally received the parts. You needed the parts urgently, but for some reason there was a delay in getting these

      I would like to know also why you won't answer as to why Chip 1 has the parts listed as stock? You didn't want to return them and suspect counterfeit, but yet you're letting Chip 1 quarantine parts and listed as stock. The story keeps changing because then the parts are in your possession. I submitted all our information to ERAI also and they are following through with the discrepancies with Spark Tech and this issue. We would like to make very clear that if Chip 1 had an issue after they were reviewed than this should have been brought up back in August. I have provided ERAI all our documentation of PO's, invoices, pictures, labels and anything else they have asked for in the process and complied on it all. Pictures you have provided of the shipment you say wasn’t opened shows that the box was in fact opened and resealed.

      All our paperwork and listing show our correct address. Even the invoice we sent you has our address on it, but you didn't take a minute to review the information. Even the shipment that came to you for these parts has our address.

      The pictures you provided show that the package was opened. I personally shipped those parts out and the box wasn't opened, and the label was not cut.

      I do not accept the business's response as a resolution to my complaint because:

      Really not sure where your logic lies in all of this. Once again parts are in my possession, so get it out of your head and the back and forth that they are anywhere but sitting in a locked cabinet with me.

      We turned over the parts to 2 different independent facilities and they were out of our possession after we turned them over. and have been sitting the majority of the time with Xtreme during testing.

      If you you had any understanding as to trade laws you would know that i couldn't send these back to you if i wanted. But i guess counterfeiters like yourself are fairly blind to the law then. If you need more info i suggest talking with Homeland security. Im sure they would love to speak with you.

      The proper authorities are involved in this, you can keep trying to shift the blame but the evidence is documented and if we need to subpoena anyone for statements everyone involved will tell the same truth. The BBB is the most visible place where your being called out for what you are. So i can see why you would exhaust so much effort here.

      If the BBB wants any additional info or statements i have a very long list of people who can give them as well as documented evidence.
