      I dropped off a ***** sewing machine to be sold on consignment on 11 October 2023. After a few months i sent an email to ask about status. Never got a response. Today I wanted to visit the store and saw it was closed.. What recourse do I have?Thanks,******

      Dropped off sewing machine for repairs. Received a message that it was ready for pick up but the business has been closed. The phone number is out of service. I have driven by there multiple times. I even shoved a note under the door and have not heard back.

      I purchased a sewing machine from downtown sewing in Henderson Nevada on March 25nd of this year. I became seriously ill on April 14 and was rushed to the hospital and had emergency surgery. I can no longer see and have been told I have 1 year to live. I have never used the machine, I never even had a chance to take it out of the case. Once released, I went back to downtown sewing on April 23 with 3 friends who witnessed the conversation I had with the owner. The owner stated she could not give me a refund but she could sell it on consignment for the full price of $1599 at a cost of 30% and that I would get back close to the $1199 sale price I originally paid. I signed the contract on April 23 with a price of $1599. Friends of mine were in the business on May 1st and were told the sewing machine was already sold. For 10 weeks I repeatedly called the owner asking where my check was and was given several excuses, the last one being, someone bounced a check to her. I finally received the check on July 12 but it was for $839.30, $280 less than anticipated. This is not what I expected so I contacted the owner again and they stated they sold the machine for sale price and that the $1599 on the contract was only a starting point for them to negotiate with. This was not discussed with me and I did NOT agree to those terms. Contract #**.

      Business Response /* (1000, 6, 2022/07/22) */ On the day Ms. ***** came into the store with her friends, she was told we do not do refunds, exchanges only as stated on her receipt. (see attached) Also, we could not sell the machine as new as the warranty had been registered with *****. As far as ***** is concerned, it would be considered a used machine, second owner. We did offer to sell it on consignment. Her companions were attempting to bully me into giving her a refund, I reiterated the reasons we couldn't. At that time my employee came out of her service room. I explained our consignment policy to Ms. *****. stating we ask the high end she would like to get for the machine and the lowest she would take for the machine. Then we take 30% of the actual sale price. Her friends wanted to know if she would get ALL her money back. I told them it would depend on the price we sold the machine for. I said it was possible or at least a good portion of it. They kept pushing the point. I told them the machine retails for $1599, new. already stated we would have to consider it used. Attached to the last email, is the consignment page typed in by my employee as explained to Ms *****. Ae NEVER promise a price we will sell a machine for. We use the range and try to get the best price we can. We do not go below the lowest price without calling the customer. We never promised Ms ***** we could sell it for full price and it is unreasonable for her, or her companions to believe we could. As far as the reason she was given for the delay in her payment, it was not a bounced check. A vendor had taken and payment twice for an invoice. Then, the same vendor took anther payment and charged for what should have been a credit.These mistakes totalled over $10,000. My business account was completely messed up. When they finally returned all the funds they were not supposed to have taken, which took over a month, I sent Ms ***** her check, which I had already explained to her a week before. She mentioned that a friend had come in to ask about her machine and we told her it was sold. I did remember someone coming in, she did not mention she knew Ms *****. We did tell her it was sold. She left. The person who purchased the machine had put a deposit on it. We removed it from the shelf and put it away from public view. Consider it sold. Terms of the sale we wouldn't just share with anyone. We also do not pay off consignments until they are fully paid for. That customer paid it off three weeks later. As we feel for Ms *****' medical issues, We did exactly what we told her we would at the time we took her machine on consignment. On another note, we recently discovered that our system was not sending all the consignment window information. There was a glitch in the module. We have since had that repaired and updated.
