      Attached is the annual maintenance contract for our property. Grasshoppers garden center requires total payment almost a year in advance of services. Over the summer, we had frequent complaints for services such as grass clippings left on the lawn, weeds that were not pulled, trees that were not pruned, and even an employee smoking on our property. We decided this Fall, to not renew our contract with Grasshoppers. As a result, the owner did not complete the Fall cleanup stated in the contract. John M*****, the owner, agreed the leaves fell late this year, but he only finished the cleanups as a courtesy to customers who resigned for another annual contract. Our yard is left littered with leaves in flower beds, front and back yard etc. We paid a premium rate for less than average service, and in the end, a job that was paid for yet not fully executed.

      Business Response /* (1000, 5, 2021/12/20) */ The company is Grasshoppers LLC not Grasshoppers Garden Center as stated in complaint. NO customer is ever required to pay in advance to contract our maintainence services. This customer choose the pre-payment option in order to receive a discount on the yearly cost. They could have chosen to be billed monthly with out the discount. In fact they asked if they could make it in two installments due to financial issues and I said yes and still gave them the full pre-pay discount. When it came time for the second payment, I had to contact them several times in order to get that payment. Contract concluded with last fall cleanup on November 24, 2021. All properties had 3 fall cleanups in November in the complex including HOA property. Any cleanup work completed in December 2021 was due to the warm December and Grasshoppers taking advantage to make our job easier in the spring for any customers who had re-signed for the 2022 season. The above customer was no longer under contract so we had no obligation or permission to be on their property. In regards to grass clippings, the customer did voice a concern during the summer and Grasshoppers addressed this and the customer agreed that this was taken care of and resolved. Not once was there a mention of of any missed weeds.In fact we have an employee who weeds/details every two weeks for the entire complex throughout the growing season. not one customer including this one ever questioned the quality of the weeding/ detailing work completed. In regards to tree pruning, we were contracted to prune two japanese maple trees on the property. Before we had a chance to complete this work, the customer had another company prune these two trees. The cost for that part of the contract was refunded to the customer since we didnt feel right keeping something we did not earn. cigarette smoking was never brought to my attention, had that occurred I would have informed my crew that no smoking was permitted on the property, just as several other customers have asked and my crews are respectful of that request and would have refrained. In closing Grasshoppers completed or refunded all work that we were contracted for on the above mentioned property. Consumer Response /* (3000, 7, 2021/12/28) */ (The consumer indicated he/she DID NOT accept the response from the business.) Unfortunately, there are many discrepancies in the response from grasshoppers. Attached are the text messages regarding the smoking on the property as well as the grass clippings throughout the yard. In addition, there were 5 more working days in November for the final cleanup to be completed per the contract attached. We did hire another company to prune the Japanese Maples, the arborvitaes were never pruned nor were the bushes in the back which were quoted together at $1250, We were returned a little over $200. We have since hired another company, but would be remiss to not bring this type of business behavior to the BBB's attention. Thank you. No other resolution needed. Business Response /* (4000, 9, 2022/01/07) */ The arborvitea were never included in the contract price. That was a seperate price from a tree service and the consumer chose not to have our tree service do that work for them. There are many descrepancies in their responses also. They stated no further resolution is needed, so I think it is best to just agree to disagree wih this customer. We are a 37 year company with an excellent reputation in the area for the work we perform and the customer service we are proud of.
