On May 16th 2023, I paid Tin Smith Mechanical $5,188.23 via check #**** to replace my outside A/C unit and he handed me a signed invoice. On May 19 2023 Zack called me and told me equipment was in stock and could be in that day for install, we agreed on an install date of May 22nd. I messaged him the morning of May 22nd asking him if we were still on for installation that day and he messaged me saying the equipment had not arrived after exchanging messages and phone calls about him previously saying it had arrived we then agreed on install date of May 26th . I messaged Zack on the 25th to make sure he was coming on the 26th and he said "it was not looking like it, Might be next week before I can get anyone over" I then requested a refund and he said he would mail out my check on Tuesday the 30th. The morning of the 30th I messaged him asking if he had mailed my refund out, "he said not sir we haven't received a refund yet, should be today or tomorrow hopefully. The following day he told me he just shipped the unit out for refund on 6-1 and once he got his money back he would be sending me a check. This person always changed his story, says one date and never shows up, he basically stole my $5,188.23 check and has not completed any work nor has he issued a refund. I recently filed a complaint on ******** ********** due to there lack of responsiveness and work ethic and other key reasons. I appreciate the BBB for helping me resolve that issue. However, now I am filing a complaint on TSM whom was contracted by ******** ********** to fix my air conditioner. The contractor that *** hired came out on 22 June 22 and assessed my unit and **** the contractor from TSM said that my air conditioner was low on refrigerant 14 pounds to be exact per his text message to me and the conversation we had. The HVAC unit seemed to work for a day and then on 23 June 22 I had to call *** and **** from TSM again to let them know that the unit was still blowing hot air. At this time I called **** back and told him what happened and he said "Looks like a snowman. thats not good. seems like there is a restriction internally." and also said "I hope it didn't leak out. and when i was charging the unit it took awhile for the low pressure die to gain pressure". I then asked him "So what do you think the problem is causing the restriction?" He said "Possible trash in the metering device" I did not get a receipt for the refrigerant addition cost of $570 which I paid him cash for. I only heard from him by text on 12 July and my home still without air conditioning, so I had to press and fix it with a local company in Clovis, New Mexico because ******** ********** and TSM were not responsive and would not communicate with me to explain what the real problem was. I have attached the receipt from the local HVAC company ** ****** who I hired, they identified that my unit was overcharged by over 7 lbs and were professional enough to draft a quote and show me what needed to be done and that the problem was not the shrader valve according to **** from TSM, but was a faulty electrical motor and the unit being overcharged. I only seek a refund for my costs for the refrigerant due to the overcharging. Thank you.
