On 2/2/24 a salesman promised me that the bathroom would be completed before my guest arrived at the end of the month. He even contacts the loan company. He was verifying and guaranteeing that the project would be completed in 1 day. They made appointments and they canceled. We called and it's not easy getting in contact or receiving callbacks from the company. Excellent salesman but poor service after you sign the contract. After several attempts to contact them. They finally answer and want to come back again for another measurement. After, I told them they had not fulfilled their agreement. Unable to contact them. Their salesman is promising one thing, and the service company is not. The loan company was just as bad they gave me a loan and wanted the first payment on March 4, 2024, because they assured me that the bathroom would be complete. I spoke with Joesph at ext. *** and requested a refund. He said I cannot because it has been passed 3 days. I said you have not fulfilled your part of the contract it's passed 4 weeks now into 8 weeks. He said they have a year to install the bathroom. I told him that's not what your salesman is selling. As of now, I feel it's a scam. The bank asking for a payment with no work being completed timely and the salesman is not telling the truth. If we had to wait 8 weeks to 1 year for a job to be completed. I would not have used their service. I told him if they don't refund the money because they have done the job. I will contact the credit card service. Report it as a scam. I have a signed loan contract with ******* ******* *** with ***** ***** and a contract dated February 4, 2024, passed 8 weeks and the first payment is due on 3/4/2024. Which verified that the work was told to us it would be completed before my guest arrives.Business response

After looking at the contract, there is no where it discusses rushing the job or completing by a specific date. We are able to complete the project as discussed.Customer response

I am rejecting this response because:
That's the problem. Your salesman said it would be completed by the end of the month and pushed to get the loan pushed through. Not only that. Your contract said 4 to 8 weeks. You should not be allowed to make promises you can't keep. Your salesman should not mislead or outright be dishonest. Change the way you do business. Honesty should be your policy. I am requesting a full refund. Why? Are you demanding to force your service on a job. You haven't started. Your company can't keep an appointment, don't return phone calls timely and don't answer the phone.

3. TIME AND DELIVERY FOR INSTALLATION: Delivery time will be approximately 4-8 weeks but it is not guaranteed for a
specific date. Buyer understands that any delivery or installation date is merely Bath Fitter® failure to perform agreement by a
given delivery or installation date shall not be a breach of this agreement and Bath Fitter® shall not be liable for any damages
to buyer for any delay in Bath Fitter® performance of this agreement. Time of essence for installation: Work must be
scheduled and installed within one year of the date on the front of this contract. O’Gorman Brothers, Inc. reserves the right to
keep the deposit paid and product ordered, if this criteria is not met.The time frame is approximately 4-8 weeks, but there is no guarantee that it will be done in that time frame. We are still on pace to get everything completed as sold. As for the sales rep, there is nothing on the contract that discusses a specific date.
