    TOTAL HOME PROTECTION TO PAY $400K IN RESTITUTION, REVISE BUSINESS PRACTICES

    The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

    Dec 9, 2021, HARRISBURG  — Attorney General Josh Shapiro announced today that Pennsylvania based THS Group, LLC — more commonly known as Total Home Protection — and its owner, David Seruya, have agreed to pay $400,000 in restitution as part of a settlement of the lawsuit filed by the Office of Attorney General against the home security company for deceptive marketing practices. With today’s settlement, THS and Seruya have agreed to revise their business practices.

    THS advertised and sold home warranty “service contracts” to consumers, many of whom were elderly or otherwise vulnerable, in Pennsylvania and dozens of other states. The lawsuit filed by Attorney General Shapiro’s office stated that THS and Seruya falsely advertised the coverage and services available under these contracts — and once consumers were locked into a contract, THS and Seruya used creative and deceptive means to wrongfully deny covered claims, failed to respond to consumer claims and inquiries, and refused to reimburse or refund consumers in accordance with the terms of their written guarantees.

    Today’s settlement agreement prohibits THS from, among other things, using advertisements for service contracts that contradict the terms of the service contracts themselves and engaging in unfair and deceptive conduct to deny coverage.

    THS is required to make meaningful, substantial and specific changes to its business practices, including but not limited to sales policies, claims evaluation processes, the cancellation process, and customer service policies.

    THS is to pay a total of $750,000, which is broken down as follows:

    • $400,000 in consumer restitution
    • $200,000 in costs
    • $150,000 in civil penalties, with an additional $150,000 of civil penalties suspended.

    The Consent Petition allows for restitution to be paid to eligible consumers including any additional consumers who file complaints with the Office of Attorney General’s Bureau of Consumer Protection by Sunday, February 6, 2022. To be considered for restitution, any consumers who believe they may have been harmed by THS should submit a complaint online at www.attorneygeneral.gov/submit-a-complaint.

    This company offers home service contracts which provide limited coverage to repair certain items in contract holders' homes.  These service agreements are not meant to be emergency service contracts and immediate services may not be available under the terms of the contract.

    The BBB suggests that consumers read the home service/warranty agreement to understand its terms and limitations.  Consumers should understand any additional fees associated with the contracts, like direct payments to service providers, after the warranty company dispatches them.  Consumers should also understand that even though the agreement may cover a specific appliance or part of your home, it may not cover the specific issue.

    I signed up for a 2yr contract with this company on 6/2023. on 3/2024 I filed a claim for my roof. 2 days later I received an email stating they cannot find anybody in my area to fix my problem. I get another email telling me to find my own roofer and get reimbursed up to $300. I'm still waiting, and roof is still not fixed. On 6/2024 I filed another claim for my sewer drain, The next day I get the email, cannot find anybody, find your own and get reimbursed up to $200. I called the company on 6/14/2024 to discuss my frustration with the company and asked to cancel my policy according to their policy terms. I got told by the manager that day, the cancellation was processed. An hour later I get a call back we can't cancel. I called the manager back and asked why. The manager tells me they are not willing to cancel this policy according to their terms and conditions. I saw the cancellation should be in writing. I email a letter and mail the letter, asking to cancel the policy according to the terms and conditions. I still got no answer from my request. They are breaching their contract and forcing me to keep it.

    A bunch of crooks!! I have summited 4 claims over the last year and they havent fixed anything yet.THE LAST ONE WAS A FEW DAYS AGO.My hot water heater went out and they want even send anyone out to look at it. Put two claims in on it and they closed both of them without even sending any one out to inspect my heater!!I payed them 3 years in advance for the warranty ($1200.00) and I can get them to fix nothing!!The fine print is where they get you at in the contract.They dont cover nothing that in writing.Please stay away from these people!!!They want even refund me my money because they said both parties have to agree to cancel the contract and they dont agree!! So I dont get my money back or get any thing fixed..I WILL DO ALL I CAN DO TO WARN OTHERS ABOUT THIS COMPANY THROUGH SOCIAL MEDIA!!!
