      Defendant Freehold Nissan, now known as Raceway Freehold Nissan along with the managers *************************, and *******************************, alleging violations of state Unfair and Deceptive Acts and Practices (UDAP) statutes the New Jersey Consumer Fraud Act (CFA), Negligence, New Jersey Lemon Law, ************************* Warranty Act, breach of contract, negligent hiring and supervision, Defamation, emotional distress, breach of implied warranty, and misrepresentation or fraud.. The Plaintiff claims that the Defendant engaged in deceptive and unfair practices related to the repair and maintenance of the Plaintiff's 2019 Nissan Altima SR causing financial losses, damaged property, emotional distress, and unlawful detainment of Lucass property for over 12 months. Negligent Communication: Freehold Nissan and *************************, as representatives of both Freehold Nissan and Raceway Freehold Nissan, negligently failed to communicate essential information regarding the transfer and location of the plaintiff's vehicle. The failure to respond to the plaintiff's phone calls and messages, as well as transferring the plaintiff to voicemails without addressing his concerns, demonstrates negligence in communication.Withholding Documents: Freehold Nissan and Raceway Freehold managed by *************************, , unlawfully withheld important documents related to the plaintiff's vehicle, denying the plaintiff access to necessary information, such as service records and billing details. The refusal to provide documentation despite multiple requests demonstrates an intentional act of withholding information.Violation of Consumer Rights: *************************, violated the plaintiff's consumer rights by failing to provide accurate information about the vehicle's status, denying access to service records, and refusing to disclose billing information. Breach of Contract: The defendants failed to fulfill their contractual obligations by not returning the plaintiff's vehicle and denying him access to it.
