      On December 13, 2022 I traded in a pistol to Nevada Firearms and Training. The trade was in exchange for a Surefire RC2 suppressor for $950. I submitted paperwork to the *** to take possession of the suppressor. The paperwork has to be reviewed by the ***, and can take a substantial amount of time sometimes.September 25, 2023 I heard back from the ***, and my paperwork was disapproved by the *** for recent changes to their policies. I talked to **** and fixed the issue with the paperwork and was going to re-file with the ***. Surefire had a new suppressor that had come out, and I asked **** if I could upgrade from the RC2, to the new product Surefire offered, which was an RC3. He agreed, if I would pay the difference in price, which with tax was $891.38 to upgrade to the RC3.The total of the trade in value ($950), and the additional money to upgrade ($891.38) to the RC3 was $1841.38.The upgrade was done on October 20, 2023 at 09:26am.**** said he expected the RC3 would be in possibly by the end of November, and put that in an email. I checked back at the end of November and he never replied. After that I tried multiple times to email him, call him and leave messages, and have stopped by his shop to no avail. I havent heard back and am not sure what his status is. I have all the emails and can pull call records if necessary.As far as what Id like to see out of this, its simple. Id like the Surefire RC3, or a refund of $1841.38.Thank you for your time in reviewing this complaint.Respectfully,***********************

      On 11/16/2023 I purchased a new Glock 17 Gen 5 w/pro night sights from Nevada Firearms & Training for $600. The *** turned down my purchase for an incident from over 20yrs ago. As of today 12/15/2023 *************************, owner of NVFT LLC (Nevada Firearms & Training) still refuses to return my $600. I have left him no less than 25 voicemails & a number of emails to no avail. For 20 days in a row now (I've called him every day), **** absolutely refuses to ************* or answer my emails. I have tried everything I can think of to resolve this issue including in a voicemail that I would even take $600 in other merchandise that I could sell or whatever it takes to settle this. I've even sat for hours in my truck every day in the store parking lot waiting for him to show up. He Absolutely refuses to return my calls or emails. He has no intention of returning my $600. I looked this business up on ************ are numerous reviews for the same problem. 1 of the reviews left states **** ripped him off for $10,000 in consignment rifles. Please Help me. I'm a 71 yr old senior living on 1 social security check per month for $2300 & my rent alone is $1000. I am desperate to get my $600 back. I truly need it very badly. Can you Please Help me? This ************ business needs the Absolute Worst recommendation you can give. Although he still needs to be listed with the BBB so people can see what a Humongous Theif & a Liar He is & Never to do Any kind of business with him. Not Ever.       Mr. *** was denied on his background. When that happened, he was contacted and notified that he was denied. He was out of town at the time and said he would contact us when he returned. I explained that I would be gone as my father was having heart surgery so I would contact him when I returned. When I did get back, I got my daughter who was sick, and in taking care of her I got sick. Due to this I was gone for an additional 2 weeks. Today was the first day I got back to the office, and Mr. *** came up to me as soon as I pulled in to the shop before I even got to get out of my car, and was yelling he wanted his $600. He said he had been calling and leaving voicemails, which I explained I had not been here to get them as I was gone sick. As he stated he has been waiting at the shop everyday for someone to arrive and no one has been here... 

      I told him to give me a min to get the shop open and I would get things taken care of for him. Once we came in, I got his return processed and when I gave him the payment minus the background and restocking fee, he told me no. He wanted everything minus the background check. I showed him the sign posted on the wall showing if you are denied there is a restocking fee and he said he didn't care. He wanted the full amount. I explained to him that its normal policy with most all firearms stores to have a restocking fee if you are denied on a sale. He told me he wasn't leaving until I gave him the full amount. I asked him to leave and he refused. He told me he wanted the full amount or I would pay and I didn't want him getting it another way. I had to contact ************ to ask for assistance as he wouldn't leave. After he sat here and made some calls he finally left. After his threats to "Make me Pay" He is no longer welcome at our building. If he would have been calm and not called me names, and made threats then things could have been resolved another way. Now he will make posts and slander myself and the business.

       

      He has been refunded his money.

