November 16,2020, around 2:30pm I went to Kokopelli Pawn and Gun to retrieve my pawn. As I approached the register to talk to the pawnbroker/store owner Chris B******. I had asked for my balance so I can take my pawn out and he asked for my ticket. I did not have my ticket on hand so he asked for my name to look up his index. As he searched he said my name is not in his index and I asked my wife to send me a picture of my pawnticket back home. As she was searching Chris said he found my pawn ticket and told me that my items went out for sale because of no payment. I was in disbelief and I asked if I can buy my pawn back. He told me "if it is not on the shelf then it has already sold". I told him it wasnt right and that I thought I had 30 more days left before it goes on dead pawn. He told me his policy states 90 days exactly and that it is written on the back of my pawn ticket. He also stated "I have been doing this business for over 20 years and I know my rights". I was still shocked and heartbroken and asked him if theres anything I can do and he said there isnt nothing he can do and that I should have called or made a payment before 90 days. I was sad as I left and stopped at the next pawn shop on the way out to ask about the laws. As I suspected they told me contact the BBB and let them know New Mexico laws say other wise about the 90 days. I located my pawn ticket and read the back of the ticket and it states "The loan is due one month from the date made on the reverse side and may be redeemed or renewed on payment of charges. In compliance of NM State laws. Failure to redeem pledge in (90) days from date due forfeits all rights and claims and pledge becomes property of issuer." It is his word against his on the "policy is behind your pawn ticket" Pawn date is 07/28/2021 and due date for payment is 08/28/2021. According to the policy and NM Pawnbroker laws I have 90 days from 08/28/2021 to make a payment or redeem my pawn goods. I feel cheated and want justice.
