Contracted Fantastic Pools by *** to put a pool in ********** ** in January 2021. He said it was no problem with him coming from ** to ** to do the work. Spring of 2021, he is to start, but then he tells us that we need to find an excavator to dig as he doesnt have anyone, even though it was in his contract that he would take care of it. We find one and hire him. The pool is started but then delayed due to material issues because of Covid. That is understandable and not a problem. In late fall, he is finishing what he can, but we needed to have the pool closed to finish up this spring. We called him when we got the electrician here to hook up the pool mechanicals and he said hed be out to finish up. This was about three weeks ago. His contract included one closing and one opening, plus the chemicals to get it started. He also needs to explain the systems and show us how to use them. He said he would call back with a time to let us know when he could be out here, but he was busy putting new pools in. We told him he should finish this one first. He hasnt called back, and now every time we call, his phone goes straight to voicemail and its full. We tried using a different number and he picked up and said hed call and lets us know what time at the end of this week hed be here. No call, and still cant leave a message. Texts go unanswered. He has been paid in full. He kept pestering for payment, and we inadvertently paid in full and didnt realize it. We just want the chemicals and the pool opened as was in the contract. I cant imagine it should take him more than an hour to finish up, so I dont know why this cant be taken care of promptly.

      Hi *****,

Just to clarify a few misleading comments presented by the customer. ********************** contracted a pool with the customer on April 12, 2021, not January 2021. The customer wanted to use his own excavator and electrician; however, his electrician never did a pool. The customer was in a rush to complete the pool; however, we did not receive their first deposit check until July 25, 2021. His excavator was unable to start the job earlier, and did not start excavating until early August 2021. Fantastic pools started and poured concrete on August 17th, 2021. We ordered a Loop-Loc mesh cover to cover the pool. Fantastic Pools completed the pool by September 2021 and covered it with the pool cover because without a fence, it is illegal to have a pool opened (and the electrical was not completed). We received their last check on October 18, 2021. We could not open the pool early spring 2022 because the electrician did not finish the job until spring 2022. However, the following issue is that we told the customer numerous times that by law, he needed to put a fence around the pool and needed a final inspection prior to Fantastic Pools opening the pool. In November 2021, we told the customer he needed the electrical and inspection completed by April 2022, and were available to book an opening in March or April 2022, as we were booked from May onwards with other jobs. Despite telling the customer he needed a fence, and they were not satisfied with the answer, Fantastic Pools went in May 2022 and put the chemicals in and started the pump (to prevent the water turning green), but did not open the pool cover because the fence was not completed nor was the final inspection. After two weeks, Fantastic Pools contacted the customer to inquire if the fence was completed so the pool cover could be opened, and the customer stated he had the fence completed and already opened the cover for the pool. The customer notified the Inspector in the town, who told the customer you need a fence and electrical completed before he opens the pool. It is still unknown if the customer passed or had a final inspection.

      Thank you,

      ***** Torunidis