      I am rejecting this response because: Yes I was there. He's lying through his teeth with his excuses of being sick. I never once told him that I sat outside his shop waiting for him to show up. Why would he say that & even if I did do this how would he know if he was sick out of town? The gun never left his store. So why $106 restocking fee? I left voicemails every day for over a week & he said he was out of town helping his dad & would be back in 3 to 4 days. After that time expired & not hearing from him I left voicemail's every day for 18 days & sent 3 emails in those 18 days as well. He never answered for almost 3 weeks. A 2 minute phone call to re explain things would have not only been courteous but should have been done as a business/client relationship. It would have also stopped any problems. If you look on Yelp you will find 3 or 4 others that went through the same thing with this guy. All, including one person that was never paid for $10,000 owed to him for consigned rifles, never received any money due them.

       No we did not settle things. This is how he lies. He gave me a post dated check (which is illegal. Call any bank for verification) telling me the check was not good now but would be in 5 days. He post dated the check until 12/28/23 which is 8 days. I just called 2 gun stores,  1 has no restocking fee & laughed about it. The second store does charge a 10% restocking fee. He said he never heard of a 20% fee like with me. I guess it just comes down to greed. So, until I cash this check on 12/28 & actually have cash in hand nothing is settled. If I get this cash in hand on 12/28 then I will email you it's done. Thank you for your help & your time.

      Mr *** is rejecting the response as he is upset and very emotional, and I sympathize.

      Lets start with Mr. *** told me which is recorded on our security system in store that records not only the video but also the audio, "Just give me the gun and it will stay at my house, and once I have the issue cleared up with the courts then I will come back and fill out the paperwork again" I explained that he is a prohibited person and was denied by the *** to purchase a firearm or even be in possession of one due to his criminal history. It would not happen, at that point he told me he was not leaving without his money back. Mr. *** thinks that he can sidestep the law, and do what he wants. As I stated before he told me he would get me back. This is his way of "getting me back" for not just "giving a prohibited person" a firearm.  I will have to give the recordings to the police and or the *** to see if they want to pursue charges against him for attempting to get a firearm even though he is aware he is a prohibited person.

      He says "Yes I was there. He's lying through his teeth with his excuses of being sick", I was sick as was my daughter who I had to keep home from school, I'm not posting school records for my child to show that she was out sick and I was sick as well, but I just stayed home and there is no way to prove that, but I was home sick. Next Mr. *** claims "I never once told him that I sat outside his shop waiting for him to show up. Why would he say that & even if I did do this how would he know if he was sick out of town?", The first part where he says he never told me he sat outside the shop he stated in his original complaint, ". I've even sat for hours in my truck every day in the store parking lot waiting for him to show up. He Absolutely refuses to return my calls or emails", which I wasn't aware until I read the complaint, again proving by his own words that he was here for "hours everyday in the store parking lot" and I was never here. As far as returning emails and phone calls, the emails and phone calls/voicemails are on the computer and phone at the shop, I didn't get any emails until I returned, and after he left yesterday I heard the numerous voicemails that he left, there was only one email. 

      In regards to the restocking fee, it is posted in store right above the desk where he sat down to fill out the ****, made his purchase, and its printed on his receipt that he agrees to all posted terms and conditions and all sales are final. The sale was completed between Mr. *** and the store when he made the purchase. The background is the next step in receiving the firearm. Its just like people who purchase online they make payment and have it sent to a dealer for final processing. When the have the background check processed and are denied, they can return the firearm, and most online stores charge a 25%-30% restocking fee plus the shipping fees. If you purchase it locally it the same thing, Why doesn't Mr. *** tell us the shops that he spoke to and we can verify his claim that they have no restocking fee. 

      As far as "other people" on "yelp", in 15 years of business there are those like Mr. *** that are not happy about restocking fee's or having to actually pay for the time a business spends taking care of them as a customer. Yes I would like every customer to have a good experience but unfortunately you can not please everyone. the other ****** customers that have done transactions over the last 15 years have been happy. There will always be a few customers that you cannot please no matter what you do. 

