      **** the owner of Southwest Speed was supposed to do a new engine build on my 1991 GMC Jimmy, we starting planning the build on Jan 13,2021. **** assured me he could do the work so I gave Southwest Speed three payments of $15,000, $5,000 and $2,600 to get some parts ordered so we could start the build. He gave me receipts and receipt numbers. I was told the parts would take some time because of Covid. I have never been contacted on the progress of the parts or when the truck would be started. He is never at his office to answer questions. No parts were ever ordered and he moved to a new location with 0 communication. He doesn't acknowledge the three payments and blames his employees for everything. He now doesn't want to finish my truck and doesn't want to refund me my money for parts/service I never received. My truck has been waiting to get everything installed for 2 years now. I was trying to give Southwest Speed the benefit of the doubt because of Covid and everything but I am getting taken advantage of. This has been the worst experience and I wouldn't recommend Southwest Speed to anyone. I even referred my friend ** to him and he is dealing with the same situation after spending $20,000 at his shop also. I wish I could get a refund for my time but that is already gone. I finally got ahold of **** and went to his office and he had me pick up my engine from his shop and never gave me my $22,600 or my parts. I need that money to finish the truck at a real automotive shop. My truck is at a stand still and this is not how business should be conducted. All I wanted was for my high school truck to be finished but now I am dealing with this.

      Mr. ****** ****** came by my shop this week on Wednesday the 24th in the afternoon in reference to this claim and spoke to me directly about his situation. 

      I have only seen Mr. ****** once in my life before this week and that I knew only about his situation after him coming to talk to me this week in person.  He had been to our shop and spoke to a former employee (***** ********) and allegedly gave him money to perform some work outside of my business between him, Mr. ****** and another 3rd party entity - not Southwest Speed LLC - as we do not perform the kind of work that he was looking for. 

      I would like Mr. ****** to acknowledge that he in fact gave this former employee payments directly and NOT me.  I have never received ANY funds whether cash, credit or debit to our business and am more than happy to provide all financial record to prove and support my statement.  This statement is slander, libel and an untrue fact. 

      I respect, acknowledge and believe the fact that Mr. ****** states that he gave a former employee of SWS LLC some sort of payment(s) and that this former employee is currently under investigation by the Bernalillo County Sheriffs Office for said actions and others similar to this. (Case # *************).

      I kindly and voluntarily shared this information with Mr. ****** and showed him that Southwest Speed LLC has never received any payments or monies from him but his reply was simply "well, your insurance or you should just pay me back since it's a business."  He also stated that he was in communication recently with the abovementioned person to whom he gave money to so it is in my professional opinion and belief that he should be filing a complaint against that person, who also is a business (***** ******** - ******** ****************** *** ********* *** *** ************ *** ****** ******* *** ******) and and not Southwest Speed LLC. 

      Please allow me to share with all parties involved - at any request - any information, data, financial records, witness testimony from current employees or anything else needed to support this claim for immediate resolve and dismissal.

      The provided attachments from Mr. ****** are estimates - not paid invoices.  All invoices are recorded and payments processed accordingly.  

      Also attached is a screenshot of all customers who have paid SWS LLC any monies - Mr. ****** is not in this list.  

      Customer claims payments were made in cash to **** *****.  This is not true.  Southwest Speed LLC does not have any record of any payments or deposits reflecting such either.  As mentioned previously, it is believed that Mr. ****** and a former employee were in communication and dealings for business outside of Southwest Speed LLC. 

      Mr. ****** will prove and provide testimony that his payment was in fact made to this person at some time when there were no other employees, nor owners of SWS LLC present.

      Hello, I have read over ***** response and it is really disrespectful and incorrect. I was referred to him by my friend ***** because I am doing an LS Swap on my truck which **** only specializes in. That is why I took him my vehicle in the first place. **** assured me he could do the work and everyone was exited for my build. I met **** and his techs who were going to work on my truck the first time at ***** shop Southwest Speed in Rio Rancho (Dec, 2021 Shook his hand). I gave the first payments $2,600, $15,000 and $5,000 to get started. **** states that I am dealing with his ex employee ***** when I am not. His ex employee was helping me with the build of the truck at Southwest Speed at the front desk. I have never had any dealings or meetings with him outside of Southwest Speed. Everything was handled at ***** old Shop in Rio Rancho. When I made the payments for the parts, I received three different receipt #'s and the dates of when I gave my payments. I have never received parts that were promised. **** is now showing that he has a criminal case against his former employee ***** and doesn't want to pay me back for my parts. I am stuck In the middle of their feud and my truck is sitting in the garage waiting to get finished. I have to pay $250 a month where its kept. I was promised it would be done a long time ago by Southwest Speed no one else. I would never have his former employee ***** touch my truck the way **** runs shop. **** is not running his business records accordingly and is trying to say my receipts aren't valid. **** pulled out his computer and said I was never a paying customer. A business owner shouldn't be in business if they treat their customers like this with total disrespect. I know I payed cash but that doesn't give **** the right the take the funds and never order the parts or even communicate. This is ***** business not ***** at the front desk business. I have only been in business with **** at Southwest Speed. I wasn't even informed of the shop move by **** I had to find the new location on my own. **** moved my LS3 motor and air kit without me knowing which I had already pre payed for. I hope my parts for okay. I just want my Money back so I can get out of this headache and have my truck on the road. **** said "He is in the Navy and makes so much money outside of Southwest Speed" so why am I loosing sleep and getting stressed everyday over this situation? I am willing to get a lawyer and go to court too get this issue resolved. I have all the receipts, emails and proof of payments that I received from **** at Southwest Speed. The estimate he gave me was never turned into an invoice because no parts were ever ordered and no work was ever started. It was a big build in progress. My money was taken and that was the end of it. I would get told your "next in line" for 2 years with no update on my parts. Covid was at a high so I would give Southwest Speed more and more time. $22,600 is a lot of hard earned money and to be treated like I was never a customer is really sad and frustrating. I am now taking the time out of my work day to write this to make up for all that money I gave Southwest Speed. I want my money back so I can get going with my truck and put this in the past. I am not going to tolerate being treated like a nobody and 0 respect.

