I have contacted the business about a service they advertised on Instagram on May 13th. A person by the name of Christine was my contact person. The first scheduled visit was cancelled at the door after being confirmed. Then she contacted me again to go back and try a first visit which was scheduled for May 25th, then she rescheduled again because she made a mistake again. Finally, after a lot of confusion was scheduled for July 5th. I signed an electronic pad and I asked for a copy which Christine told me would be provided later. It never happened. On the day after I had a flood in my house, which made it inhabitable and me and my son, who is disabled are temporarily back in Brazil until I am able to fix the house and go back. I notified her on July 11th with pictures and estimates to prove what happened. She said sales were final which I was NEVER made aware, she never provided the policy. I am in Brazil and so far I have received 73 collected calls from Cherry. I have tried international calls and texts to Christine and I have never heard back. I am being harassed daily by Cherry (her finance company) and I exhausted all the means of communication with her hence why I am looking for your help.Business response

I did follow up with Abby from the Better Busines left a message.
The client and I have been in contact. My policy when purchasing a service when you finance through another company which was cherry not me. it's a zero refund policy.
However, I did give her a partial refund and that got taken care of a few weeks ago.Customer response

I was offered the service and agreed to an "introductory/sample" demonstration. I was never handed a copy of what I signed, she asked me to sign a blank screen on her cell phone and told me she would give me a printed version and the contract/agreement. It never happened. On the weekend of the first week of July due to the heavy rain period my house was flooded and condemned. I immediately notified the merchant that I was moving back to Brazil since I have a son who is disabled and could not be exposed to the mold and extensive work that the house will need to go through. I provided videos, pictures of everything to her. Her reply after seing the horrific destruction was " my heart goes out to you, you will in my prayers", ALL SALES ARE FINAL and there is nothing I can do. She added that I should have read the policy on her website, which was the first time I heard about.
I then started being harassed in Brazil by ****** ************ her financing company, getting sometimes 7 collected call on a day, since I do not have an international plan.
I begged them to stop calling and tried to explain my situation. Nothing changed. The calls were non stop. I have an approximate amount of 736,00 dollars in 1 month from their calls. Cherry's told me to file a complaint with their department which I did on August 30th and they would present me with a response. I have never heard back from them. The daily harassments with calls continues to this day. The merchant blocked me , and only answered me again on October 2nd. I can provide documentation of the conversations, videos, pictures and the bills and call log.
Please explain how you think the business was unfair or deceptive.
The businesses (both the Healing Tree) and Cherry were very dishonest and deceptive in the way they treat customers. No copy of agreement was provided. It is very mal practice to tell a customer that the client should anticipate that the policy is on the website and as soon as you walk into the business you are agreeing on the terms.
I notified the merchant on a timely manner. She was not professional or courteous by first cancelling the very first appointment at the door after I drove for over 1 hours. Above all is not that I acquired some merchandise then returned it making it useless. I discussed having a service offered and since I am not geographically present anymore I would no longer be able to use the services. She did not waste, invested, or dedicated any time or material with me leading the business to loss. That was not the case at all.
Finally, considering what the circumstances are that affected me and my son and I acted in the most honest way on notifying and constantly trying to contact both the Healing Tree and ****** ************ I came to sheer desperation for above all handling the constant harassments and a huge phone bill resulting from the international calls, I still have one pending, for something that I acted right the whole time.
