I was conned into this agreement from a 3rd party with the amount of $490 cancelation fee. After everything was signed and my system was hooked up I realized how much money it was costing me to have their services. I called to cancel the services and was told it was going to be $48,000 to cancel. I was lied to by the rep that I talked to. The system I am paying $48,000 for is only $2000 to buy. This company is a scam and is hurting the working people. When I was signing the contract it was all sent to me through the 3rd party. I did not even know about Finova Capital until I seen the charge on my bank statement and called to dispute the charges. After reviewing their contract their name is at the top but is blocked out by numbers. Everything was done through SBGA and not through Finova. I asked for the call recording to prove my case that I was lied to but they would not provide it to me. I am currently paying $850 a month for 48 months for a $2000 system.Business response

I have a lease for a Clover POS system with Finova Capital in my ice cream, I sold the business and Im not getting another business, the new owner doesnt want that system and I call Finova to cancel the contract but they told me I have to pay $7000 even if Im not using the equipment. So how you can help me.Business response

In April of 2023 our business signed up for merchant services through FM Pay. The local representative was a local person known to us and assured us repeatedly there was no contract involved and it was month to month. Shortly thereafter we were shipped equipment by Finova Capital to begin processing payments and the monthly charge was $345.40. This merchant service did not work for our business and we have been actively trying to cancel through FM Pay since late 2023. We signed no contract with Finova Capital but received the attached c demand letter for $13,008.35 to buyout a lease we DID NOT sign. They refuse to send a copy of said contract. For a small business this is a huge amount of money. FM Pay is fraudulent, the local rep was no longer employed 3 months after signing us up. I have copies of all of that and nothing included a contract as Finova has stated. We had never even had contact with Finova Capital. This equipment is a register drawer and 2 Ipads, at the most worth $2500. We will happily return all of that and have paid over $3500 to them so far. This company is fraudulent. From all the other reviews it seems that FM Pay, Finova Capital, Cascade Leasing and Riverside Payments are all in business together to scam small businesses with promises of lower fees for merchant services. FM Pay has you sign a no-contract comparison showing great savings then the billings begin from all these other companies and they will not speak to you on the phone or help resolve the situation in any way. I just want to get them their equipment back and them to cease their auto withdrawals from our bank.Business response

Signed up with a company called riverside payments who leased us machines from finova capital. Riverside's bank ended up dropping us(and holding on to over 20k of our money for a month) so we could no longer use the machines leased from finova. When contacted by finova, I sent their machines back to them. They have now sent the account to collections even though I can't use their devices AND I sent their devices back to them.Business response

I signed a contract with this company through another company and was unaware that it was a contract that could not be cancelled. They initial company did not disclose that it was a non-cancellable contact. ****************** did not explain that the credit card machine was leased through a different company. I was not happy with my services through Riverside so I decided to cancel them. That's when I found out that I was under a non-cancellable contract with Finova Leasing. Finova then lets me know that I have to pay $5988.02 to "buy out" the rest of the contract. This is a small business and it is unfair that they are having Riverside reps lock people into contracts that are "non-cancellable". I will be speaking to our attorney about this as well, but I refuse to pay $6000 for a piece of equipment that is worth less than $1000, that they are just going to get back and reuse for some other customer and charge them $6000 or it as well. They are straight scamming people with their contracts and pricing. That is also price gouging. I am willing to send their equipment back and pay their ridiculous restocking fee of $150 if they will cancel the contract.Business response

************** has had my business in limbo for nearly 3 months because the system I was promised and that they have me financing through Finova Capital was not what was promised. I've been ignored with no result or resolution from the company. Yet the company has continued to charge me $27.95 for merchant services and I am also being charged through Finova Capital various fees which is even higher than what the contract stated. I spoke to ******************** and he promised to get me a system that can do all the things my current POS system can. I was used as the guinea pig for TCP. The system I was sent did not include all that was advertised. **** still has no date of arrival for the missing parts. Additionally, their representative was unable to factor in the upcharge for those paying with card. Between Finova Capital and TCP, I have been charged $512.64 for equipment that TCP promised to send a return label for. Finova, I am paying for equipment I did not receive nor am I using.Business response
