On October 22, 2021 the Consumer Protection and Antitrust Bureau filed charge for one Class A felony count of Theft By Misapplication and one Class A felony count of Theft by Unauthorized Taking in Rockingham County Superior Court. Charges filed allege the business is in violation of state law, alleging that on or between November 11, 2019 and October 24, 2020, Mr. Gioseffi obtained or exercised unauthorized control over the property of D.C., specifically U.S. currency, with a purpose to deprive D.C. thereof, in an aggregate amount in excess of $1,500. Additionally, charges allege that on or between November 11, 2019 and October 24, 2020, Mr. Gioseffi obtained property, specifically U.S. currency, from D.C. upon agreement to make a specified payment to Groundhog Landscaping, whether from that property or its proceeds or from his own property to be reserved in an equivalent or agreed amount, and he recklessly failed to make the required payment to Groundhog Landscaping, and dealt with the property obtained or withheld as his own, the value being in excess of $1,500.

On July 14, 2023, Mr. Gioseffi pleaded guilty and has been sentenced in the Rockingham County Superior Court to one class A felony count of theft by misapplication and one class A misdemeanor count of theft by unauthorized taking. On the theft by unauthorized taking charge, the Court sentenced Mr. Gioseffi to 12 months in the House of Corrections, stand committed. On the theft by misapplication charge, the Court sentenced Mr. Gioseffi to serve 2 to 4 years in the New Hampshire State Prison, all of which is suspended for 4 years from his date of release. As a condition of the suspended sentence, Mr. Gioseffi is ordered to pay $84,150 in restitution and is enjoined from soliciting or accepting any advance payment for the duration of his suspended sentence.
