    Worst experience with an ATTORNEY. HER NEGLIGENCE COST $100,000 in losses. Emily McFarling was hired for the probate matter of my father: Rae Alan ******* Jr. Emily's behavior indicates she didn't know what she was doing or she was just negligent. The Will devised 4 items: 1. 100k, 2. a stream of income from a lease with a monthly payment of $804 and 3. the underlying real property interest (California Property), and 4. a property in Goldfield Nevada called Roaring Camp. The Estate Attorney at the time was Robert ****** and he stopped the monthly payment on the of the California lease. ****** then stated that in order to receive the $100k that the interest in the monthly income and underlying real property had to be signed over to the Executor and if that wasn't done the 100k wouldnt' be paid in Jan & Fed 2013. Emily was hired mid-Feb. 2013 and she billed for spending 3 hours on the case from March 2013 to Dec. 2013. She was quite unresponsive to emails I sent her. She took a wait and watch approach rather than actively do anything. All the while the Executor, Connie *******, had misappropriated the lease funds to herself in the amount of approx. $1400 a month beginning in Dec. 2012 (I hired another attorney and got a subpoena that establishes that fact). EMILY did file a Petition once in Jan. 2014 and sought court oversight but when the hearing rolled around in later Fed 2013, Emily, after speaking with Robert ******* withdrew the Petition to force the Distribution. Emily was provided all the information she needed to actually do something about the fraud occurring BUT EMILY DID NOTHING. A subpoena would have been good in 2013, because when it was finally done it proved the fraud. The Executor has entered into a new lease on behalf of the Estate of Rae A ******* jr and had the bank send the checks directly in her name rather than the Estate in an effort to keep the money). Robert Graham stole $300k from the probate estate while EMILY did nothing and just waited. ********* theft of clients funds began in mid to late 2013. The $100k was being held by ****** but Emily did nothing to obtain it either. I believe she acted negligently in my matter. Emily may or may not treat your case with diligence. She withdrew from this case 3 months before the Estate Attorney Graham was arrested. Another attorney was hired in 2018 after the dust settled and was able to get subpoenas issued to expose the fraud that Emily was unaware of but was happening under her nose. But she really didn't attempt to do any thing of substance; no subpoenas were ever issued, no interrogatories or request for production of documents were sent and no research was done by EMILY to establish the facts. She relied on someone else to tell her their version of the facts and she accepted it without any supporting documentation. Poor reasoning skills were displayed in her strategy. I hired another attorney who received $25k in fees and the case was finally settled six (6) year after the mess created by *****. The Estate had to turn over the steam of income from 2012 to the present (over 170k) so not all was stolen and I did recover the stream of income because the Executor has defrauded the Estate but Estate Attorney ****** stole the $100,000 which he had in his trust account on July 28, 2011. But for *****'s performance It is my firm believe that the 100k would have been distributed.
