I have spoken to National Business Factors on numerous occasions trying to get a medical bill resolved. This medical bill was sent to collections in 2021. I thought it had been paid in full as the *** from Cigna showed. I did not receive any communication from *** whatsoever. No call, email or letter. I found out about the debt after running my credit report and actively sought a resolution with *** and Cigna. I was told the interest would be waived if I paid the debt myself. I waited as Cigna told me to do.I followed up with *** today to just pay the debt myself since I am purchasing a home and need my credit restored. The manager, Sunny, refused to abide by previous commitments. When I asked her to listen to recordings, she made accusations and said very hurtful things in regard to this debt. She told me I had to pay all interest or she would not allow it to be removed from my credit to buy a home. *** should not have charged interest during the time I was unaware of the debt. They confirmed not sending any notice out. I was entirely unaware of this debt and a company should not seek to charge interest deceptively by withholding the fact that a debt exists. I would like *** to remove all interest and allow me to satisfy the debt in a fair and just way.

NBF posted to my credit prior to sending any letter notifying me of an alleged debt. They called me on the phone after the debt had been posted approximately 6 months and I have sent three letters asking for validation as the phone numbers they gave me for the medical providers billing can not find any invoices stating that I owe a debt. I have mailed certified letters to NBF and asked NBF multiple times to send me proof of this debt and to not post to my credit until they can prove it's mine. So far they have only sent 1 page with some numbers they claim I owe, that does not match anything the medical providers have. They continue to add interest and post to my credit without any validation or communication. This is extremely unprofessional and they have no regard for people's credit or how it affects their lives by posting to credit prior to having any validations. I have spent months just trying to get a simple answer and asking them to stop posting and they continue posting new interest to my credit without providing any kind of documentation of this debt. I want this pulled off my credit report immediately. I want copies of every document they say they have recieved about this alleged debt.

Levi Jenkins has 4 accounts assigned to this office, after each of our clients exhausted their efforts.     Each of the four accounts are medical debt.  The first account ******** was assigned May 11, 2022, with a date of service of February 5, 2022.  The initial notice was sent on May 23, 2022, and the validation notice was mailed on July 25, 2022.  The second account ******** was assigned on March 16, 2023, with a date of service on November 19, 2022.  The initial notice was mailed on March 27, 2023, and the validation notice was sent on May 29, 2023.  The third account was assigned on March 29, 2023, with a date of service of November 19, 2022.  The initial notice was mailed on April 10, 2023, and the validation notice was mailed on June 12, 2023.  The fourth account ******** was assigned on May 23, 2023, with a date of service of November 19, 2022.  The initial notice was sent on May 15, 2023, and the validation notice was mailed on July 17, 2023.  This office did not receive notification of return mail by the USPS.  This office spoke with Levi Jenkins on June 6, 2024, in which you claimed these bills are wrong and you would be calling the clients.    This office did not give Levi Jenkins any telephone numbers to our clients.   On June 17, 2024, you telephoned this office and asked for a statement, there was no mention of requesting itemized from our medical clients.

This office reported the accounts to the credit bureaus one year after the assignment date, as required by the credit bureaus.  Levi Jenkins sent several consumer disputes to the credit bureaus, this office only received one certified mail, which was answered on August 6, 2024.  If Levi Jenkins has evidence to support his claim that our clients do not have invoices, please send them in to us.  Our clients have not contacted us to indicate these bills have been satisfied.   This office has requested from our clients’ itemized statements for each of the four clients.  This could take up to 45 days for the statement to reach Levi Jenkins.

      Business response

      09/17/2024

As previously explained, both the initial notice and validation were mailed to Levi.  I have attached each of the initial notices and validation that was mailed to this response. The date of each notice is under NBF address.    As previously stated, we did not receive any kind of mail return notice.  The valdiation notices contains veribage to credit reporting on the second page.  It should also be noted that Levi Jenkins received statements from each of the clients in the attempt to collect prior to assignment.

Levi Jenkins has not provided this office to support his allegations that the clients do not have a record of these accounts.  This office has contacted each of the clients to have them send an itemized statement to Levi Jenkins.  This process could take up to 45 days for Levi Jenkins to receive the itemized.

This office follows rules and regulations of Fair Credit Reporting Act as well as the policy of each of three major credit bureaus.  Accounts over $500.00 report one year from assignment date.

