David B.the Owner of ASAP came to my home give me an estimate on repaving my driveway and on March 27, 2024 we signed a contract for $12,000 for work to be completed on May 28, 2024. Mr. B. deposited the check on the same day. The contract indicates that the payment was received on May 28th, but that is an error. On May 22, I reached out to Mr. B. through a text message confirming that he would be coming on the 28th. He confirmed he would. On May 28th at 9:46am I texted Mr. B and asked him if he was coming to do the driveway. He texted back asking to reschedule for Friday May 31 because he was behind due to rain. I agreed. On Thursday May 30, Mr. B. texted me asking to reschedule for Wednesday. I texted back asking him to confirm June 5, to which he did not respond. I texted him again the next day to confirm June 5. No response. On June 4, I texted the customer asking to confirm that he was coming the next day. No response. On June 5, I called him and texted him. No answer and no return text. At 9:12am I received a call from a woman who said she is Mr. B.girlfriend. I do not recall her name. She claimed that Mr. B.will be doing the job soon. I told her at this point I that I want my deposit back for breaching the contract. On June 6, I received a text from someone identifying themselves as Mr. B.stating that either himself or his cousin would "definitely be in contact" with me. This is the first time a cousin was mentioned and have no idea who that person is. I have tried to call multiple times and Mr. B.doesn't answer. I have sent multiple text messages requesting my deposit back and to meet at a neutral location with no response.