      Mr. *** wanted to be paid back on the spot. Refunds are from checks processed by the accountant who was not available due to the holiday. To make it easier for Mr. *** I offered to give him a check from an account that is not our main account. I told him and he signed a agreement acknowledging that he was being provided the check that would not be able to be cashed for 5 business days, not 5 days. weekends and holidays do not count as banks are closed especially this time of year. The accountant when back on the 27th will move the money to that account, and that is why the check provided was for the 28th.

      This man has been lying so long he's become very good at it. Just to give you a point of FACT. I would be more than happy to forward all emails I sent him. Including the 1st email he did respond to. Including a screen shot of date & time he called me back to explain he was out of state helping his father & wouldn't be back for 3 or 4 days. He is SO lying about being at home sick so he never received my calls or emails as well as how many I sent. 1st, I sent him 4 emails (he answered my 1st email) on 11/30/2023, 12/07,2023, 12/08/2023 & 12/18/2023 that I would be more then happy to forward to the BBB. So tell me this. If he didn't hear my voicemails or see my emails until he got back to his shop on 12/19/2023, then how did he answer my 1st email on 12/01/2023 when he was supposedly out of state with his father? He was able to hear my voicemails & read my email then when he was out of state (11/30/2023) SO his statement about not getting any of my voicemails or emails & not even able to get them  until 12/19/2023 is a Total Outright Lie. A lie from a very accomplished lier who has had a lifetime of experience. This shows what I mean when I say he is an accomplished lier. I will also be happy to forward a screen shot of my phone records showing he answered my 1st email, from out of state (unless this was also a lie) with a phone call on 12/01/2023 telling me he was out of state & would be back by 12/06/2023 & he will pay me back my $600 then with NO mention of a restocking fee. He never answered any voicemails or emails since 12/01/2023 again. Which any other legitimate business would have. 

      As far as his explanation of his restocking fees being posted behind his desk. First off, the day when I 1st purchased the gun he never mentioned anything about a restocking fee. 2nd, when I finally caught him at his shop & he told me about the restocking fee he turned around from his desk & took a framed letter down from the wall (6' high) & held it out saying "it says right here that I charge a 20% restocking fee" & then hung it back up never letting me read it. Also the lettering is SO small you can't read anything from 3' away. I dare anyone to sit in the chair in front of his desk & be able to see or read anything on that paper. When sitting in the chair this letter is at 6' high & 8' away with the smallest print ever. No one can read it & your never told about it until something like this comes up. The **** of a bad business that you don't want to do business with. 

       I could go on but I've have had enough of this back & forth. This complaint is not done until I cash his illegal post dated, no funds in account check on 12/28/2023. If I can cash it then this complaint will be done. 

       Question, what kind of reputable business doesn't even have $500 in their business account & has to write a check like this.

      I purchased a two suppressors from ************************* at Nevada Firearms and Training (NFT). One on January 23 and the other on January 24 of 2023. I was told upon purchasing the suppressors that it would take approximately 2 weeks for the suppressors to be shipped to NFT from its vendors. After they arrived I was then supposed to come back in, purchase a $200 tax stamp for each suppressor, take fingerprints and an updated picture, then fill out all necessary ATF paperwork. I followed up with emails from him on 2/28/23, 3/26/23, 4/17/23 and 4/26/23, I only received a response from him on 2/28/23. To paraphrase, he stated he was out of town and would take care of it when he got back. After sending multiple follow up emails I eventually decided to dispute the charges since I did not have the product nor a refund for the product, which I was awarded by my credit card company. Apart from those two suppressors, I had another suppressor that was sent to him when I moved here to ********* from *******. Working with NFT, I resubmitted the Form 4, Application for Tax Paid Transfer and Registration of Firearm. This Form 4 was submitted prior to the purchase/experience of the other two suppressors, but was ultimately denied and required me to resubmit. At this point, due to my experience on the other two suppressors, I decided I would like him to send the suppressor to another dealer as I would prefer not to do anymore business with NFT. He is now trying to charge me $195 to release the suppressor to another dealer.Breakdown of charges:$75 transfer fee x2 (in and out)$25 ************ processing fee $10 per chargeback for the two suppressors To charge $20 for chargebacks when you dropped the ball is unethical. To charge $75 for an "inbound" fee that should have been charged over a year ago if that were the case is simply punitive because I don't want to do business here anymore. I'm ok with paying $100 ($75 and $25). Character limits prevented me from going into more detail.

