This firm performed a pre blast site survey for a blasting company. 2 external doors adjacent to the blast site which were fine before blasting are now binding badly. The inspector fully admits that she did not check these doors and will not accept that her lack of a comprehensive pre site survey should have caught that these doors were working perfectly fine prior to blasting.Business response

Business Response /* (1000, 5, 2021/12/01) */ The definition of a pre-blast inspection as mandated by the State of New Hampshire is to "include both the interior and exterior visible and accessible walls and foundation of the structure". The State of Maine; where this project took place, does not have a state regulation for pre-blast inspections. The only regulation that the Town of Kennebunkport requires is that all property owners within 500 feet of the site be notified by certified mail that blasting operations will be performed with no requirement for an inspection. The blasting company hired KS Inspections, LLC to perform the pre-blast inspections to all abutters of the project at his own expense and with no requirement from the town. The pre-blast inspection was scheduled and conducted on October 6, 2021. I entered and exited the property for the pre-blast inspection by way of the front door and did not open all exterior doors. The two doors that Mr. ********* is complaining about are at the rear of the property. After the blasting operations were done Mr. ********* contacted me on November 22, 2021 to complain about the doors. I conducted a post blast inspection on November 23, 2021 at Mr. *********'s request; which was expedited due to Mr. ********* only being at his vacation home for Thanksgiving. I met the owner of the blasting company, which is my customer (not Mr. *********) at Mr. *********'s home. We did measurements from Mr. *********'s house to the closest blast area (over 200 feet) and I was also given copies of the vibration monitoring reports. The doors that Mr. ********* say are "now binding badly" were easily opened and closed several times during the post blast inspection. There was a slight sticking of the doors at the bottom threshold. As soon as I entered the home Mr. ********* informed me that the doors are adjustable. And in my estimation that is the very simple solution to Mr. *********'s problem. It is also my understanding that as a courtesy to Mr. ********* the contractor for the lot where the blasting operations occurred offered to send one of his master craftsman over to adjust the doors for Mr. ********* at no cost to him. This all occurred on Tuesday, November 23, prior to Thanksgiving. Evidently Mr. ********* lacked the patience to wait until after the holiday and was sending threatening emails on Monday, November 29 at 9:00 a.m. saying that he was contacting his attorney and would be billing the owners of the lot where the blasting occurred. Mr. ********* also insulted myself and my company in this email. I have issued a post blast inspection report to the blasting company. I tried to explain to Mr. ********* that the blasting company used vibration monitoring during every blast and that the PPV levels were too low to cause any damage at his property. He was very curt and told me he didn't understand any of it and "what's the bottom line?" I tried to explain it to him several times; but I can only explain it to him, I cannot understand it for him. When I started to tell him what my report was going to say he kicked me out of his house and said he was contacting his attorney. That was my last interaction with Mr. *********. The whole purpose of a pre site survey is to completely evaluate the site prior to blasting. KS inspections took less than 10 minutes and did not check the doors which are the closest to the blast site indicating to me that an incomplete inspection was done- the inspector fully admitted that she did not check the doors. Her comments about any other conversations with the construction company or owner of the property are hearsay on her part since she was not involved in any of thos discussions. I have had to hire a contractor to repair these doors and legal action is still pending Business Response /* (4000, 14, 2022/01/09) */ This issues has been resolved.
