      I been harassed, over and over, by this company. I did a no commitment, no contract gym sign up. Before my month end I made it clear I was coming back. First call was after they charged me again. I said I'm not coming back to that gym. I go to another gym. I called my credit card company and closed the account, because they said they can't stop the charges. I still get calls. Today I'm called again saying I now owe $173, for a gym that I have no commitment, contract, I told them I was coming back, and it's been about 8 months or so. They saying it's going on my credit report. I record the 2 calls and both times explain I'm not returning. I went online signed up, I didn't have to sign documents and bring it to the gym.

      ************* signed up for a gym membership at Retro Fitness of Egg Harbor online, the membership he signed up for was our Ultimate membership and he paid $32.18 a month, this was done on July 22, 2021.

      ************* attended the gym 3 times during the month of July and then stopped coming. According to the notes from the billing company they started trying to reach ************* in November when his payment did not go through with the credit card he put on file. In the notes from *** Fitness Solutions they advised ************* of the gyms cancellation policy, ( signature required either in person at the gym or mail a letter with a reason for cancellation and a signature) his response, he insisted he won't pay or send a letter.

      *** Fitness Solutions *************) is the company that we use for billing purposes. ************* was contacted by *** and not the gym for a resolution to this matter.

      ************* signed up for a no contract membership, it is month to month and will continue until the member cancels the membership, either by in person signature or a letter received in the mail with a reason for cancellation and a signature.

      It appears that this complaint is with the billing company, if there is anything else i can assist you with in this matter please feel free to contact me.

      Again I didn't send in a letter or sign in anything in person for you to allow me to come. When I sign up I did not sign up for ultimate. I signed up for $20, on one of the days I came to the gym, my little brother came and he was buying $10 per day. The guy at the counter would let the not pay time to time. I asked if he could be a guest. The guy at the counter went into the computer came back and said we are good. If he changed it to ultimate, and again didn't get a signature nor told me he changed my plan. That is 100% wronging doing on retro end, as well as I didn't sign nor again for my plan to be changed. Shortly after that I informed them I wasn't coming back. I was charged. I then call and canceled the card, especially because I was charged a higher amount then when I signed up. Now I know why I was charged a higher amount, without my permission the plan was changed. I didn't sign or agree to any plans to be changed. I asked about someone working out, and we were told we are good. He can sign a affidavit to to. As well as the other 2 gym member that were standing there. I have the contact info and can get affidavit from them. So it was illegal changed, without a signed agreement to pay for higher amount. Let allow I haven't been there, you seem to agree I said I wasn't coming come, and yet you tried to charge my card, after I said no. That again is illegal. You can't just go charging whatever amount you want, even after I said don't charge my card at all.

      This response is in reference to the additional concerns by ************* about his account.

      ************* signed up for a gym membership online and he signed up for the ultimate membership. There is no documentation of his membership being altered in anyway. This information can be confirmed through our billing company *** Fitness Solutions. When ************* signed up online he entered into an agreement, he was given the option to print out his agreement and everything is spelled out in that agreement.

      The membership was not changed by any Retro Fitness employee, again this complaint appears to be directed at the billing company *** Fitness Solutions since they were contacting him about his past due payment.