      **************** did purchase 2 suppressors. I had gone out of town and ended up in the hospital which was why he had no response. When I did return I was made aware of the chargebacks which were unopposed as I was in the hospital and was not aware of them at the time that they sent the request. They were refunded by our processor. I canceled the order in our system and canceled the order with the vendor for the suppressors since they were on hold while I was out of town. ******************** Form 4 application for his original suppressor was also denied by ATF due to a failed Background check. He requested ********** to another dealer which we told him was not a problem and we would do it, but we needed to collect the fee's that were owed. We have a fee of $75 for inbound and/or outbound transfer processing for NFA items which require a lot of paperwork processing, there is a $25 fee for our vender that we paid for the fingerprints to silencershop, and a shipping fee of $20 to ship for a total of $195. We did not charge a fee for the chargebacks as stated, we even offered to resubmit the form 4 once the issue was resolved for free. With transfers we collect our fee's once the item has been processed and approved as our job is not finished until the final pickup of the item(s). Our fee's are posted not only online on our website but also posted in store. We don't have an issue doing the transfer and will transfer it as requested once our posted fee's have been paid. We were not charging him anything in excess of what was posted and certainly not charging him for the chargebacks. At this point we paid the $25 for ************ fingerprinting, and spent the time to log the item in, the time to do his fingerprints and do the form 4 submission, store it securely, and provide him advice on how to resolve the denial with ATF. We have paid money out and not collected anything from **************** for the first suppressor. He wants us to pay the shipping to the new dealer, and provide our time for free essentially for all the processing and storage of his original suppressor, and not pay us for the fingerprinting that we paid to silencershop.

      The fee's are exactly as they should be, we normally do charge a cancelation fee which is posted in store and on our website for orders. Due to the issue of being unavailable and that he was unable to reach us we didn't charge the cancelation fee. We also have not charged any storage fee's at this point once he was denied for the suppressor by ATF which we normally do charge storage fee's if the application is denied.

      Had we charged the 20% restocking fee which is posted and the $10/day storage fees which are posted, **************** would owe us a lot more than the $195 that is his current bill.

      I am rejecting this response because:

      So let's address the root cause of why I did not want to have the first suppressor resubmitted through you. I purchased two additional suppressors from you end of January, and our last communication was on February 28, 2023. I did not file for a chargeback until early May. First of all, I don't believe you were out of town or in the hospital for that entire time, but that is irrelevant. REGARDLESS of whatever you have going on, if you are operating a business, it is unacceptable to not provide any update on purchases of over $1200 total for over two months. That is simply bad business. If I was operating a business and I was legitimately unable to respond to a customer, the first thing I would do once I returned to work would be to respond to my customers which you never even had the decency to address. To be ***** with you, I'm not even sure I believe you ever ordered the two additional suppressors. I'm aware of another scenario (not involving Nevada Firearms and Training) when a seller was charging customers for NFA items then pocketing the money and never providing the item, but that will be addressed at a later time with the appropriate agency. At this point, I've already paid the $195 fee so hopefully ATF will process the Form 3 quickly and we can move on.

      You have paid the fees that were posted and listed. The form 3 will be filed to transfer to your dealer. I will email them to let them know you have paid the fees and we are filing the form 3. If you reject the explanation then why pay the posted fees? As to you rejecting the explanation given, I will email you the stamps in my passport showing my travel so there is no doubt that I was out of the country. Trust me when I say that I wish I had been back as the extended time gone has caused many issues and cost me tens of thousands of dollars. 

      I am sorry to hear about other dealers taking money and not delivering. We have been a GOLD dealer with silencershop for 10 years delivering thousands of suppressors to people. At the beginning of this year we stopped working with silencershop to process everything in store as they had numerous submission issues resulting in denied applications due to paperwork errors. Your Form 4 however was not one of them, your denial was due to a failed NICS check. You said it was one of the other people on your trust and they were removed. If that is the case you should have no issue now.