I am writing to formally dispute the accuracy of a collection account reported on my credit file byNATIONAL BUSINESS FACTORS. The account in question is reported to Equifax and Experian Credit Pureausand listed under an account ending with ******* reviewing the details of this account, I assert the following:1. No Contractual Obligation:I have not entered into any contractual agreement withNATIONAL BUSINESS FACT. Without a signed contract or agreement directly with me, I am not legally liable for any debts they claim I owe. For a debt to be considered valid, there must be a binding contract between the creditor and the debtor, which in this case, does not exist.2. Lack of Awareness of Original Creditor Account:I do not have any knowledge or recollection of the original account associated with this debt. I am not aware of any such account, nor have I received any documentation or evidence to substantiate this claim from either the original creditor or the collection agency. As such, I challenge the validity of this account and request its immediate investigation.Demand for Immediate Removal:Given the absence of any legal basis for this collection account and my lack of awareness of the original creditor, I hereby demand that this account be permanently removed from all of my credit reports with immediate effect. This account is negatively impacting my credit, and as it stands, there is no lawful reason for its inclusion in my credit file. I respectfully request that you conduct a thorough investigation into this matter and confirm the deletion of this account from all credit reporting agencies.I am fully aware of my rights under the Fair Credit Reporting Act (FCRA), and I expect this dispute to be resolved within the legally mandated time frame.Thank you for your immediate attention to this matter. Complaint: 22001981

I am rejecting this response because: NBF has again and in this communication, failed to provide a contract between myself and NBF. It seems Tahoe FD would have details regarding this billing and responsibility there of, I suggest NBFcontact Tahoe FD for this information. My dispute is with NBF, who placed a filing on my credit report, requiring them to prove a debt to NBF. I've never made a contract with NBF and owe no debt to NBF. It is incumbunt upon NBF to prove the debt valid, not for me to disprove. Short of proof a contract exists between NBF and myself, I demand that these items be removed from my credit report as their filing against me is unbsubsubstantiated and inncorrect.

The contract is between ***************** and Tahoe ******* ***************. When Tahoe ******* *************** responded to a call on April 26, 2019,and again on April 28, 2019, services were rendered to ******************. Those services created two bills, one for April 26, 2019, and a second one for April 28, 2019.   When ****************** failed to provide health insurance information or make payment arrangements for those debts, they were   sent to collection.  Tahoe ******* Fire is well within their rights to assign the debts to a third-party collection agency. ***************** has not stated whether he agrees or disagrees that he owes Tahoe ******* ***************.   As a third-party collection agency we are within our legal rights to place a report on his credit report, which is within our rights to do so.
Since Tahoe ******* *************** provided medical services, I have asked them to send you an itemized statement

      Complaint: ********

I am rejecting this response because:

Subject: Urgent Request for Contractual Evidence or Credit Report Correction

I am writing once again regarding my ongoing concern, as detailed in complaint ********. Despite my repeated requests, I have not received any evidence that confirms the existence of an agreement or contract between us. The lack of a timely response to my complaint, which took 19 days before the 1st response, is quite troubling and not reflective of the prompt service expected.

The ambiguity in your communications suggests that there may not be a contract in place between NBF and me. For clarity and to move towards a resolution, I hereby request that if a contract or agreement does indeed exist, please provide me with a copy that includes my signature. If you are unable to furnish this document promptly, or if no such contract exists, I insist on an immediate correction of the entries in my credit file.

The erroneous entries on my credit report are causing significant financial strain and personal distress, hindering my ability to obtain financial services. Resolving these issues promptly will allow for the satisfactory closure of the aforementioned complaint.

I trust that NBF will address this matter with the urgency and seriousness it warrants. I look forward to your prompt response and a swift resolution to this issue.

       Sincerely,

I am writing to formally dispute the collection account reported by NBF Group **** on my credit report. I am not liable for this debt with NBF Group **** and do not have a contract with them. Despite my repeated requests, they have failed to provide the original contract verifying that the debt is indeed mine.In addition to the lack of documentation, NBF Group **** has engaged in practices that seem to be intended as harassment. They continuously renew and re-report this alleged debt, making it difficult for me to manage my credit and causing undue stress. This tactic of repeatedly updating the delinquency date is both misleading and unfair.Furthermore, I have identified several other common issues that many consumers face with creditors, which also apply to my case:Incorrect Reporting of the Debt: The amount they claim I owe is inconsistent with my records. I believe the debt amount has been inflated without any basis.Unfair Collection Practices: NBF Group **** has contacted me multiple times in a manner that violates the Fair Debt Collection Practices Act (FDCPA), including making calls outside of reasonable hours and using threatening language.Failure to Validate the Debt: Upon my request for validation, NBF Group **** has not provided sufficient evidence or detailed statements to substantiate the debt, as required by law.Misleading Information: The account has been reported under different names and account numbers, creating confusion and complicating the verification process.
