I signed a contract with J&F Custom art. I was told 160 days to complete my portrait. I paid my final payment on May 16 2023 and the portrait should have been done on sept 11 2023. I reached out as the day was coming close and she claimed she was having medical issues and quoted me three more weeks. Three more weeks went by and she did not reach out, so I reached out to her without an answer until I said I wanted a refund. She then messaged me back instantly and gave me a sob story about her health and asked me to wait until the end of January, which I did and she never reached out. I reached out and she did not answer again until I said I wanted a refund and was filing a dispute. She then answered and told me she is broke and does not have the money and to wait until March. I just want my money back at this point.Business response

Good afternoon ********. I didn't read the complaint. Sorry. However, in reference to this individual. She signed a contract ahead of time prior to paying that notified her that we do not do refunds at anytime through the process. We also stated the the time frames given are guestimations at best based off the work and what obstacles they present. This is hand done artwork. Not something purchased at a store then shipped. Even at that we agreed to refund her anyway based off the fact that it was taking longer than expected. However, we notified her that it would be 45-60 days before the refund would be processed since its not something we do. These transactions are recorded for taxes and to get are accountant to reverse something that was contractually not supposed to be takes time. But because it wasn't right away she went ballistic and started become threatening and just uncommunicative. Honestly, we could just stick to the original contract and finish the piece and send it. Were trying to be nice here and accommodating. However, no matter what we do this woman is just belligerent about it. We have done hundreds of pieces for people who are all happy about it. However, you can't please everyone. We will stick to what we say and hopefully this lady realizes that she's only hurting herself with all this hate and animosity.Customer response

I am rejecting this response because:As stated in the contract there are no refunds… if I decided I don’t want the work anymore or change my mind. However that was never said, it’s been a YEAR and I have not received the item nor a refund and I feel strongly that if the item that has been paid for is not delivered on then a refund is absolutely necessary. I gave ***** multiple extensions and was promised multiple different times it would be completed by a certain date and ***** never reached out to me to tell me what was going on. She always waited for me to reach out weeks after I was promised the work and she still wouldn’t answer me until I would say I was disputing with my bank. Then I would receive a response almost immediately. Not in a single conversation was I “belligerent and non communicative”. I have attached proof of our conversations I have given her at least 5 chances and was nice every single time until I finally had enough. No threats have been made I simply stated I was filing complaints with the BBB, the ******* ***** **********, and the *** ****** ********** ** ******* and would pursue small claims court if the need arose. I have been extremely accommodating and have given MANY extensions. It’s been a year. If she is unable to produce the product, then she needs to refund the money. I am glad to attach all proof of conversations that I have been more than accommodating and I have tried on MANY occasions to communicate with Darcy, despite her claims otherwise.