      I'm at a loss at this point to what else we can contribute to the complaint.  As we've stated the facts of the matter -  Mr. ****** can either accept them or not.   

      If he was in fact a customer of ours and had in fact paid us, it would be simple to refund him.  

      We do not have his property, his money, nor any parts that he says he are missing.  We can and have proved in earlier responses that we have never received monies or payments from him as well.  I understand his apparent frustration - but Mr. ****** is attempting to attack my business and get my business to fix a problem that he has with another entity.        

      A police report in reference to his point of contact that he claims to have dealt with has been given to Mr. ****** directly.  It is also included it in the initial response to the complaint.  For the record it is Bernalillo County Sheriffs Office #*************.  Deputy ***** ****** (Badge #***) was the person who took the report and it is currently being reassigned to a Criminal Investigations Detective where they can be reached at ***** ********.    
      I have spoke to Mr. ****** and told him everything that I know which is nothing in reference to his situation other than his claim to have given cash money to somebody who used to work for my business.   We will continue to assist him with any facts or help that he needs to continue finding out where his claimed missing money and parts are if needed.  This includes involving him in any police investigations and legal or criminal proceedings.   
      Our intentions are not to be disrespectful to Mr. ****** but rather be of service to him to assist if we can otherwise.  As the owner and proprietor of the business I can state only what I know to be fact and demonstrate only what I know to be truths in the matter without making assumptions.

      Hello Mrs. *****,

      I am totally stuck right now on what to do next. **** doesn't want to refund me or give me my parts. I am NOT dealing with his former employee like he keeps stating. The only interaction I have had with his ex employee is at Southwest Speed. **** is trying to make it seem like I gave money to his ex employee to do work outside of Southwest Speed. His Ex employee is not touching my truck! I have another shop waiting to start but I cant because **** took my money for some crucial parts that I needed. **** is not stating facts and is putting everything on his ex employee because of their civil case which seems to be extensive. This is not right! I am not going to let **** take advantage of me, take my money and call me a liar. I have went to his shop numerous times and shook his hand when I made my payments for my parts. I am a paying customer of Southwest Speed and ***** actions will be held accountable in a court of law because I have the receipts which he thought I didn't. I will not let him tarnish my name and spread false information to you. I have the receipts, receipt numbers and dates of when I paid **** at Southwest Speed with no parts or service to show for it. The fact the he doesn't recognize me as a customer is horrendous. This is ridiculous and I don't know how **** can sleep at night knowing he did this to a customer. I gave **** my trust and that got broken. Let me say this one more time, I have never been in business with anyone other than **** at Southwest Speed and all receipts show that. I have never been in business with his ex employee and I shouldn't be in the middle of their problems within ***** Business. **** needs to be held accountable for my $22,600.00. Maybe this is pocket change for him but it's not for me. Thank you.

      To whom it may concern, I have paid this company money to have work done to my vehicle, in the end of 2020, since the vehicle motor was in bad shape I understood the delay with parts. I recently found out that they had issues with money not going to parts. I was made aware of this by another employee, not the business owner. who I've spoken to on different occasions to discuss my build and reasoning for the delays, or raised any suspension. So now that my car got moved to another shop I'm looking for parts that I've ordered and labor that I've paid for and it doesn't exist. The owner **** is having me go after his employee for the money I don't believe it works that way. I'd just like my money back and all other payments owed to SWS paid so I can be done with it. Also After clicking the active duty military button. I do want to make it aware that I did ask for legal advice from coast guard legal and pending conflict of interest documents. We kind of decided better Business bureau would be the way to start. /r X

      My vehicle is currently not at his shop, it is at **** *********** where I had to pay additional money to have work finished on the vehicle. I'm requesting to have money returned to me that I spent on a supercharger set up and holley efi, parts and labor that was paid for but never received.