      I hope your submission this time goes thru without any issues.

      I had two expensive ($5,000) rifles sent to this shop because they claim to specialize in silencers and both rifles had built in silencers. When I contacted the owner to pickup my guns, he told me he sold them. He gave no explanation other than the rifles had been in his shop for more than 45 days. Of course they were in his shop for more than 45 days, it take almost one year for the paperwork to clear before he would legally be allowed to give me my guns.

      Business Response /* (1000, 5, 2021/12/16) */ Mr. **********, made a purchase online. We tried to contact him several times when his rifle showed up in Feb of 2020 and he never responded. After the storage fee's exceeded the value of his rifle and it was considered abandoned. At that time it was sold. He made another purchase and had it delivered in May of 2020. He then showed up 5 months later asking about his first rifle. We explained that he never came into do his paperwork to get it processed and that the storage fee's exceeded the value of the rifle so it was considered abandoned and sold to recover our fee's. We started the paperwork for his second rifle and after the threats from him we told him that we would not be doing business with him and to let us know where he wanted the second rifle shipped and it would be shipped there. He never responded to us this time either and after it sitting here for almost a year we finally sold it as the storage fee's again exceeded the value of the rifle by a long shot. This customer never answered his phone, he tries to use the fact that as he has claimed he is well known to his advantage. The items he purchased were NFA items that required him to submit fingerprints, photos and go thru an extensive background with the FBI that would have taken 10-12 months for approval. He never came in to do any of this on his first rifle, when he did show up to inquire about his first rifle we got his prints and photo's and information to start his paperwork, but after his threats we opted to ship his rifle to another dealer of his choice at our own expense, but then he never replied with where he wanted the rifle to be sent. After over a year of it sitting here we finally considered it abandoned as we had not heard from him. He wasn't aware that his purchases had to be processed by the ATF & FBI before they could be released which may be why after he came in and we explained the process he stopped responding. Maybe he can't pass a criminal background check by the FBI. We don't know. At this point the rifles here both for over a year before we considered them abandoned and sold them to recover our fee's. He is not owed anything and we will not do business or accept anything for him in the future! He has been trespassed from the property. The fact that he hasn't even contacted us in over a year, and waited this long to file a complaint just shows his lack of timeliness and that he doesn't follow thru with anything. I have attached a document which breaks down Mr. D********* reply one sentence at a time and includes my response. I have provided all emails and documents to BBB in the original submission Business Response /* (4000, 12, 2022/01/04) */ Mr. ********** is obviously not aware of how the NFA procedures work as mentioned prior. A Form 3 is a form used by Dealers to transfer between two licensee's. The seller of the firearm files a Form 3 with ATF and once approved by ATF then ships the rifle to the receiving dealer. The receiving dealer has no information and fills out nothing, that is all done by the dealer selling the NFA item. The dealer that sells the item typically includes the information of who the buyer is with the NFA item when it is sent. We did have his information as we stated we tried to contact him several times when the first rifle showed up in Feb 2020. We never got a response and left several messages. We do maintain records and copies of the Form 3's which do not have any information on them except our information and the shipping dealers information. It has none of the information for the buyer. We did make several calls and never heard anything from Mr. ********** until November of 2020 when he emailed about the second rifle and then finally came in to do paperwork for the second rifle as explained previously. There are signs posted in store and on our website that very plainly discuss storage fee's and abandoned items! His ignorance is not our problem. In Fact we kept the items longer than what was needed to try to give him an opportunity to come pay the fee's and submit his fingerprints and photo and that never happened. We are not a storage facility. Mr. **********'s claim that it takes 7 months for the form 4 to be approved, is approximately close, but his Form 4's cannot even be submitted until we have Fingerprints, Photo's, and he signs the Form 4's. How is any of that supposed to be done if he never replies or comes in to get that done. There is also a $200 tax stamp payment that has to be made, and he never paid for that either, so there was no way possible to even submit the form 4's. If he would have replied to a voicemail, called, or contacted us at any time that proces would have been explained in detail like we do with ALL customers. Mr. **********'s claim