Back in May I hired **** to do my landscaping in the front, I had my septic dug up and I wanted grass seeds put down. He gave me an estimate and wanted 1/2 money up front and stated he could be done with job in a weekend. I wanted about 1-2 inch of dirt with new seeding. I was taking out a flower bed, so more dirt would go there. Everything was a disaster...I told him to order 16 tons of dirt he only ordered 8...I said I told you 16, we already measured and that is how much you will need. long story short, in between, he took other jobs, the other 8 tons came from the dump, had glass and metal/ceramic mixed in the dirt. He never came back to finish the job. He said I never called him...He never text me....he was suppose to be done before the holiday. I told him he was not getting the other half of the money because me and my family had to do the rest! with the awful dirt! I PICKED OUT GLASS FOR DAYS! AND STILL HAVE IT FOR PROOF! AND NOW HE IS SENDING ME A **** WITH LATE FEES! NO!Business response

The contract she failed to sign says will lay 1/2-1inch of dirt. i told her many times you can not lay more then that because of your sprinklers. It also states i will not be held responsible for wash out. The Dirt she is talking about i called my supplier and they admitted it was there fault. I wanted to work with the client but she refused. She did not need 16 tons of dirt she insisted to buy it so i did. when i was done with the dirt there was 4 tons remaining. i told her to do as she wishes with it just leave me enough so i can level where the dirt was and seed. i called back a week later and she refused to pay be because of the dirt situation. She insisted to say i did not preform any kind of service. as you can see by the the picture the grass all grew in as it was supposed to. that picture was taking 2 weeks when she refused to pay. client needs to finish payment for the job. I am rejecting this response because:
************** has not been truthful with many things. I just found out he did not have his ** Consumer Affairs License while trying to do my lawn. Where are receipts, you will need them in court! I never signed a contract for 1/2 inch of dirt! 1/2 inch is run off dirt gone, in one rainfall where we live.... I wanted my lawn leveled and you know it! Remember there I have two witnesses to all of our discussion. And original Texts beginning to end. Yes I refused for you to come back, after you had texted me that you would show up and did not, NO SHOWS for you were more and more. I have dates, times and text. Verifying everything!! When a contractor does not show up with the time they agreed upon with the customer it is a strike against you!! See another lie your last text to me was to see if I would pay you some money not all. YOU NEVER WANTED TO MAKE IT RIGHT. YOU NEVER SHOWED UP "NO SHOW" HAVE TEXT AND WITNESSES! WHEN YOU DID CONTACT ME JUNE 5TH & 6TH over a month into it....(which you said two weeks tops) You just wanted your money, did not care about what you did to us. The pictures better be of my lawn, because we redid our own lawn. Added dirt where it needed dirt and you can ask every neighbor that came by. So, you will need to come up with original receipts, from your supplier that you had the dirt paid for....because dump dirt cost $0.00. So in my eyes you kept the money for the dirt.....you pocketed the money that was supposed to have been my clean dirt. You made out.....not me. Take me to court. I am so ready to have your lies laid to rest, with proven text messages and many photos that prove your inconsistency on how you treat clients. How he sees that this was finished is beyond me. I have sand....I wanted Dirt with Grass. Concept People. Grass grows on dirt... So I wanted a good amount of dirt, never mind the sprinkler. GRASS WILL NOT GROW ON SAND I GOT CRABGRASS THAT IS WHAT GROWS ON SAND!!

There was a slope already on your lawn from the house to the street. from the road up there was at least a 4inch differed i told you you would not want to level from the street you want to keep that slope because it goes away from your house. it would require at least a 4 inch height difference from the pavement (street) and your grass. I also told you that you can not do 2 inches with your sprinkler heads. they will not work. we also talked about redoing them. We agreed in leveling the best there could be. I told you from the start as well as text that your septic cover should not be covered with dirt you insisted in it getting covered. I told you i would not be responsible for wash out from rain. You said you got it redone the picture i have was taking a week in half after the only thing that looks different if there is a LOT more grass. i completed my job.
when i found out about the glass in the dirt i told you i would call the supplier you said you did not care and did not want to work with me. that is your lose. I did what i could to work with you. you also did not want to sign the contract. you signed my quote. when signing my quote is the same as signing my contract. if this is not resolved and it goes to court you will be held responsible for all legal fees and cost associated with this. you are talking about almost $600 to resole this I offered you to resolve at $400 you refused. I also tried to work with you to resolve this in text you still refused to. when it came to your lawn I put 1 inch down and you complained that i covered your sprinkler as well as your water shut off. when in fact i went around it. you simplify are looking to take advantage of a small business. As far as my business license i never broke ground and it was in process of being renewed. you state there was a delay. I told you my situation and it didn't mind if it took awhile to get done. in the end there was a delay due to waiting for you to move the remaining dirt that was not NEEDED as i told you. i was not responsible for removal of the dirt you choose to want. At the end of the day i supplied you with a service. whether you think it was done right or wrong a service was provided to you. I am willing to work with you to resolve this. you are being very hostel. you have even been harassing my collection company.

I am rejecting this response because:I cannot harrass a collection agency.... they told me send me what you have a to prove you do not owe ************** anything. So, I did....So I guess, on there point of view, I provided them with enough information that I do not owe you anything. Guess collection agency knnow the law, you cannot go after anyone that doesn't owe you anything. So they left me alone. ****************** view is ****************** view. There are other views and if he wants court that shall be it. No more back and forth..... Please take me to court. THIS WILL NOT END GOOD FOR YOU
