      Dan R*** is the owner of Unique Realty LLC, http://thegleamteam.com/ *** *** St, *******, NH ***** (***) ***-**** Dan R*** was hired by my 80-year-old Mom to manage her rental property, located at ** ******* Drive, ****** NH. (NOTE: my Mom has some disabilities so I - as her daughter - am helping to file this claim) From 2016 to October, 2021, Dan charged Mom the first month's rent and a monthly fee of 8% to manage her property. Tenants that Dan found and signed contracts with moved out of our property in October 2021. During the 5 years these tenants lived in my Mom's house, they broke the lease agreement on several fronts. 1. started a business at our property (they opened a mechanic shop) 2. they brought two large dogs into the house, the dogs damaged property 3. tenants and dogs damaged the property costing us around $10000.00. The property wasn't rentable when they moved out. Dan R. did not manage the property according to the lease, and HE RETURNED THE SECURITY DEPOSIT TO THE TENANTS without performing a walk-through with my Mom, the property owner. When Mom asked for the security deposit to cover damages, he said he gave it back to help the tenants with the purchase of their new house. I have the texts he sent me regarding this issue. MORE IMPORTANTLY, Mr. R*** collected a 6% commission on a house he sold to the tenants when they left my Mom's house. It seems clear that he represented THEIR interests, and not ours. Please advise us on how to proceed to ensure accountability and fines for mismanagement by Mr. R***.

      Business Response /* (1000, 12, 2022/03/01) */ I managed the property at ** ******* Drive in ****** probably for 10 years. There were a handful of tenants that lived there in that time frame. Not one month went by that I did not collect rent and send it to the Owner. I did charge 8% per month to collect rent, below the market rate of 10%. In that time frame, the Owners did not have to put any money into the house. I believe the water heater went once or needed service. The interior needed an interior paint job and a couple minor fixes from day one. The last tenants did have one dog. They did not use the garage as a mechanics shop open to the public. They paid for the use of that garage for their own use. The tenants had the driveway sealed and replaced the refrigerator when the old one broke, both situations the tenants paid for these expenses and did not charge the Owner. They left the refrigerator when they vacated. In the fall of 2021, during covid-19 and the beginning of a new school year for the tenants children and winter approaching. The daughters of the Owner demanded that the tenants vacate so the Mother could move back in the house. The tenants were in a tough situation as there were no rental properties available, especially in that immediate area and school system. I tried to keep both sides happy, I was able to help get the tenants financing and by the grace of God they were able to buy a home in another town. They were out of the house within 90 days of the beginning of the Owners family's consistent demands. If the Tenants didn't get their deposit back they would of not been able to buy and move into this home. No one showed up at the scheduled day and time of the walk through with me. When it was 10 minutes past the appointment I called one of the daughters and they said they were still at home and would leave shortly. I had other appointments and needed to leave. This Owner can not be pleased, is ungrateful for the years of good service I provided and is looking for someone with deep pockets to renovate her home to her liken. It is truly a shame that people can be so demanding and disheartening to a good paying family for four years.. My opinion is paint the inside of your home, fix any minor wear and tear items that happen when a property and rented for 10 years, move in and be happy! PS I did not make 6% on the sale of their purchase and this Owner is suing the Tenants for thousands as well. The house was used as a repair shop and many neighbors were upset with all the noise and the traffic. The neighbor opposite our house will testify if necessary. The garage floor was painted blue to cover for the oil spills as they were fixing cars. A camera was installed on the garage door for surveillance of the structure on the outside of the garage where they were storing cars for repairs. We didn't charge any rent increase for at least two years due to Covid and yes, they were late paying the rent a few times. the management rate is at 8% not 10%. We never got a chance to view the house to assess the damages till after they had left. the property manager left the key under a mat outside without any walk through. He paid the deposit and interest back to the tenants even though there were substantial damages to the house. We got an estimate of $10,000 for repairs. we can provide the invoice. we have pictures of the damages. the house was not to be used as business entity as specified in the lease. We had specifically asked for no pets but the property manager allowed two dogs without notifying us or any extra security deposit. The property manager was paid by us but acted on behalf of the tenants. The lease agreement had become tenant at will without any notice. we found out about two years after the lease was changed. There were many disputes between the tenants and the neighbors specially the one across the street. The previous landlord to these tenants came by our house and showed us many pictures of the damages they had caused to his property. I immediately notified this manager and requested to start eviction and give them sometime to leave. He assured us and they would be good tenants. our house was in a great shape and professionally cleaned. These guys left the house in aa mess and a lot of damages to repair. We hired a property manager so that we don't have to directly deal with people like these. The manager acted unethical and unprofessional. We are left with cost of repair on the management fee of about $12K on top of the loss of the security deposit. There never was a walk thorough during and after these tenants were planning to leave. This management company should never be in the business of housing if honesty, integrity, professionalism and job quality is not part of their standards. This is extremely shameful. Photos are available as proof of the damages despite what this guy says. Business Response /* (4000, 16, 2022/03/07) */ Sounds like the issue is between You and your past tenants. I'm not responsible for someone else's actions. I did do a walk through. You didn't show up to the appointment. I'm not paying you money to fix your normal wear and tear items that come from tenants living in your property. Any further communication can be directed to my Attorney. ** ******* in ****** NH. I'm considering filing a law suit for slander if you don't stop harassing me. If there is any major damage as you claim, take it up with the person that did it.
