      This job was first begun on 4/27/2021. Since then, there were significant cost overruns, of which I agreed to foot half of the overrun cost. I paid for that portion. To this date, the job has not been completed. There was to be a retaining wall built field rock stone, never done. The lawn to be regraded, loamed and reseeded where materials were brought in disturbing the lawn. This also was never completed. Numerous calls have been made with no response from the owner of the business. Voice messages have been left as well. My last phone communication with him occurred in November 2021 in which he stated that he would start completing the remaining work on 2/2022. In the last three weeks, I have called leaving seven voice mails with no response.

      In regards to the letter sent in by Mr. ********** 

       

      I am sorry to hear that Mr. ********* is disappointed. We strive to make our customers happy but unfortunately there are times, although rare,  when things are out of our control and we can not meet expectations. In the instance of this particular job we ran across issues where a neighbor was displeased because he felt we were too close to wetlands and called the town. Who shut the project down and gave us a day to remove all the equipment, which included and excavator needed to place boulders for the retaining wall. 

       

      It is, however, the homeowners responsibility to pull all permits. I did not believe the property was on wetlands. This caused a major delay as the State had to be contacted and all work had to be halted. We were not permitted to continue work on the retaining wall until the matter was sorted out. This caused a lot of unforeseen, added expenses to the project, moving equipment in and out of the area. The stone wall in question is at the edge of the property where the wetlands are said to be. 

       

      We did however complete the following work manually, physically loading and moving material which was planned to be done with equipment: the steps and the firepit patio leading to the steps. I did also fix the lawn, grading, loaming and seeding , repairing all the areas that were misplaced by our work. Not using equipment means more man power and  also caused the project to be more labor intensive and time consuming driving cost up. I added the extra cost to the project in order to break even and the customer was not willing to pay the extra costs. He did pay half but I lost money on the job. I informed the customer that I was unable to complete the work that was not paid for as it was unprofitable for my company.

      Complaint: 17045696

      I am rejecting this response because: the work was not completed as contracted. The company was paid as agreed whereas the wall was not built, seeding not completed and regrading was not completed, Stone was not replaced as owner of the company stated he would take care of all of this. The payment made was not only for initial work but also the agreed upon splitting of the cost overruns that were a result of company's actions. 

      All of this was agreed to by the owner of the business.
