This spring I hired McCumber Fine Gardening to landscape 2 small gardens. The work was to be done late April after the spring frosts. They insisted on doing the work the second week of April and the last frost was May 18th this year. At least 50% of the plants did not survive the spring frosts.McCumber continues to ignore my requests to schedule the warranty walk through. I paid them $5749.92 for this work which was never been completed per my contract.
This will be my first time filing a formal complaint. I am not new to remodeling houses and updating whole yard landscapes. When I relocated to Santa Fe in June 2018 I was confident that I could make wise choices about the people I hired to work on my house and yard. However, when it came to a small landscaping project the company, McCumber Fine Gardening, which I selected proved to be a terrible mistake. My friends and family have encouraged me to file this complaint. They all feel that the shoddy work that has never been finished and McCumber's refusal to respond to all of my efforts to contact them to schedule and to complete the warrenty walk through is akin to senior abuse. I finished the total house update in December of 2019. Then the pandemic started and I had my own wicked case of Covid in the spring of 2020. I did not start to feel like my typical self again until November of 2020. So other than the initial installation of the irrigation lines, I did not get anything finished in the two small perennial gardens I had planned for the front yard. In the spring of 2021 I started to think about the landscaping, then I had my second covid vaccination, and my reaction was similar to having a repeat of covid. My recovery was again a challenge andl had to accept that I would need help with the final project in the front gardens. I called McCumber Fine Gardening and made an appointment with Kendall M******* to come to my house. Someone unexpected showed up for the appointment. She said that "Kendall looked up your house on Google and decided that it was not worth her time." Kendall had made her decision on a Google view that was done several years prior to my purchase of the house. Had I not been recovering from my covid vaccination I would have recognized the warning. The woman that I worked with from McCumber was obviously not confident about making her own decisions but again I did not heed the warning signs. She said more than once that Kendal "was not pleased that I was not using them to install the irrigation system". Several comments were made that my irrigation system had to be completed within days of the planting. My already contracted irrigation system was finished on the Friday of the same week McCumber did the planting. The representative from McCumber had said repeatedly that their work would be done the end of April. Then in late March I got a text from McCumber that 'they' were on there way to install the garden. As a first time Santa Fe resident I gave no consideration to when the date of the last frost would be. However, as I had a house guest I asked them to wait a week. On April 5th I heard someone in the front yard. I went outside and asked who they were. The response I got was "I am from McCumber", no name or anythingthey were already digging things up I had told the McCumber representative that I wanted to save. I did not learn until mid-morning that the young man doing the destructive digging was a McCumber. He never gave me his name, he did tell me he was a high school drop out and that he had a Medical Marijauna card. His pushy destructive attitude and that information made me even more uncomfortable. However I have a Ring system of cameras so I knew things were being recorded. In addition, the young McCumber was obviously angry that I was not having them install the irrigation system and did every thing he could to bury the flags that I had pointed out to him more than once that the flag needed to be visible because they were part of my irrigation system. I finally put 30 inch stakes where the flags had been.
His anger was confirmed yet again when he stood in my driveway, outside the stucco wall, and yelled "you will be sorry you are not having us install the irrigation system. I can install the best irrigation system in less than an hour" He abusive statements confirmed that I had made the right decision about the individual installing my irrigation system which was completed the same week McCumber did the shoddy planting. My agreement with McCumber was that they would do a warrenty walk through as soon as there would be no more frosts in Santa Fe. The last heavy frost this year was May 18th after which I sent an email to McCumber asking to schedule the warrenty walk through. No response, which has been McCumber's attitude towards me. On May 22nd I had to leave town because of a tragic family accident. There is little to no Internet access in the rural midwest where I was. Luckily my house guests took over as my house sitters when the emergency happend. They are both more than qualified to do the warrenty walkthrough with McCumber, having spent their careers as horticulturist/botonist with the Denver Botanic Gardens. They were not contacted. I returned to Santa Fe on July 4th and sent an email to McCumber to yet again ask for the warrenty walkthrough. Again no response. At least 50% of the plants (all of which were planted when the risk of frost was a huge concern) had died by late May. I have a warrenty on the plants per my contract with McCumber and they continue to refuse to acknowledge any of my requests to get the walkthrough done.