      I have conversed with ****** on the telephone and I feel that we are indifference as to monies paid and received by my business.  

      I do concur that he car is next door being worked on by a separate entity.  Looking at the response that was noted on my account, I feel that there was some miscommunication between me and the person who took that statement over the phone.  I will in the future communcate solely with the BBB and ****** here on this platform so we can also move forward productively.  

      I am attaching (3) payments that my business has received over the course of our engagement.  There is dispute as to where or to whom ****** paid other monies to.  I asked him to reach out to ***** to confirm or deny this - and to provide proof from his financial institution as to who the merchant or vendor is that was in fact paid these other amounts ****** states went to us -  as I do not have nor show any payments rendered to my business.  

      I am in aggreeance that there is work listed on one of the attached invoices that has not been completed since the vehicle was pulled out of our shop and contracted to perform next door by another business that had the time to do it for ******.  I have zero issue refunding this amount to that invoice since we look like we will not be doing the work going forward. 

      In addition to the work that was actually performed by my business, I am also missing payments for the balanced rotating assembly and parts for the actual engine (408ci LS Based Engine) that we built for ******.  I am not sure if he made a payment to us through another merchant service or person otherwise - but my business, Southwest Speed LLC, does not have any payment towards these parts that we used to build the motor that is in the vehicle at this moment. 

      Would it be possible to get any proof or copies of payment for these parts? Or proof that all of these parts were purchased otherwise?  

      I am excited and ready to get Mr. ******* taken care of and made whole as soon as we can remedy and flesh out the parts and amounts paid for by my business to build the engine.

      Because theBecause the screenshots that were sent were screenshots of my own, not from their records in talks with this business. And a key giving me the run around on what I am owe'd.

      If the screenshots that he said me and you look at those are from my own cop. My own records shows more than fifteen thousand dollars old to Me of work and labor parts that have not been done to my vehicle.

      The screenshot/image/statement Mr. T provides shows a payment to a ****** merchant service for the amount he is claiming he paid us. 

      Southwest Speed LLC does NOT have a ****** account. 

      If you look at the other line item on the statement, it does show a legitimate payment to Southwest Speed LLC that we in fact DID receive.    

      It is my belief that Mr. T paid another person or entity via a ****** reader for parts that he was supposed to get from that person that he knows.  If the charge was by Southwest Speed LLC then it would have been one payment to the proper merchant ID and POS service. 

      Why is there two separate line item payments? 

      Southwest Speed LLC did not receive the larger of those two and when I conversed with Mr. T on the phone about this, he was under the knowledge that he did in fact make that payment to another person.  I suggested a chargeback to that charge to recover his lost monies.  If in fact it was my business that received that payment, then it would and will come out of our account and he would get his money back.     

      I'm not sure why he has not done this yet if he is in fact interested in getting his money back.

      The decision was made by Mr. T to pull his car from our shop and take it to another shop recently so there is a labor charge that he did in fact pay us that we are and will not be able to perform going forward.  

      I asked Mr. T to formally request a refund in that amount to our accounting department by way of an email so that we can process it.  We have procedure and policy for refunds so that we understand the needs and asks of our customers.  The last thing we would want to do would be to refund a customer and not perform the work if that in fact was NOT their true intentions.  We need that statement from the owner/person who paid to process that refund.  Its how we have done business for over 13 years and as you can see there have been zero complaints over that process ever.  We have no problems issuing a refund for that amount that he paid to perform us to do the work initially since we are no longer able to perform it.

      I have yet to see an email with that request.  

      In the meantime, I will await that request if that is his desire and would furthermore advise and request that if Mr. T feels that somebody has wronged him over any other amount that he simply requests a chargeback with his financial instituion to recover those monies.

      There are no other payments in question other than the one made to the ****** account that Mr. T has disputed.  The other work and payments have been satisfied and not challenged at this point by either party.    

      Thank you and I look forward to being able to remedy Mr T and his issue with Southwest Speed LLC.

      The vendor (southwest speed LLC) owes me a refund of $491.66. They have acknowledged this debt, promised to make payment to me, and do not dispute this matter. I paid $7,574.55 for some upgrades to a truck that I owned. One of the parts of the upgrad was never ordered by them when they were performing the service to my truck, and they said they would refund me that amount if I were to purchase the part on my own. The specific part is referred to as a catted "Y" pipe for $1200.00, as well as 1 7/8" Stainless Steel Long Tube Headers (see attached photo for description). After months of asking about the status of the shipment, I purchased the Y pipe myself from Texas Speed and Performance. They haven't returnee emails, phone calls, text messages, with any arrangements concerning this refund. The refund has been owed to me since June of 2022. The owner of the business, Ivan P****, has not returned any of my phone calls or emails.