that he came in and Spoke with Zach and updated his picture on the Kiosk, is also wrong the Kiosk doesn't take pictures. The only thing we do with the kiosk is collect fingerprints, which after checking Mr. **********'s profile was created in November when he came in after we had explained that he had to come in to submit prints and photo and sign, so the claim that he had done it prior is wrong. Also, we do not collect the tax stamp payments after the form 4 has been processed, we collect that prior to submission, along with the NFA transfer fee, neither of which had been paid... The response I sent Mr. ********** on 11/20/2020 was correct in that I told him I was canceling the form 4 that we were submitting and to let us know what dealer he wanted his rifle sent to and provide their FFL & SOT which is required by ATF for us to submit a Form 3 so we could ship it. We never got a response to that email. The rifle sat here just like the first one and after the storage fee's exceeded the value it was sold to recover some of our fee's. If Mr. ********** contacted an attorney and they sent a letter it was never received. Again if he had contacted us when he claims to have contacted us, then we would have gladly shipped the rifle. Since it was over 12 months the second rifle was considered abandoned and sold. This is not a scam, nor are we a storage facility for people to store firearms. We will gladly process any paperwork as needed to comply with Federal Regulations, and we have been doing so for a long time. I did tell Mr. ********** about one other person that had left a firearm sitting here for an extended time without contacting us after several attempts to contact them we finally ended up selling it to recover our fee's. We have thousands of satisfied customers! We have never stolen any firearms from anyone! We would not have our Federal Firearms License if that was the case! Had Mr. ********** followed the steps that are posted both on our website and in store, and/or contacted us back after leaving messages for him then he would not be upset and he would have both of his firearms by this point. The fact that he waits to contact anyone for 10 months or more after an item has been delivered to us and after 45 days of no contact it starts accruing storage fee's then that is on him. We have held items for people who call us many times, including several service members that were deployed and when they returned their items were sitting here waiting for them. As a thank you for their service we waived the storage fee's for them since they did contact us and let us know that they were deployed. There is nothing we can do at this point as we have already had detailed conversations with Mr. ********** about this matter over a year ago. If he would like the rifles replaced we would be happy to replace them both, but he will owe the storage fee's, which would be quite substantial and those would have to be paid in advance to us getting the replacements. There was no sign in the store stating this policy of storage fees. There are many websites that allow you to see what a website looked like on a specific date. ********.com did not add a storage fee policy or anything about "abandoned items" until 09.29.2020. I will upload copies of ********.com from each month prior to 09.29.2020 when the policy was added. This policy was added after Mr. D******* sold my guns. The $10 per day storage fee was never expressed and it is excessively, out-of-line with storage fees at other gun shops. Even so, at $10 per day, the guns were worth $2600 and $1800. That would mean they sat for 260 days and 180 days before the storage fee was greater than the value of the guns. I would like to see proof of when these guns where sold. If they were sold before 260 and 180 days then I would expect to receive the difference between the sale price and the storage fees. The information Mr. ********** provided doesn't show any of our in store posted polices, the same ones that have been posted since we opened for business, the file he provided also refers to standard title 1 firearms that we got on transfers, not NFA items, which is what he ordered. So all the information that he provided is moot as it doesn't refer to the type of firearms that he had transferred to us. Additionally as previously mentioned he waited a year before filing the compliant, which was a almost a year after the firearms were sent to us and we finally were able to talk with him. So 2 years later he has decided that now he wants to pursue this. His firearms were abandoned! If he would like to go to court then lets go, I have already had prior discussions with our attorney about abandoned firearms and he has assured me that the procedures and policies we have in place go beyond what is required by law. Mr. ********** is doing this to be a nuisance. If Mr. ********** had replied or taken as much interest in his firearms when they were ordered and came in instead of waiting years, he would have had them, instead he never bothered to contact us, or reply to calls made to him, instead he abandoned them. This matter should be closed, we have made the offer to replace the firearms if the storage fee's are paid, the storage fee's far exceed the value of the firearms! Storage fee's have been posted in store since our opening day.
